BUILDING UPDATES GENERAL OFFICE • All Building Safety staff inembers are signed up for building code training classes third week of October RITZ CARLTON RESORT DOVE MOUNTAIN • Construction is in steady progress. Attending regular meetings at the job site bi-weekly on Wednesdays. PROJECT UPDATE REVIEW • Lasertell has Tentative Improvement in review. • Monsoon's Grill opening Sept 13, 2008 (July 2008 Building Permit Report attached) -2- B. CAPITAL IMPROVEMENT PROJECTS SILVERBELL ROAD INTERCEPTOR PROJECT: 1999-050 � Concrete spillways for the main channel outlets are complete. Handrails are being installed on various structures. Grading, concrete, rock slope protection and channel drop structures are nearing substantial completion overall. The channel `C' low flow channel is 95% complete while grading continues in the other two channels. • Of the main drainage structures under the roadway, box culvert #1, is complete; #2, is complete; #3, invert poured, wall and deck forms started; #4, is complete; #5, is complete; #6, triple Reinforced Concrete Pipe (RCP) installed; #8, is complete; #12, single RCP 50% installed. • Curb and gutter has been placed along the east side of Silverbell Rd. from the start of the project to Bradstreet Dr. Two lanes of asphalt concrete have been laid and traffic shifted. Earthwork is progressing from the north end of the project to Bradstreet Dr. along the west side. Ditch cutting is in progress throughout the project. • The sanitary sewer is complete from the existing manhole to manhole #10 including laterals. Two runs and two manholes remain. The potable water main and joint utility installations being approximately 90% complete with remaining work in progress along Ina Rd. • Exploratory archaeology work is on-going in the park area adjacent to Silverbell Rd. The park construction has received DEQ approvaL • An anticipated 25,000 cubic yard shortage of fill material is being imported in stages as suitable material is identified and tested. Ina Rd. has been detoured to the south of the original intersection so as to open up the proposed intersection area in its entirety and accelerate the work. This shift will allow for approximately 85% of Reinforced Concrete Box Culvert #7 crossing Ina Rd. to commence outside traffic lanes and the installation of permanent traffic signals. Existing Ina Rd surfacing has been milled and embankinent has commenced. • At the end of August, 45% of the completed construction contract work based on total cost has been spent. To date, 65% of Phase I construction time has elapsed. • Value engineering, environmental concern monitoring, testing, quality control and assurance are on-going daily. The project has had no reported safety issues. • Based on a revised schedule (Sept. 8) submitted by the Contractor, the Phase I opening to Silverbell Rd. traffic may occur from early to mid November. Finishing roadway appurtenances will continue through February. Review of alternatives and options.are ongoing to reduce construction time and costs. THORNYDALE ROAD PROJECT: -3- • The project is approximately 79% complete. Substantial completion is expected by mid- November. Autumn weather permitting, the project team is working toward placement of the final lift of rubberized asphalt in calendar year 2008 ahead of the original schedule which did not have this phase of work occurring until Spring of 2009. • Orange Grove is now fully open to eastbound and westbound traffic. Operation of the permanent traffic signal system at the Thornydale/Orange Grove Intersection is scheduled to start up by mid October to coincide with the partial opening of southbound lanes on Thornydale and River Roads. • Work is underway at the northwest quadrant of the Thornydale/Costco Intersection following a switch of traffic on September l Oth. At-grade reconstruction of this intersection is now scheduled to be complete by September 24th. • In order to expedite construction of the Thornydale/Horizon Hills Intersection, planning is well underway for its full, ten day closure beginning September 24th following completion of the Thornydale/Costco Intersection. Special access will be given to businesses located in the northwest quadrant of this intersection while this accelerated work occurs. • Along the west side of the Thorn�dale mainline, base paving from Orange Grove to Costco was completed on September 11 `. Work on sidewalks and access ramps within this segment is occurring. Cement treatment of the roadway subgrade, finish grading of aggregate base, and installation of concrete curbing is underway north of Costco Drive to the CDO Wash. Base paving of this segment of the roadway is currently scheduled for September 22 & 23` As has been customary for the project team, providing access to businesses particularly affected by any ongoing work is a prime consideration. Ongoing public and business outreach remains an important part of the project. Communication efforts to advise area businesses about the status of the project continue with the goal of such information helping minimize inconveniences to their operations and customers. A specific focus of the project team is in regard to the expected large scale traffic impacts that will occur in October when the final lift of asphalt is being placed within the entire project area. Other focus is being given to recent, incomplete media reports characterizing the project as having an overly adverse impact on certain businesses. Also, as part of the public and business outreach program, early stage conversations have begun toward developing the scope and schedule for a concerted roadway grand reopening event. • The project