BUILDING UPDATES GENERAL OFFICE • Received a certification; Plans Technician Bloom, Plans Technician Carpenter, and Inspector Gleeson • Continuing the cross training for all staff. RITZ CARLTON RESORT DOVE MOUNTAIN • Construction is in steady progress. • Attending regular meetings at the job site bi-weekly on Wednesdays. • Casita's 4, 5, & 6 are approved. B. CAPITAL IMPROVEMENT PROJECTS SILVERBELL ROAD INTERCEPTOR PROJECT: 1999 -2- • All channel `A', `B' and `C' concrete works have been completed. • The first phase is complete and backfilled on box culvert #7 under proposed Ina Rd. • Sub grade preparation is complete for the area north of Ina Rd and the placement of base has commenced. Earthworks are nearing completion on Ina Rd. west end. Major curb and gutter pours are complete on Silverbell Rd. Sidewalk is being placed along the east side at the north end of Silverbell Rd. Sewer work has commenced in the Park area. • Traffic signal bases are being poured at the Silverbell/Ina Rd intersection. • Exploratory archaeology work has been completed. • At the end of September, 60% of the completed construction contract work based on total cost has been spent and total project elapsed time is at 45%. To date, 80% of Phase I construction time has elapsed. • Value engineering, environmental concern monitoring, testing, quality control and assurance are on-going daily. The project has had no reported safety issues. • Based on the latest schedule (Sept. 8) submitted by the Contractor, the Phase I opening to Silverbell Rd. traffic may occur from early to mid November. Finishing roadway appurtenances will continue through February. Review of alternatives and options are ongoing to reduce construction time and costs. THORNYDALE ROAD PROJECT: • The project is over 85% complete. Substantial completion of construction is expected by mid-November. Weather permitting, placement of the final lift of asphalt will begin on October 20th and last for approximately one week. Once asphalt paving and striping is completed, further opening of additional lanes of northbound and southbound Thornydale Road will take shortly thereafter. • Permanent traffic signal systems at all intersections are now operational. Fine tuning of timing and detection is ongoing. • Work is continuing throughout the project on curb, sidewalks, access ramps, landscaping, street lighting, street signage, etc. • Ongoing public and business outreach remains an important part of the project. A specific focus of the project team is in regard to the expected large scale traffic impacts that will occur when the final lift of asphalt is being placed within the entire project area. Also, as part of the public and business outreach program, the project team is actively involved in preparing for a roadway grand reopening and ribbon cutting event on November 22 to coincide with an area wide business fair. THORNYDALE RD. / TANGERINE RD. INTERSECTION IMPROVEMENTS: • Town staff is working with the developer to revise the construction plans. The developer's plan conflicts with the proposed work that the Town was constructing on the North Leg of the intersection. Revised plans should be completed and reviewed by end of October. • Estimated to begin construction the Early December 2008. TWIN PEAKS PROJECT: � Conditional cultural clearance obtained, there are areas of further recovery that will need to be cordoned off from construction initially. • 404 permit comments being returned to corps again -3- • Final right of way being acquired. UPRR easements payment sent to UPRR. Final condemnation hearing first week of September. Working with legal and title companies for east side dedications • UPRR C&M agreement signed. Meeting before ACC set for Camino De Manana closure • Demolition begins September 2. • Prospective bid of October, 2008 still possible TANGERINE FARMS LOOP ROAD: • Punch list, site cleanup work, and project closeout continuing • Drainage along Street A into Cemex pit design work begun based on latest topographical map supplied by Cemex • Signalization of the I-10/Tangerine Road intersection: Poles delivered and installation begun September 22, completion scheduled for late October HONEA HEIGHTS WATER. SEWER AND PAVING PROJECT: • NAC Construction completed water improvement installation prior to July, system tied over to new service and site cleanup was completed mid July. • Paving was completed in July, utility adjustments and site cleanup is in progress • Two additional sewer manholes, sewer main and service connections installed for low income housing project on town owned property on Whitney Ln., in new road alignment for Sydney Place • Sanitary sewer as-built information is being compiled for submittal to PCWMD and ADEQ for final Approval to Discharge, to be submitted after final manhole rims adjusted to new street pavement elevations and final survey information and post paving inspections completed • Connection of homes to new sewer main to begin after Approval to Discharge issued by ADEQ, program currently calls for approximately 200 homes to be connected over a three year period. Bid documents are in the process of being developed for the first phase of this work. • Sidewalk construction planned