Invocation Bishop Robert Condit gave the invocation. Approval o__~ Agenda' A motion was made by Doug Mostyn, seconded by David Morales carried that the revised agenda be approved as presented. and VI. Approval o~ Minutes a. Reqular Meetinq, May 7, 199~ A motion was made by Bill Schisler, seconded by David Morales and carried that the minutes of the May 7, 1991, meeting be approved. VII. Petitions and Comments Brisa Apadoca, 43 W. Simpson, said she is involved in the Suramer Youth Program at the Marana Pool, and that she recently learned the pool would not be opened during morning hours. She requested the Council to provide funding for a lifeguard at the Marana Pool for two mornings a week for the seven weeks the program is in session and that her agency, Pima Youth Partnership, would also provide a lifeguard for two mornings. The cost to the Council would be between $600 and $700. Patricia Williams, request, adding that the children 14495 N. Warfield Cr. supported Ms. Apadoca's that this would give the community the message are the most important product of Marana. Ms. williams said there has been a lot of negativism in the community, and suggested a positive program be initiated by the Council which could be called a "Good Neighbor" program. She said the cost would be insignificiant and presented written guidelines for placing the proposed program into operation. Doug Mostyn said he had received two letters this date writted by two members of the County Board of Supervisors indicating the members of Marana Town Council had been wined and dined by Waste Management. He said he resented the tone of these letters and expressed the opinion that not one member of this Council would sway their vote for a dinner and dance. He said his personal opinion is that this "poisen pen" letter is not worth the paper it is printed on, which is official County stationery. He said he does not want to be intimidated by the County in an issue of this type of high school graffiti. He stated that it was his personal opinion that as an elected official he demanded a public apology from these two Supervisors. for sending this letter because it is intimidating, it infringes upon his rights, and it is emplying things that he is above doing and he resents it. David Morales said he echoes the same thoughts as expressed by Doug Mostyn. He asked that the picture be hung in Council chambers. Mayor Narn thanked him for the portrait and for his four years of service on the Town Council. Elwin Clifton, Jr., councilman elect, 10720 Lettuce Lane, endorsed what Doug Mostyn said regarding the letters from two members of the County Board of Supervisors. Mr. clifton said he was also speaking for Nelson sabbe, Director of the Marana Chamber of Conm]erce. Mayor Harn said a letter of protest regarding the letters under discussion will be sent to the County Board of Supervisors. Vice Mayor McCrea asked that a copy of these letters be sent to the entire Board of Supervisors, and Mayor Ham said she had already taxed them a copy. Vice Mayor McCrea publicly thanked his family for putting up with him these past seven years while he has been serving on the Marana Town Council. He also thanked the current and past Councils and Town staff. He said some of the items the Council had discussed in the past that he would like to see accomplished after he is gone are: (1) The Sign Code needs to be revised because it is prohibitive, anti-business and could be modestly revised to help business and the Town of Marana, (2) The General Plan reviewed within the next year, with public input, and every five or six years thereafter, (3) he would like to see the Council take more responsibility for the daily operations of the Town, rather than to give all the responsibility to the Town Manager, and (4) He would like to see the Budget Committee and the Town Council meet monthly to review the budget. Vice Mayor McCrea expressed the opinion that if the Council would stick to the budget and allow no overruns regardless of the reason, that at the end of this fiscal year the Town sould be solvent. Bill Schisler thanked the three out-going Councilmen (Tom Hum, David Morales and Vice Mayor Bob McCrea) for their effort, dedication, work and regular attendance in serving on the Marana Town Council. VII. Announcements Mayor Harn announced that at 11:00 a.m., on May 27, 1991, the VFW will hold a flag raising ceremony at the Town Monument, and afterward there will be a pot luck dinner at the park. Mayor Harn said these activities will give the VFW and the community the opportunity to make a statement of support for our armed forces. MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL MAY 21, 1991 PAGE 4 OF 11 The Town Manager stated the Certificates of Election for the three incoming Councilmembers will be presented to them along with the statutory oath of office at 3:30 p.m., on May 24. He invited the public to attend. Mayor Ham announced that at the regular Council meeting on June 4, a plaque will be presented to the three outgoing Councilmen in appreciation of their service to the community. IX. Public Hearing a. Ordinance 91.04 Amendments to the Specific Plan Process A motion was made by David Morales, seconded by Bill Schisler and carried the Council go into public hearing on Ordinance 91.04. Bob Sharp, 4640 Sunrise Dr., Suite 217, stated