Discussion: This presentation is intended to introduce to the Marana Town Council the Tangerine Corridor Conceptual Plan. Graduate students; Matthew Stuart, Hillary Turby, Aaron Liggett and Karilyn Roach from the School of Landscape Architecture and Planning will present the Tangerine Corridor Conceptual Plan Final Report, a vision for development along Tangerine Road Corridor that embodies Marana's economic and environmental goals while outlining innovative design concepts for a dynamic, livable, commercial /industrial district. The students work presented here was performed under the direction of Marana Planning staff, with Assistant Professor Elizabeth Scott acting as the faculty advisor. This project provided students with an opportunity to gain planning experience working to develop concepts for the Tangerine Road Special Planning Area, an area identified in the 2010 Marana General Plan as critical to the economic growth of the Town. The Tangerine Corridor Conceptual Final Report will provide guidance as we explore development opportunities along Tangerine Road. CIVIC CENTER DRIVE, MARANA, ARIZONA 85653 Council Chambers, March 27, 2012, 6:00 PM To: Mayor and Council Item D 2 From: Frank Cassidy, Town Attorney Strategic Plan Focus Area: Not Applicable Subject: Resolution No. 2012 -21: Relating to Intergovernmental Relations; endorsing the proposed amended Camino de Mariana Annexation to the Mountain Vista Fire District Discussion: On March 6, 2012, the Council adopted Resolution No. 2012 -14, endorsing Mountain Vista Fire District's annexation of a large area of land in the general vicinity of Camino de Mariana. As a result of intervening annexations by Northwest Fire District, Mountain Vista Fire District has revised its proposed annexation area and has requested the adoption of an amended resolution to address the revision. Mountain Vista Fire District's Board of Directors is scheduled to consider the annexation at its April 3 meeting, so the Council's March 27 study session is the only opportunity for the Council to consider the district's request. Attached as Exhibit A to the proposed resolution is the legal description and map of the proposed annexation area, which now covers an area generally bounded by Desert Falcon Lane on the north, Camino de Oeste on the east, Palo Fierro Boulevard on the south, and the eastern boundary of the Cascada development on the west. The same annexation map with the Marana town limits highlighted is provided as a separate backup material. This proposed Mountain Vista Fire District annexation area covers the remaining Camino de Mariana area that is not currently located within a fire district. Arizona law requires a fire district annexation of land within an incorporated city or town to be "endorsed" by the city or town with an ordinance or resolution. State law does not define the word "endorsed." Nevertheless, the Town has always supported having land located within the town limits in a fire district. Study Session - March 27, 2012 - Page 5 of 25 MARANA RESOLUTION NO. 2012-21 RELATING TO INTERGOVERNMENTAL RELATIONS; ENDORSING THE PROPOSED AMENDED CAMINO DE MANANA ANNEXATION TO THE MOUNTAIN VISTA FIRE DISTRICT WHEREAS the Town of Marana has received a boundary change impact statement for Mountain Vista Fire District's proposed Camino de Mariana Annexation; and WHEREAS a portion of the proposed annexation area as depicted in the boundary change impact statement is located within the town limits of the Town of Marana; and WHEREAS A.R.S. § 48 -262 (G) provides for approval of the boundary change impact statement by the Mountain Vista Fire District Board of Directors "only if [the Town of Marana] has by ordinance or resolution endorsed such annexation..."; and WHEREAS the Council adopted Marana Resolution No. 2012 -14 on March 6, 2012, endorsing the originally proposed Mountain Vista Fire District's proposed Camino de Mariana Annexation; and WHEREAS Mountain Vista Fire District has now submitted a revised Camino de Mariana Annexation area with a revised legal description and a revised map for reasons including the annexation of certain additional lands into the Northwest Fire District; and WHEREAS Mountain Vista Fire District has requested that the Town readopt its resolution to reflect the revised boundaries of the Camino de Mariana Annexation; and WHEREAS the Mayor and Council of the Town of Marana find that adoption of this resolution is in the best interests of the citizens of Marana. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, that the proposed Camino de Mariana Annexation to the Mountain Vista Fire District as depicted in the proposed annexation boundary legal description and map dated March 21, 2012, is hereby endorsed by the Town of Marana in accordance with A.R.S. § 48 -262 (G). CIVIC CENTER DRIVE, MARANA, ARIZONA 85653 Council Chambers, March 27, 2012, 6:00 PM To: Mayor and Council Item D 3 From: Frank Cassidy, Town Attorney Strategic Plan Focus Area: Not Applicable Subject: Relating to Land Development; Overview of proposed Marana Land Development Code comprehensive revision process Discussion: In 2006, the Town hired the private planning consulting firm Clarion Associates to assist in the creation of a comprehensive revision to the Marana Land Development Code. As part of its effort, Clarion representatives interviewed then- sitting members of the Town Council, staff, Planning Commission members, developers, consultants, and architects who work with the LDC to gain additional insight about its strengths and weaknesses. As a result of that effort, Clarion produced a preliminary diagnosis and outline of possible