CALLED TO ORDER At 7:01 P.M., by Vice Mayor Doug Mostyn II. PLEDGE OF ALLEGIANCE Bill Schisler, lead the Pledge of Allegiance. III. INVOCATION Elwin Clifton, delivered the invocation. IN ATTENDANCE Ora M. V. APPROVAL OF AGENDA A motion was made by Bill Schisler and seconded by Elwin Clifton, that we approve the agenda as submitted. A motion was made by Eddie Honea and seconded by Elwin Clifton, to amend the motion to move agenda item F. to the First Item of business. The amendment to the motion carried unanimously. The amended motion carried unanimously. VI. APPROVAL OF MINUTES A motion was made by Elwin clifton, seconded by Eddie Honea to accept the minutes of July 9, & 10, 1991 Special Meeting, July 15, 1991 Special Meeting, July 16, 1991 Regular Meeting, and July 30, 1991 Special Meeting be approved, but noting there were some typing errors. A motion was made by Bill Schisler and seconded by Helen Key, to amend the motion to make corrections to Special Meeting July 30, to show the meeting was a Special Meeting not a Regular meeting. Also, the Regular Meeting of July 16, 1991 page 5, paragraph 5, under the heading Pima County Department of Transportation and Flood Control District, to strike: "to amend the Amended motion", for it to read "to amend the motion" and to add the word "in" so the sentence will read as follows: "A motion was made by Bill Schisler, seconded by Jo Rex to amend the motion MINUTES OF REGULAR COUNCIL MEETINGt MARANA TOWN COUNCILt AUGUST 6t 1991 to insert the words: "in Phase iA"." Also on page 5, para- graph 6, number 1. should read: "remove one Police officer from the Budget;" and number 3. should read: "remove one laborer from the Road Crew" and insert the word: "in" so it reads: "and to leave in the k-9 unit." The amendment to the motion carried unanimously. The amended motion carried unanimously. VII. PETITIONS AND COMMENTS Brisa Apadaca, 43 W. Simpson, Tucson, reported on the summer program and wanted to thank the council for providing the funding of this program and for matching money for the life guard salaries. She went on to say there were approximately 82 children registered between the ages of 4th grade through 9th grade. The program offered a fun and healthy alternative to drugs and anti-social behavior. The Marana School Dist. provided the trans- portation to and from the summer program. The follow four par- ticipants addressed the council, giving their opinion of the program and answered questions from the council: Steve Mc Nulty, 13560 W. Price Lane, Marana, AZ Ruth Brandon, 12365 N. Blacktail Road, Marana, AZ Shenise Pitts, 11733 W. Watz, Marana, AZ Wendy Sandoval, 16636 W. Watz, Marana, AZ Frank Zaragosa, 11401 W. Linda Lane, Marana, AZ Mr. Zaragosa addressed his concerns to the Council regarding what he feels to be the Town's practice of hiring non-Marana resi- dents over Marana residents. VIII. ANNOUNCEMENTS The next Founders Day meeting will be held August 22,1991 at 7:00 P.M. at the Town Hall. A. (formerly Item F) Town Council Considerations to Direct the Town Manager to Recruit An In-house, Full-Time Attorney A motion was made by Bill Schisler, seconded by Eddie Honea, to direct the Town Manager to advertise for an in-house Attorney with a salary of $40,000-$45,000. A motion was made by Bill Schisler, seconded by Helen Key, to amend the motion that we adjust the salary range to: $40,000.00 to $48,000.00. Motion failed 3 nay 2 aye. A motion was made by Eddie Honea to amend the motion to adjust the salary to 44,000.00, no second. The original motion to direct the Town Manager advertise for an in-house Attorney with a salary range $40,000-$45,000. The motion carried. Vice Mayor Doug Mostyn suggested that Bill Schisler be an ex-officio on the In-house Attorney selection committee. 