he has been responsible for Hartman Hills, Tangerine Hills and Foothills specific plans. He feels it is a good idea to come before the Council on a yearly basis to report what has or has not been accomplished and the reasons why or why not the plans are not proceeding as originally planned. He said he feels it would be wrong to set a five-year expiration date on the specific plans and to have to start all over again because they have spent $100,000 on each of these plans in compiling the best zoning and useage for the property that the plans cover. He said each of these plans cover hundreds of acres, and the current rate of absorption of housing units in Tucson today are at a 30 year low, so it doesn't make sense to start the development of those plans today. A motion was made by Doug Mostyn, seconded by David Morales and carried to come out of public hearing. X. Marana Volunteer Fire Department, Inc. A monthly departmental operations report was filed by Rick Insalaco, Chief of Marana Volunteer Fire Department. (Copy on file). Chief Insalaco reported that the boundaries have been drawn for the formation of a fire district, and they are in the process of getting the legal descriptions from the County. The matter should be voted on by the people of Marana in November. Chief Insalaco said the bids for sale of surplus property will be held on June 3. Doug Mostyn congratulated the Department on successfully landing a contract with MUPI. The Chief said the Department along with the fire departments of Flowing Wells, Picture Rocks, Northwest and some others put on a successful training session at a structure on Saturday. (Copy on file) Bill Schisler questioned page 2 (IV) (b) of the report. The Town Manager explained to the Council that the Town charges the specific applicant for plan review through the application fees. He reported a meeting was held on this date on the initial reports of Waste Management's development plans; This matter is scheduled to go before the Planning and Zoning Commission on June 5. Prior to that date several meetings will take place to make sure this development is in the best interest of the community, B. Police Report A monthly departmental operations report was filed by the Acting Police Chief, Dale Bradshaw. (Copy on file). In reply to Vice Mayor Bob McCrea, the Chief informed the Council the grant request for the police dog has been submitted to the appropriate agancy, but there has been no response to the request. C~ Street Report and Park Report A monthly departmental operations report was filed by Robert Kern, Road Supervisor (Copy on file). In reply to Bill Schisler, Mr. Kern stated the people in Adonis subdivision would like the Town of Marana to take over their roads and streets, but the streets are not up to grade. In reply to Vice Mayor McCrea, Mr. Kern said the ligament has been put down on Barnett Road, and they are waiting for it to cure, which should be by Friday or Saturday. Mayor Harn reported all the quit claim deeds have been secured for Barnett Road from Sandario to Sanders Roads. A monthly departmental operations report filed by Park and Pool Supervisor, Robert R. Kern (Copy on file). Mr. Kern reported that 90% of the sprinkler timers are not working right in the park, and that Pima County is helping with it, and the cost of the repairs should not be too drastic. Jo Rex and Mayor Ham remarked on how good the pool and the park looks and how many people are utilizing the park. Mr. Kern reported they have already completed some of the salty features in the park, and they are going to make a lot of changes, especially on the playground equipment. D. Water Maintenance and I~Drovement Report A monthly departmental operations report filed by Robert R. (Copy on file). There were no questions on the water report. Kern E_~. Water Financial Report Dan Groseclose, the Water Representative, said he could not give a financial report because he is no longer in control of the checkbook. The Town Manager said Mr. Groseclose has access to the checkbook at any time, and expressed the opinion that MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL MAY 21, 1991 PAGE 6 OF 11 Mr. Groseclose has the responsibility according to his contract to prepare the report. Mr. Groseclose disagreed, and Mayor Ham said she would meet with these two men later to resolve this problem. F_~_. Maqistrate Report A monthly departmental operations report filed by the Magistrate, George Kline (Copy on File). In reply to Vice Mayor McCrea, the Magistrate stated the Court does have a volunteer person who is paid $20 a day regardless of the hours worked. He added that no volunteer has worked less than four hours a day, and this money paid to them is for travel, food, and clothing. He said this was approved by former Town Attorney, John Moffitt several years ago. The Magistrate said he is no longer in control of the finances of the court and is not comfortable with that arrangement. G. Buildinq Inspector's Report A monthly departmental operations report filed by Vick Charnis, Building Inspector (Copy on file). In reply to David Morales, The Planning and Zoning Administrator said that Kal farms had made application for a sign permit for an off-site advertising sign 500 square foot in area, and the code does not allow for that. He said the matter has been appealed to