once all homes are connected to the sanitary sewer system CAMINO DE MANANA PROJECT: • 404 permit application has been submitted to the Army Corp. The Corps is waiting for a concurrence letter from Fish and Wildlife. Town staff is expecting to have a permit by mid- October. • Construction Manager At-Risk (CMAR) procurement method has been selected as the project delivery method. • Contractor's proposal submittal deadline for CMAR selection is October 30, 2008. The pre- submittal meeting will be held on October 20, 2008. • Selection of a contractor will be announced in mid-November. • Construction is estimated to start approximately two months after the Twin-Peaks Interchange will start (March 2009), and construction should be about 500 days. -4- BARNETT LINEAR CHANNEL: • Environmental investigations have begun for utility pot-hole locations. Revised 60% plans are estimated to be completed by end of December 2008 PAVEMENT REHABILITATION PROGRAM: • The 2008-2009 pavement rehabilitation program construction should start End of October or early November 2008 C. LEGAL WASTEWATER LITIGATION • Judge Richard Mangum signed Marana's proposed form of judgment on September 30, and it was posted to the file on October 15. Judge Mangum struck out the Town's requested Rule 54(b) language, so the judgment is not "final and appealable"; however, it is "law of the case" and will be controlling law for further proceedings in the Superior Court. • Judge Mangum granted Pima County's motion to amend its answer on October 8, and it was posted to the file on October 14. • Sewer system schematic diagrams are being prepared in anticipation of future pleadings addressing the ownership of specific sewer infrastructure. • The deadline for a ruling on Pima County's motion for reconsideration is November 14; however, the motion appears to have been denied by implication when Judge Mangum signed the judgment. WASTEWATER TRANSITION • On October 8 and 9, Frank Cassidy attended the PAG Management Meeting and the PAG Regional Council Meeting, respectively, concerning the approval of Pima County's Regional Optimization Master Plan (ROMP) 208 Plan Amendment and the initiation of Marana's 208 Plan Amendment seeking designated management agency (DMA) authority for the Marana area. Legal staff is participating in twice-weekly wastewater staff ineetings to address ongoing transition issues, including the preparation of new draft Town Code provisions addressing wastewater. CMID IGA NEGOT1aTiorrs • A key meeting occurred on Monday, October 13, the results of which will be a subject of discussion at an October 21 Council executive session. DEANZA REFERENDUM LITIGATION • A proposed draft stipulation of undisputed facts is currently being circulated and negotiated. • Motions for summary judgment based on the undisputed facts will likely be filed within 30 days. POLICE DEPARTMENT PERSONNEL MATTERS • Jane continues to provide coordination and oversight with respect to the following: • Barbara Harris' PARB hearing, which began during this period but was not concluded. • The internal investigation being conducted by Lia Keller regarding the hostile work environment complaints of Harris, Ochoa and Garbini. -5- • The internal investigation being conducted by Merle Turchik regarding the complaints received from Sgt. Ochoa's "subordinates." PUBLIC WORKS PROJECT PROPERTY ACQUISITIONS • Acquisitions continue, through condemnation litigation and negotiations, for remaining Twin Peaks/Linda Vista interchange right-of-way. • Cedric Hay is leading the effort to coordinate appraisals and property acquisition negotiations to obtain right-of-way needed for the Camino de Manana project. • Town legal staff is preparing letters to property owners of land affected by rezoning conditions requiring dedication of land for the Camino de Manana project, explaining the basis of compensation for right-of-way. OTHER NOTABLE CIVIL MATTERS • On October 9, Frank Cassidy presented an overview of American land use law to the Oro Valley Citizen's Planning Institute. • On October 8, a new version of a proposed First Amendment to the Foothills (Tapestry) Development Agreement was received from the developer's attorney, which is currently in staff review. • On October 6, Cedric Hay notified cemetery developer Jon Aries of Significant Land Use Change (SLUC) procedures associated with the approved cemetery and crematorium use. • On October 3, the Town's outside counsel filed an answer on Pima County's behalf in the United Fire (Honea Heights Sewer Project) litigation. • On October 1, the Legal Department issued a formal opinion that appointment to the Northwest Fire District Board of Directors does not give rise to a conflict of interest for a Town employee. • Cedric Hay provided background legal analysis for the October 14 solid waste presentation to Council. • Cedric Hay has been working with Public Works staff to develop a strategy regarding the strip of land behind the Thornydale noise wall, for presentation to Council on November 5. • Cedric Hay has been working with the Planning Department to address illegal lot splitting in the Camino de Manana area. • Jane Fairall is working on a standard uniform policy for the Water