2 MINUTES OF REGULAR COUNCIL MEETING~ MARANA TOWN COUNCIL AUGUST 6~ 1991 B. Adonis Subdivision Street Improvements and Town Acceptance of Streets A motion was made by Elwin Clifton, seconded by Bill Schisler, carried unanimously to accept information as provided on the Adonis Subdivision Street Improvements and Town Acceptance of Streets. C. citizen Petition to Extend the Closing Date For The Marana Park Pool A motion was made by Eddie Honea, seconded by Bill Schisler, carried unanimously not to extend the closing date for the Marana Park Pool. D. 2ND Reading and Adoption of Amendments to Town Personnel Policy 01.02.02 A motion was made by Eddie Honea, seconded by Elwin Clifton, carried unanimously to accept the 2Nd Reading of Personnel Policy 01.02.02. Recess 8:40 p.m. Back in Session 8:50 p.m. E. Town Council Residency Requirements For Ail Town Council Standing Committee Appointees A motion was made by Eddie Honea, seconded by Helen Key, that the council take no action on Residency Requirements for All Town Council Standing Committee Appointees. The motion carried with Elwin Clifton voting nay. F. (Formerly Item A) Town Council Discussion of Dog Control And Enforcement A motion was made by Bill Schisler, seconded by Elwin Clifton, carried unanimously to direct our Town Manager to draft a leash law Ordinance and submit to the Town Council with other informa- tion at a later date. Council Member Eddie Honea suggested the Town Manager look into a fine structure payable to the Town or Pima County to pay for services. G. Public Hearing and Petitions and Comments Procedure A motion was made by Elwin Clifton, seconded by Eddie Honea, carried unanimously to accept the recommended changes limiting speakers to 5 min. at which time the Town Clerk would notify the Mayor that Time has expired by holding up a Time Expired card. 3 MINUTES OF REGULAR COUNCIL MEETING~ MARANA TOWN COUNCIL~ AUGUST 6~ 1991 H. Town Council Discussion On Potential Amendments To The Arizona League of Cities and Towns Municipal Policy Statement. The Town Manager asked the council to review the 1990 Arizona League of cities and Towns Municipal Policy Statement and if they see any anything they would like to add or see changed to put into written form . Council member Bill Schisler asked the Town Manager to ask staff, court and the Town Attorney if they have any recommended changes, adding that is where some of this comes from. I. Arizona League's Festival Of Cities and Towns Leilani Schisler reported to the Council what the Town did last year and emphasized it would take more than one or two people to put the booth together and to man it because it was great deal of work. Bill Schisler recommended that any council member that wishes to go to do so, and that in the past the Town has paid for the registration and hotel room, but the Council Member is responsi- ble for transportation and miscellaneous meals experience. A motion was made by Helen Key seconded by Bill Schisler, and unanimously carried not to participate this year in having a display/booth in the Festival of Cities and Towns. J. Town Attorney's Report A monthly departmental report was filed by Town Attorney, Higgins (Copy On File) Harold K. Mayor's Report There was no Mayor's Report due to her absence. L. Manager's Report The Town Manager referred to his memo to the Council requesting them either verbally or in writing for any unanswered question or concerns they may have concerning Waste Management and he would get that information back to them as soon as possible. Roy Laos also reported that the negotiation with Pima County to use gasoline facilities at both Sanders Rd and Ina Rd which is also in the town limits is going well. If we get the IGA ap- proved we will get fuel at 83 cents per gallon. Presently we are buying fuel at Circle K at a 1% service charge at retail prices. X. EXECUTIVE SESSION PURSUANT TO A. R. S. SECTION 38-431-03 (A) (3) AND (1) TO DISCUSS PERSONNEL MATTERS A motion was made by Eddie Honea, seconded by Bill Schi$1er carried unanimously to go into Executive Session at 9:55 P.M. Out of Executive Session at 10:30 P.M. and MINUTES OF REGULAR COUNCIL MEETING~ MARANA TOWN COUNCIL~ AUGUST 6, 1991 XI.