the Planning Commission. H. Financial Report A monthly financial report filed by Eileen Dilts, Clerk (Copy in file). Bill Schisler objected to the Town spending more money than it is taking in. He said before more money is spent the outstanding amount owed to the Town Engineer and past Town Attorney should be paid. Mayor Ham requested that the Council continue to receive a written report on all outstanding bills. Doug Mostyn asked when the Council would be able to see the beginning balances on the financial report, and the Town Manager did not kncw, but said progress is being made to rectify the problem. He said it was not necessarily a major problem because it can be determined, based on the balance sheets, how much is being spent and how much revenue is coming in. The Town Manager assured the Council that the Town is solvent. I. Planninq and Zoning Report The monthly planning and zoning administrator's report was filed by Chuck Dinauer, Planning and Zoning Administrator (Copy on file). Mr. Dinauer said the Planning Commission will meet on June 5 because of vacation schedules of several members. He said that with the appointment tonight of a new member, the Commission will have a full complement. XII. Order of Business XII. A. Town Engineer's Appointment and two-year contract F&D/ GLHN Engineer's Bill Schisler said he thinks the Arizona Revised Statutes require appointments of Engineer, Clerk and Police Chief to take place after the new Councilmembers are seated. Mayor Ora Harn and Vice Mayor McCrea asked that the Town Attorney review the contract before approval. Doug Mostyn wants the Town Manager to get a cost comparison of other engineering firms. A motion was made by David Morales, seconded by Doug Mostyn and carried that appointment of a Town Engineer be postponed to the June 4, 1991, agenda and that the Town Attorney review the contract. XII. B~ Comstat Information System's Contract Amendment and Scope of Services The Town Manager stated that this contract has been negotiated at a reduced rate over what the Town is now paying this individual. He felt that because of the incumbent' knowledge of the system, the new financial analyst would need him on an interim basis only. This individual would also be used to assist in internal control and system analysis if the Town Manager felt it necessary. In reply to Vice Mayor McCrea, the Town Manager said 96 applications have been received for the position of financial analyst, and of these 25 are CPA's. He said the selection committee will begin meeting next week and will select those they feel most qualified to present to the Council for hiring consideration. A motion was made by Bill carried that the Comstat be approved. Schisler, seconded by David Morales and Information Syst_m ~ Contract Amendment XII. C. Mayor's Recommendation to Fill a Vacancy on the Planning Commission A motion was made by Doug Mostyn, seconded by Davi~] Morales and carried that Kathleen Golden be appointed to the Planning and Zoning Commission. RECESS A recess was called at 8:30 and the meeting resumed at 8:35. XII. D. Ordinance 91.04 Amendments to the Specific Plan Process, Recommendation and Ordinance from th~ Planninq and ~oninG Commission. A motion was made by David Morales, ~econd~d MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL MAY 21, 1991 PAGE 8 OF 11 carried that Ordinance 91.04 be approved with the deletion of Section B. Vice Mayor McCrea explained to the audience that this matter was discussed at the planning and zoning level, and what they were trying to do with this proposed ordinance was to prevent developers and speculators from coming to the Council requesting to be annexed into the Town and coming up with these specific plans until they are ready to develop, but that the way the Section B of the document is worded, more problems would be created than would be solved. XII. E_~. Approval to Annex the North Half of Tanqerine Road Riqht-of-Wa¥ A motion was made by Bill Schisler, and seconded by Doug Mostyn that the Council approve annexing this four-mile section of the north half of Tangerine Road right of way. The Vice Mayor questioned the cost of this annexation. The Town Manager stated there is no significant cost, that it is a jurisdictional problem. The motion carried. XII. F. Town Council Review Dnd Discussion of Pima County's Oro Valley Rec¥clinq Ordinances At the request of the Council, the Town Manager presented Information on how other entities are recycling their waste. Bill Schisler suggested that a recycling program be tried on a voluntary basis before the Council takes any formal action on a recycling program. David Morales said he thinks recycling should start with the Town, and the Mayor is already checking into recycling the white paper. Vice Mayor McCrea said the town will eventually end up in a bad shape if they don't make an effort to recycle, and he added that at least one-half of the solid waste in the community could be recycled. He suggested the Council begin making the community aware of the ability and availability of recycling. No action was taken. XII. G. Marana and Oro valley Intergovernmental AGreement for Dispatch/Communication Services A motion was made by David Morales and seconded by Doug Mostyn that the Intergovernmental Agreement between Oro valley and Marana and Resolution 91-18 be