AGENDA TITLE: Resolution No. 2006-153: Relating to Subdivisions; approving a
release of assurances for Acacia Trails Continental Ranch Parcel
39 and acceptance of public improvements for maintenance.
DISCUSSION
Approval of Resolution No. 2006-153 will release the Assurance Agreement between Pulte
Homes Corporation, a Michigan corporation under Trust No. 7924-T and Lawyer's Title of
Arizona Inc., an Arizona Corporation, and the Town of Marana, regarding Acacia Trails,
Continental Ranch Parcel 39 as depicted on Exhibit A. Acacia Trails, Continental Ranch Parcel
39 is comprised of lots 1 through 51 and Common Area 'A'. The subdivision is recorded in
Book 59 of Maps and Plats, Page 58, Pima County Recorders Office, Arizona.
In releasing said Assurance Agreement, the Town of Marana will accept for maintenance,
including regulatory traffic control signs and street signs, approximately 0.30 miles of the
following paved streets:
. Deimos Drive
. Phobos Drive

RECOMMENDATION
Staff recommends that Mayor and Council release the Assurances for Acacia Trails, Continental
Ranch Parcel 39 and accept the public improvements for maintenance.

Acacia Trails Continental Ranch Parcel 39 Full Release
MARANA RESOLUTION NO. 2006-153
RELATING TO SUBDIVISIONS; APPROVING A RELEASE OF ASSURANCES FOR
ACACIA TRAILS CONTINENTAL RANCH PARCEL 39 AND ACCEPTANCE OF PUBLIC
IMPROVEMENTS FOR MAINTENANCE.
WHEREAS, Acacia Trails is a 10-acre subdivision located on Coachline Road, north of
Twin Peaks Road, containing lots 1-51, and common area 'A', and .is recorded at the Pima
County Recorder's Office in Book 59 of Maps and Plats, Page 58; and
WHEREAS, the Town has previously entered into an Assurance Agreement with Pulte
Home Corporation, a Michigan Corporation (beneficiary) and Lawyers Title of Arizona, an
Arizona corporation, (trustee), under Trust No. 7924-T recorded at the Pima County Recorder's
Office at Docket 12537, Page 3929, assuring the completion of public improvements; and
WHEREAS, Pulte Home Corporation has completed the public improvements acceptable
to Town standards in accordance with the Assurance Agreement for Acacia Trails Continental
Ranch Parcel 39; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana as follows:
Section 1. Acacia Trails Continental Ranch Parcel 39 is hereby released from the
Assurance Agreement with Pulte Home Construction, Inc. under Trust No. 7924-T and Lawyer's
Title of Arizona.

Section 2. The Town accepts for maintenance, including maintenance of regulatory
traffic control and street signs, 0.30 miles of paved streets for the following appurtenances, as
depicted on Exhibit A:
A. Deimos Drive
B. Phobos Drive
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
