It will cover the accomplishments of the past year, a review of in- progress items, and staff - recommended modifications. The Council will have the opportunity to discuss and set priorities for FY '12, which will serve as a framework for the development of the FY '12 budget. The Marana economic recovery plan will be presented for review. This plan will help guide the Town as economic conditions improve over the next several years. The intent of the plan is to identify priority funding areas and guide decision making by appropriately allocating limited funds to the priority areas. The priority areas include existing employees, resources and equipment, and strategic positions. In addition, the Council will have the opportunity to discuss proposed organizational enhancements (changes to the organizational structure), citizen commissions, city versus town designation, creation of an interfaith council, and general Council operational issues. Attached is a Council Memorandum dated January 6, 2011, with information and background information from Town Attorney Frank Cassidy regarding the city versus town designation issue. Careful comparison of the Arizona statutes governing cities and towns reveals a few differences, as explained in Josh Wright's enclosed August 5 memorandum and in the enclosed February 9, 2004 memorandum from then - outside counsel Dan HochuL But even many of the differences are meaningless. For example, cities are required to have a longer list of municipal officers, but the Town of Marana already has all of the officers required of a city except for a city physician, and other cities don't have a city physician anyway—representatives of the Arizona League of Cities and Towns tell me that they've never heard of an Arizona city having one, notwithstanding the statutory requirement. League representatives believe the only substantive difference between a city and town is a city's ability (with voter approvaD to adopt a charter. A charter acts as the city s "constitution" and can give a city broader authority than state law on local matters, such as certain local voting practices and city property purchase and disposition requirements. For example, the City of Tucson is arguing that its charter's ward primary /citywide general election process is a matter of local concern that trumps a recentl)-adopted state law outlawing that process. The enclosed memos also note that a city may choose to hold district ('ward") elections, and that cities have broader authority to adopt regulations addressing public health issues. The Hochuh memo opines that cities are nqt6&to have a health department and to handle its own solid waste, but cites no legal support for these contentions, and I can find none. In follow-up communications with Dan Hochuli, who is now the Sahuarita Town Attorney, he cannot recall the basis for his conclusion and finds nothing to support it. K1s memo mentions a disagreement with Yavapai County when Cottonwood converted from a town to city form of government, so I've sent an email to Cottonwood's attorney to see if there's any further information. And for that matter, I have never heard any speck other advantages of a city over a town either. As far as requirements that are different for non- charter cities vs. towns, I have never seen or heard of those either. (Of course, I never heard of a city physician either!). I think any differences that you find are going to be obscure. I know that isn't much help but that is all I have. Itnmediatelyupon approval by the voters, the new City got notice from the County that the county would no longer provide these scrvices unless the City contracted for them. The end result was that Cottonwood had become aChN which gave them almost no advantage, but they now had to enter into an IGA with the county for the provision of health department and solid waste department. B. DIFFERENCES BETVVEEN CMES AND TOWNS There is only a marginal difference between being a city and a town. The only difference is that a city can have a charter, but a town cannot. A city charter is essentially the city's constitution. In the United States, every Person and state is subjectto the jurisdiction ofthe Federal Constitution. Each State has its own constitution as well. In Arizona, cities may have Charters that operate much the same as a constitution, 'establishing rules for operations and conduct, and legislating areas of local eonoern. C. CHARTER GOVERNANCE PROCEDURE 1. Basic requirements. The adoption of a charter government is governed by A.R.S. §§. 9281 to 9-285. first, .a city must have a population of mare than 3,500. inhabitants before it can frame a charter for its. awn government. Of course the charter must be consistent with the Arizona Constitution and Arizona state laws. 2. Election of a board of freeholders. The second step requires the: fibeg of a petition with the .chief executive officer of the city demanding an election ofthe board of fiieeholders. - The board will be composed fourteen. (14) qualified- electors of the city. D. THE PROS AND CONS 1. Advantages. Once approved, the charter becomes the organic law o €the city, and the provisions of the charter supersede all laws of the.s!ate relating to. pruely municipal affairs in conflict with the city's charter provisions. In that sense,. a city may have more control in. the area of its municipal laws: Essentially, deter governance allows cities to uflor iaws to their specifC community needs. IfMasana were to become a city it would 'have the:opportunity to create its own rubes, as long as those rules do not conflict with the Arizona Constitution or state .laws. 2. Disadvantages. Once the charter is set, hft ana will need the voters to make any changes to it. The process to amend a charter would require a majority vote of the citizens of- Marana. Any time a provision of the charter became unworkable or undesirable, the issue would have to be put before. the voters. This process will be very costly and time- consuming. If all goes well, today I will be recovering from right knee surgery at the VA hospital. To begin, the idea of the town becoming a city started when I was running for mayor four years ago. In a period of self - reflection I asked myself this question, "What does the town needs to do to be successful in the future in order to secure new businesses and high paying jobs ?" I could only think of three words, transparency, dynamic, and for it to become a city. Transparency no major corporation will come without transparency. Dynamic as the word states: characterized by continuous change, activity, or progress. If a town is not growing then it is dying like so many towns that have boarded up windows. Because of the word dynamic the town has to become a city. Because of its location it is a must. When a town is in the Sunbelt, on a major interstate going from coast to coast, and in between two major municipalities' it will grow with the right leadership in place. In addition, it has a railroad running parallel to the interstate. The council only job on this matter is to show leadership and forward this question to the voters of Marana. Three of you are asking the voters to return you back to the council. In two years four of you will do the same. The median income in the town is 65,000 so right there is your proof that most of the voters are college graduates and they will make the right decision. had a meeting with the mayor and the town manager a few months back and I was told that they did want to hold a special election well it is election season in Marana. The cost would be $300,000 dollars. It will be that if the town becomes a city over night. In 1979 1 open a saving and checking account at the Valley National Bank in Marana. The bank has moved and it went from Valley National to Bank one to Chase. To this day I still have my same account numbers and when the names changed I was told to use the same checks until they ran out and when I reorder the new name would appear on the new checks. In closing, I have nothing to gain or lose in the election however, a future council does, if the cost is $300,000 today, in the future it will be in the millions. If the voter of Marana votes for city nothing will happen except now a future council has the option to become a Charter City to become one you must first be a city. I believe in a government OF, BY AND FOR the people, because the people are always correct. So please do not usurp the will of the people; please let the people choose their future.
