HomeMy WebLinkAbout08/14/2006 Blue Sheet Amendment to IGA for Cortaro Road Improvements TOWN COUNCIL MEETING INFORMATION TOWN OF MARANA MEETING DATE: August 14, 2006 AGENDA ITEM: I. 1 TO: MAYOR AND COUNCIL FROM: Frank Cassidy, Town Attorney SUBJECT: Resolution No. 2006-123: Relating to Public Works; approving and authorizing the Mayor to execute Amendment No. One to the Intergovernmental Agreement with Pima County executed April 6, 2004, for design and construction of improvements to Cor- taro Road. DISCUSSION On April 6, 2004, the Mayor and Council executed an intergovernmental agreement with Pima County for design and construction of improvements to Cortaro Road. It has now been deter- mined by Pima County that the Town's share of the costs of construction need to be increased by $16,000. This single financial amendment will allow the County to exceed the previously ap- proved $7,000,000 limit listed in the aforementioned intergovernmental agreement. RECOMMENDATION Staff recommends adoption of Resolution No. 2006-123, approving and authorizing Amendment No. One to the Intergovernmental Agreement with Pima County. A TTACHMENT(S) Amendment No. One. ONE TO THE INTERGOVERNMENTAL AGREEMENT WITH PIMA COUNTY EXECUTED APRIL 6, 2004, FOR DESIGN AND CONSTRUCTION OF IMPROVEMENTS TO CORTARO ROAD. WHEREAS, on April 6, 2004, the Mayor and Council executed an intergovernmental agreement with Pima County for design and construction of improvements to Cortaro Road, and WHEREAS, it has now been determined by Pima County that the Town's share of the costs of construction needs to be increased by $16,000; and WHEREAS, the Mayor and Council find that the terms and conditions of Amendment No. One to the aforementioned intergovernmental agreement are in the best interest ofthe Town. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that Amendment No. One to the aforementioned intergovernmental agreement between the Town of Marana and Pima County, attached to and incorporated by this reference in this resolution as Exhibit A, is hereby approved, and the Mayor is hereby authorized to execute it for and on behalf ofthe Town of Marana. BE IT FURTHER RESOLVED that the Town's Manager and staff are hereby directed and authorized to undertake all other and further tasks required or beneficial to carry out the terms, obligations, and objectives ofthe aforementioned amendment. AMOUNT: $7,000,000.00 AMOUNT THIS AMENDMENT: $16,000.00 REVISED TOTAL ~OUNT: $7,016,000.00 AMENDMENT WHEREAS, Pima County and the Town ofMarana have entered into an Intergovernmental Agreement for joint and cooperative action, as referenced above, dated March 1, 2005; and WHEREAS, Pima County and the Town ofMarana agree that the aforesaid Intergovernmental Agreement be modified; NOW, THEREFORE, the parties hereby agree that the aforesaid Intergovernmental Agreement is amended as follows: ARTICLE 13. FINANCING OF THE PROJECT A. Allocation of County Bond Funds: is changed to read: County shall therefore contribute $7,016,000.00 of County HURF bond funds as the County's contrIbution to the Project for construction costs incurred by Town. The effective date of this Amendment shall be August 1,2006. All other provisions of the Agreement, not specifically changed by this Amendment, shall remain in full force and effect and shall be binding upon the parties. .