Department. • Frank Cassidy has been negotiating a cell tower site lease with Crown Communication, Inc., which is scheduled for consideration by the Town Council on October 21. PROSECUTION ACTIVITIES AND SEPTEMBER 2008 STATISTICS: • The September 30 Legal Department report indicated that the Department prosecuted and closed 72 criminal cases in Marana Municipal Court. The correct number is 145 prosecuted and closed cases for the month of September. • In September, the Legal Department accepted 303 new cases from Marana Police Department and other state agencies for future prosecution. E. OPERATIONS AND MAINTENANCE UPDATES FLEET SERVICES • Met with Finance Department to discuss contingency plan for 2009 vehicle purchases. TRAFFIC SIGNALS • Warked with contractor on Thornydale/Orange Grove project to activate new traffic signals successfully. SIGNS AND MARKINGS • Installed "Stop Ahead" legends on Moore Road at Tangerine Farms intersection. STREET MAINTENANCE • Entire Sunflower subdivision has been cracksealed and patched to prepare for chipseal project (Pavement Rehab Program). • All other routine maintenance programs are proceeding as scheduled (shoulder grading, mowing, trash removal for I-10, on/offramps, etc.). Pa�s �vn REC�aTION MARANA CULTURAL AND HERITAGE PARK • Punch List Items are being addressed • Entry monument installation complete by October 20. • Marana Heritage Park Rail Road — new car is in final stages of completion, wheels and hydrostat transmission to be installed by October 20. • Marana Fall Festival at the Heritage Park being planned for October 25. • Operations and Maintenance Department has been great help assisting maintenance staff in cleaning the undeveloped park area. SILVERBELL-CORTARO DISTRICT PARK • Installation of private sewer for park and water system is underway. • Archaeology recovery is complete coordinating back fill and grading operations with Public Works and Environmental. -8- CONTINENTAL RESERVE BALL FIELD LIGHTING • Lighting design in 75% review. • Estimate for installation underway. • Staff is coordinating contract with Sellers and Sons. They have completed field lighting installations for Pima County, City of Tucson, and Sahuarita. TORTOLITA MOUNTAIN TRAILS WILD BURRO TRAILHEAD • Engineering plans have been approved. • Ritz Carlton development is using the trail head location as a holding area for salvaged plant material. • Anticipate clearance for trail head development summer of 2009. ORA MAE HARN PARK IMPROVEMENTS • Restroom in final phase of design. PARKS AND RECREATION COMPREHENSIVE MASTER PLAN UPDATE • First Public Meeting planned for October 25 at Heritage Festival at Heritage Park. POLICE GETTING ARIZONA INVOLVED IN NEIGHBORHOODS (G.A.LN.) • Project kick off Saturday October 1 l, 2008 from 2 pm. to 8 pm. Community Government on Wheels represented by Town staff, council members, and police officials. • Neighborhoods/ Complex's visited: Continental Reserve, Twin Peaks HOA, Cantera Apartments, The Springs Apartments, Sunflower, Heritage Highlands, Richland Estates and Yoem Pueblo. Celebration was a huge success with meeting residents of our community. Towiv CLE� NOWSAGENDA UPDATE • Parallel testing to occur for September 16 and October 7 Council Meetings • Original live date was November/December but we are ahead of schedule and will be live by October 10 • Monthly refresher/new user training available as needed � CREW & MARANA 1 Ol • CREW started September 3 and will run for 8 weeks, and Marana 101 for 10 weeks (1 week of community partners, 1 week of Town tour) • 34 currently registered for CREW • 21 employees and 3 commissioners registered for Marana 101 ELECTIONS • Nomination packets were available beginning September 3 • Five packets were picked up • Candidate papers cannot be filed before November 10 L UTILITIES DEPARTMENT WASTEWATER: • The Town of Marana's request with PAG for its Clean Water Act Amendment is moving forward to the Scope of Work Committee. • The committee will have its first meeting during the last week of October. FY20O9 CIP UPDATE: • Beginning on October 13, 2008, Operations and Maintenance will evaluate short-term and long-term projects which need to be evaluated for each well site. BUDGET FOCUS: • Due to the condition of the economy, the Utilities Department is evaluating all budget line items to determine if there are opportunities to postpone, forgo, or restructure planned projects in an effort to preserve funds whenever and wherever available. PUBLIC NOTIFICATION: • The Utilities Department received customer feedback of less than 2% from the public notification mailer regarding Total Coliform. • The majority of concerns/questions were relating to the health affects and safety of the water. • All customers were satisfied with the response to said concerns/questions from Utilities Department staff. SAFETY: • The Utilities Department is working with Orville Saling of the Public Works Department to institute in-house training for field staff. • The first training session will cover lockout/tagout procedures and confined spaces. • The Utilities Department is also attempting to receive PDH Credits to distribute to all staff members who participate in the training session.
