HomeMy WebLinkAboutResolution 2011-102 amendments to title 5 of the land development code relating to conditional and prohibited uses a public record MARANA RESOLUTION NO. 2011-102 RELATING TO DEVELOPMENT; DECLARING AS A PUBLIC RECORD FILED WITH THE TOWN CLERK THE AMENDMENT TO TITLE 5 (ZONING) OF THE MARANA LAND DEVELOPMENT CODE, MODIFYING SECTION 05.11.03 VC (VILLAGE COMMERCIAL) AS IT RELATES TO CONDITIONAL USES AND PROHIBITED USES BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that the amendment to Title 5 (Zoning) of the Marana Land Development Code, a copy of which is attached to and incorporated in this resolution as Exhibit A and three copies of which are on file in the office of the Town Clerk, is hereby declared to be a public record and ordered to remain on file with the Town Clerk. SECTION 1. Title 5 (Zoning) Section 05.11.03 VC (Village Commercial) of the Marana land Development Code is hereby revised as follows (with deletions shown with strikeouts and additions shown with double underlining): 05.11.03 VC Village Commercial [Sections A through E are unchanged.] E. Conditional Uses — (Reserved) The following may be permitted subject to the conditional use permit procedure set forth in Section 10 10 if the indicated criteria and limitations are satisfied: 1. Automobile paint, body and fender shops, subject to the following criteria: a. The parcel containing the use shall be located not closer than 250 feet from any residentially zoned lot line. b._ The development shall be subject to the commercial design standards (Section 08.07.03 of this codel C. Areas where vehicles are being stored or awaiting repair shall be screened on all sides by decorative block walls and solid gates. d. Outdoor storage is prohibited. e. Outdoor repairs are prohibited, except windshield replacement F. Temporary Uses -- (Reserved) G. Prohibited Uses. The following uses are prohibited in the VC zone: 1. . 2 . Contractor's yard. 2.3 Heavy equipment sales or leases. 3.4 Agricultural or industrial equipment sales. 4.-5-. Comparable uses as determined by the Planning Administrator.