revisions and organizational changes to the LDC. As a result of staff changes, funding limitations, and the worsening economy, the LDC revision effort was put on hold. A Town staff team composed of Planning, Development Engineering, and Legal representatives is now undertaking an in -house effort to revive the LDC revision. This presentation is intended to provide an overview of the anticipated revision process and to show Council the work product to date. If approved by Council, Town staff intends to follow a two -step LDC revision process. The first step will codify the LDC as Title 17 of the Town Code. This step will reorganize and renumber the sections of the LDC, and will simplify some of its language and delete sections that are redundant to general Town Code provisions. The first step will also add a new chapter to the LDC containing the League of Arizona Cities and Towns model ordinance to implement the 2011 development impact fee legislation. Town staff anticipates that this first step will likely take about four months to complete, including a study session and a public hearing before the Planning Commission, meetings with SAHBA and various individual developers and stakeholders who commonly work with the LDC. The second step in the LDC revision process will involve chapter by chapter revision of the LDC. Most of the substantive revisions to the LDC are anticipated to occur during this second step, although some may be accomplished in the first step. Town staff anticipates that LDC chapters in most urgent need of revision will be brought forward for revision first. CIVIC CENTER DRIVE, MARANA, ARIZONA 85653 Council Chambers, March 27, 2012, 6:00 PM To: Mayor and Council Item D 5 From: Frank Cassidy, Town Attorney Strategic Plan Focus Area: Not Applicable Subject: Relating to Utilities; discussion and direction concerning the proposed transfer to Cortaro- Marana Irrigation District of the Town's non - potable water system located within the geographic boundaries of CMID, and concerning the draft agreement between and among the Town, CMID, and Cortaro Water Users' Association to accomplish the proposed transfer Discussion: The Cortaro- Marana Irrigation District (CMID) is an irrigation district and political subdivision of the state of Arizona, covering 19,827 acres of land in and around the Town of Marana (the "District Area "). Cortaro Water Users Association (CWUA) is the agent for CMID and for the owners of land located within the District Area. CWUA owns certain water rights associated with the District Area. The Town currently owns and operates a non - potable water system in north Marana, most of which (other than in the San Lucas area) is located within the District Area. At this time, groundwater is the Town's only readily available source of water to serve its non - potable system. The Town is obligated to replenish, through groundwater recharge, an amount of water equal to the groundwater the Town delivers through the non - potable system. This raises the Town's costs, which are passed along to homeowners' associations and other customers in the non - potable water rates. The Town's outside water counsel and CMID /CWUA's attorneys have conferred with staff of the Arizona Department of Water Resources and have concluded that CMID can serve non - potable water within the District Area without incurring a replenishment obligation under current Arizona law, as long as CMID owns and operates the non - potable system. CMID has expressed a willingness to take ownership and operation of the portion of the Town's non - potable system located in the District Area as long as the Town continues to require future development within the District Area to expand the non - potable system and dedicate ownership of the expansion to CMID, and continues to require all common areas, turf areas, right -of -way landscaping, and other large landscaped areas located within the District Area to be connected to the non - potable system. The Town does not anticipate requiring future development to provide non - potable connections to individual homes. Study Session - March 27, 2012 - Page 24 of 25 Property owners within the District Area pay a CMID property tax that entitles them to one and a half acre -feet of irrigation water per year. That fact and the absence of a replenishment obligation should enable CMID to deliver water to non - potable customers at a significantly lower rate. This study session is intended to give Town staff the opportunity to explain the benefits of the proposed transfer of the Town's non - potable system to CMID, and to give Council members the opportunity to provide feedback on the proposed transfer. If the Council agrees that the non - potable system transfer should be pursued, Town staff will negotiate the terms of an agreement with CMID and CWUA, and the agreement will be brought to Council for future consideration and possible action. Financial Impact: The Town Attorney will undertake the primary drafting of the agreement, to minimize transaction costs. The Town's outside water counsel will be consulted as needed to review the agreement and negotiate key terms. The Town does not anticipate that attorneys' fees to outside counsel will exceed $8,000 for this matter. If the agreement is successfully completed and approved, the Town will lose net revenues from water deliveries to non - potable connections within the District Area. Gross revenues are currently around $221,000 per year. The rate structure is intended to make this service cost - neutral. During the past year, the cost to deliver to the non - potable connections was approximately $224,000.