approved. The Town Manager said that the only difference between this agreement and the former agreement is that 24 hour co~n~munication tapes are now required, that acceptance of the Dais is made a part.of the document, and that Oro Valley will be charging a $5 fee for processing of warrants submitted by the Marana Court to Oro Valley Police Department for entry into the ACJIS computer system. The motion carried. XII. H__~. Discussion of "Bed and Booze" Tax Bill Schisler stated the Marana Regional interested in this bed tax in order to help Arts Council is support the arts. MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL MAY 21, 1991 PAGE 9 OF 11 David Morales said he felt the Council should wait until after these bed businesses come into the community before assessing such a tax because it might discourage companies from locating in the Town. The Town Manager disagreed with this approach, and stated if such a tax is approved, it should be now in order to avoid problems with these constituants in the future.~ Discussion ensued over the many projects in the Town a bed tax revenue would help support such as the Arts Council, the Chamber of Commerce, Founder's Day activities, and the Clean Machine. A motion was made by Bill Schisler, seconded by Doug Mostyn and carried that staff be directed to draft an ordinance which would impose a 1% bed tax. The Town Manager reminded the Council the bed tax would now be 3% because the Town already imposes a "use tax" on hotels and motels. XII. I. Honea Heights Water System - Main Line Bids A motion was made by Vice Mayor McCrea, seconded by Doug Mostyn and carried to award the bid for labor and equipment to O'Leary Construction at $14,186.55 and to award the bid for purchase of waterline materials to the Dana Kepner Company at $10,670.90 for a total of $24,857.45. XII. J__~. Mayor's Report Mayor Harn stated she had attended the D.A.R.E. Program at the Estes Elementary school, and has done some reading programs with the Junior High. She attended a 5th grade class at Estes Elementary where the children were involved in a small business venture. The students walked to the Town Hall and were given a mock business license. She participated in an outing at the Breakers with some of the Junior High students. Threw out the first ball of the Little League season to the Town Manager. Along with the Town Manager, met with officials of Oro Valley to discuss Tangerine Road and the IGA Communications agreement. Met with the land owners along Tangerine, Town may be able to pick up most of that to the Town. and it looks like the right-of-way at no cost MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL MAY 21, 1991 PAGE 10 OF 11 Met with County Manager Chuck Huckleberry and County Supervisor, Reg Morrison regarding the Tangerine Landfill. At that time she told them whatever discussion the town of Marana was having with Waste Management Co. was between the Council and the Company and none of the County's business. Met with the Governor in Phoenix at a Women in Municipal Government's luncheon. Attended a black tie event where she was a guest of the Greater Tucson Economic Council for "Up with People." They have outgrown their quarters and the city of Denver is trying to entice them to their community. Went to Evergreen Air Center to watch the 747 plane come in that carries the Shuttle from the space program. NASA has awarded Evergreen Air Center the maintenance contract for these 747 planes. Was invited to a special reception for President Manuel Pacheco, the newly appointed president of the University of Arizona. Attended a happy hour at Tucson National Golf and Athletic Club to meet the Secretary of Co~erce. XII. K. Manaqer's Report The Town Manager is working with PAG, and a meeting is set for next week with the executive director and the official in charge of transportation and planning to pursue grants through ADOT to initiate some improvements at the intersection at Sandario and Marana Roads. He said the intersection is in dire need of being redesigned because of safty factors. The Town Manager reported that he had toured the Marana Unique Products, Inc. (MUPI) facility. He said he was impressed with the cleanliness of the plant and the salty features in place at the facility. He said that only one employee is not from the Town of Marana and that this business is an example of a commitment on the part of a new entry into the town, who truly does what they say they are going to do. The Town Manager said Pioneer Paint had been thinking of moving to Marana. They initially were looking into the old greenhouse location but they were concerned with the sprinkling system. The owner of MUPI is going to contact Pioneer Paint to pursue this matter. Mayor Ham instructed the Town Manager to make a call on this issue tomorrow. XIII. Executive Session a. Personnel Matters Pursuant to A.R.S. Section 39-431-.03 A motion was made by Doug Mostyn, seconded by Bill Schisler and carried the Council go into executive session at 9:40 p.m. Regular session resumed at 10:05 p.m. XIV. Future Aqenda Items A motion was made by Doug Mostyn, seconded by Bill Schisler and carried that discussion on purchasing a new recording system be placed on a future agenda. David Morales asked that the departing councilmembers be sent a courtesy agenda over the next year. XV.
