AGENDA TITLE: Resolution No. 2006-137: Relating to Development; approving
and authorizing a release of assurances for Cortaro Ranch and
acceptance of public improvements for maintenance.
DISCUSSION
Approval of Resolution No. 2006-137 will release the assurance agreement between DR Horton
Homes Corporation, a Delaware corporation under Trust No. 7886- T and Lawyers Title of
Arizona, an Arizona Corporation and the Town of Marana, regarding Cortaro Ranch as depicted
on Exhibit A. Cortaro Ranch is comprised of lots 1, 2, 145-162, 181- 292, and common area
'A'. The subdivision is recorded in Book 51 of Maps and Plats, Page 6, Pima County Recorder's
Office, Arizona.
In releasing said Assurance Agreement, the Town of Marana will accept for maintenance,
including regulatory traffic control signs and street signs, approximately 1.01 miles of the
following paved streets:
· Cortaro Crossing Drive
· Cortaro Crossing Court
· Cactus Garden Drive
· Hayfield Street
· Wood A venue

RECOMMENDATION
Staff recommends Mayor and Council release the Assurances for Cortaro Ranch and accept the
public improvements for maintenance.

MARANA RESOLUTION NO. 2006-137
RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING A RELEASE OF
ASSURANCES FOR CORTARO RANCH AND ACCEPTANCE OF PUBLIC
IMPROVEMENTS FOR MAINTENANCE.
WHEREAS, Cortaro Ranch is a 32.75 acre subdivision located north of Cortaro Farms
Road at Cerius Stravenue, containing lots 1, 2, 145-162, 181- 292, and common area 'A' and is
recorded at the Pima County Recorder's Office in Book 51 of Maps and Plats, Page 6; and
WHEREAS, the Town has previously entered into an Assurance Agreement with DR
Horton Homes Inc., Corporation, a Delaware corporation (beneficiary) under Trust No. 7886- T
(subdivider) and Lawyers Title of Arizona Inc., an Arizona corporation, (trustee), recorded at the
Pima County Recorder's Office at Docket 11870, Page 3491, assuring the completion of public
improvements; and
WHEREAS, DR Horton Homes Inc, has completed the public improvements acceptable
to Town standards in accordance with the Assurance Agreement for Cortaro Ranch.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana as follows:
Section 1. Cortaro Ranch is hereby released from the Assurance Agreement with DR
Horton Homes Corporation under Trust No. 7886- T and Lawyers Title of Arizona.
Section 2. The Town accepts for maintenance, including maintenance of regulatory
traffic control and street signs, 1.01 miles of paved streets for the following appurtenances, as
depicted on Exhibit A:
A. Cortam Crossing Drive
B. Cortam Crossing Court
C. Cactus Garden Drive
D. Hayfield Street
E. Wood Avenue
Section 3. The Town accepts for maintenance, a potable water system including
appurtenances, valves, water meters and fire hydrants for the above referenced project.