team remains engaged in an impressive partnership, fostered in part by the construction management at risk contract delivery method, which is reaping dividends in terms of both schedule and cost. THORNYDALE RD. / TANGERINE RD. INTERSECTION IMPROVEMENTS: • IGA with the RTA was approved by the Town's Mayor and Council and wili now go for final approval with the RTA on October 23, 2008. • Estimated to begin construction the early November 2008. -4- • Duration of construction is anticipated to take 3 months TWIN PEAKS PROJECT • Conditional cultural clearance obtained, there are areas of further recovery that will need to be cordoned off from construction initially. • 404 permit comments being returned to corps again • Final right of way being acquired. UPRR easements payment sent to UPRR. Final condemnation hearing first week of September. Working with legal and title companies for east side dedications • UPRR C&M agreement signed. Meeting before Arizona Corporation Commission set for Camino De Manana closure • Demolition begins September 2. • Prospective bid of October, 2008 still possible TANGERINE FARMS LOOP ROAD: • Punch list, site cleanup work, and project closeout in progress • Drainage along Street A into Cemex pit negotiated with Cemex, design and construction modifications to follow • Signalization of the I-10/Tangerine Road intersection: site electrical work substantially complete, signal cabinet being checked and prepared by ADOT, awaiting delivery of poles for installation to energize signals, currently expected in September, 2008 HONEA HEIGHTS WATER, SEWER AND PAVING PROJECT: • Paving was completed in July, utility adjustments and site cleanup is in progress • Two additional sewer manholes, sewer main and service connections installed for low income housing project on town owned property on Whitney Ln., in new road alignment for Sydney Place • Sanitary sewer as-built information is being compiled for submittal to Pima County Waste Water Management Department and Arizona Department of Environmental Quality (ADEQ) for final Approval to Discharge, to be submitted after final manhole rims adjusled to new street pavement elevations and final survey information and post paving inspections completed • Connection of homes to new sewer main to begin after Approval to Discharge issued by ADEQ, program currently calls for approximately 200 homes to be connected over a three year period. Bid documents are in the process of being developed for the first phase of this work. • Sidewalk construction planned once all homes are connected to the sanitary sewer system -5- CAMINO DE MANANA PROJECT • 404 permit application has been submitted to the Army Corp, Town staff is expecting approval from the Corp in the next couple of months • The Town sent out consultation letters to several Tribal governments regarding the Cultural Resources Survey Report for the Project. No significant cultural resources were found, and no issues are expected. • Right of way acquisitions are currently on going and are expected to be complete by January 2009. • Project is anticipated to begin construction early next year which will last 12-14 months BARNETT LINEAR CHANNEL • The FEMA in-flow water has been received and is being analyzed by the CIP Engineering Division. The results may indicate that the channel can be reduced in size, thus allowing for the reduction or elimination of TEP line relocations. This analysis will be finalized by mid- September. • Existing underground utilities have been located for design of the utility relocations within the Rail-Road rights of way. The results will be submitted by the first week of September. • Environmental investigations for bridge foundation geotechnical investigation coring have been put on hold until the farm fields within the Town's Right-of-Way are harvested. The approximate date for harvest is December 2008. PAVEMENT REHABILITATION PROGRAM: • The 2007-2008 programs have been finalized and are complete. The 2008-2009 is underway and the remaining residential streets within the Sunflower neighborhood are being advertised for bid and work is expected to begin late September 2008. • If funding is available following the Sunflower pavement rehabilitation, staff will look into the costs of rehabilitating Twin Peaks Road between northern Silverbell Road to the Saguaro Springs development. • Engineering staff has met with pavement specialists to look into the possibility of using recycled materials for the Twin Peaks Road over the Rattlesnake Pass corridor. This potentially may reduce the costs of rehabilitation of that section of roadway. C. LEGAL DEPARTMENT UPDATE WASTEWATER LITIGATION • On August 29, Marana filed the last pleading concerning its request for final judgment on Judge Hoffinan's June 9 ruling. • On September 15, Pima County filed the last pleading concerning its motion for •reconsideration of Judge Hoffinan's June 9 ruling. �:� • Unless Judge Richard Mangum sets oral argument on one or more of the pending motions, a ruling could be issued any day now on Marana's request for final judgment and on Pima Count�s motion for reconsideration. WASTEWATER TRANSITION • On September 5, Marana sent documents to PAG explaining Marana's objections to Pima County's Regional Optimization Master Plan (ROMP) Section 208 Plan Amendment (the planning document required by the federal Clean Water Act to ensure appropriate planning and treatment of all regional wastewater). • On September 8, Marana staff presented to Pima County staff an overview of Marana's proposed Section 208 Plan Amendment, addressing Marana's treatment facilities planning alternatives. • A September 18 meeting is scheduled between PAG's attorney, Thomas Benavidez, and Frank Cassidy to discuss Marana's objections to the ROMP Section 208 Plan Amendment. Members of the Pima County Attorneys' office have been invited but have not yet responded. • A September 29 meeting is scheduled between Marana and Pima County staff to identify and describe the wastewater conveyance infrastructure located within the Town of Marana. CMID IGA NEGOTIATIONS � A draft IGA has been prepared to facilitate the use of hydro-power at three CMID wells used by Marana for potable water deliveries. � � On September 11, the fully executed Second Tolling Agreement (approved at the September 9 Council meeting) was hand delivered to CMID. • Meetings have been taking place between the Town and CMID on a proposed IGA to replace the 1997 IGA. Negotiations are currently anticipated to be completed in mid-November DEANZA REFERENDUM LITIGATION • We anticipate receiving a proposed draft stipulation of undisputed facts from Plaintif�s attorneys any day now. • Motions for judgment based on the undisputed facts will likely be filed within 30 days POLICE DEPARTMENT PERSONNEL MATTERS • Jane has been providing coordination and oversight with respect to the following: • Barbara Harris' PARB hearing • The internal investigation being conducted by Lia Keller regarding the hostile work environment complaints of Harris, Ochoa and Garbini • The internal investigation being conducted by Merle Turchik regarding the complaints received from Sgt. Ochoa's "subordinates." PUBLIC WORKS PROJECT PROPERTY ACQUISITIONS • All necessary Twin Peaks/Linda Vista interchange right-of-way should be obtained within 30 days either through completion of settlement negotiations or by obtaining immediate possession in condemnation • One or more settlement proposals on the remaining pending Thornydale Road/CDO-Orange Grove condemnation cases are expected to be presented to Council in the next 30 days -7- • Appraisals and property acquisition negotiations are in process to obtain right-of-way needed for the Camino de Manana project OTHER NOTABLE CNIL MATTERS • On September 5, legal staff participated in a meeting with Marana and Union Pacific representatives to discuss proposed deal points for an anticipated double-tracking agreement. • Saguaro Ranch historic aceess easements are the subject of litigation brought by Theresa (Tracy) Chamberlain and others against the developer ' • On September 2, Judge John Davis denied Chamberlain's request for reconsideration of the August 12 order denying injunctive relief regarding the public's rights to use historic easements through Saguaro Ranch. • On September 4, Chamberlain's attorneys requested the Town Attorney to sign an affidavit concerning whether Marana had "abandoned" the public easement (the affidavit is not yet signed) • Cedric Hay and Kevin Kish met with representatives from the Arizona Department of Water Resources and the Arizona Department of Real Estate regarding illegal subdivisions along the Dove Mountain extension. The Airport will help host an overnight event at the Pima Air Museum with the Tucson 99's (an all women's organization) E. OPERATIONS AND MAINTENANCE UPDATES KEY INVENTORY • Have received responses from all departments. • Will be going through all responses to check for appropriateness of keys, OK forms and forward to HR for personnel file. • Will complete Phase 1 of access/security issues and begin Phase 2 which deals with well sites and other security challenges F. PARKS AND RECREATION UPDATES MARANA CULTURAL AND HERITAGE PARK • Punch List Items are being addressed • Entry monument is in process • Marana Heritage Park Rail Road — test runs and final adjustments are being made. • Marana Fall Festival at the Heritage Park being planned €or October 25. SILVERBELL-CORTARO DISTRICT PARK • Installation of private sewer for park has begun. • Archaeology data recovery is being completed: • Boxing of 12 specimen Ironwood Trees on the site has begun. CONTINENTAL RESERVE BALL FIELD LIGHTING • Lighting design in underway. • TEP is coordinating power delivery with design engineers. TORTOLITA MOUNTAIN TRAILS WILD BURRO TRAILHEAD • Engineering plans have been approved. • Coordinating bid date with Ritz Carlton Construction. ORA MAE HARN PARK IMPROVEMENTS • New benches being installed. • Restroom plans are under review. PARKS AND RECREATION COMPREHENSIVE MASTER PLAN UPDATE • Focus groups with community leaders, service providers, and users were held September 15 and 16. Over 35 participants were interviewed by the consultants. • Phone survey of 400 Marana residents completed. -10- RE CREATION • Cardboard Boat Race, Breaker's Water Park was held September 6. Community interest and partners is growing and this event will become an annual effort between the Parks and Recreation Department and Breaker's Water Park. • Movie in the Park, Continental Reserve Park, September 13 had 200 attendees. • Itty-Bitty Open (toddler gol fl, The Practice Tee and Continental Ranch Community Park 9:00 a.m.- 12:00 noon, September 27. • Youth Programs — 4,516 • Teen Programs — 512 • Sports Programs — 45 • Seniors — 1,469 G. Deparhnent personnel will be working with Pima County personnel on transition planning in the coming weeks. CMID: • The Utilities Deparhnent and others are actively engaged in coming to a mutually beneficial resolution with members from CMID. DEVELOPMENT: • Several developers have met with the Utilities Department staff over the past week. • These developers may be seeking to take advantage of possible lower construction costs to get critical infrastructure identified and in place in the coming months.
