DISCUSSION Approval of Resolution No. 2006-155 will release the Assurance Agreement between Meritage Homes Corporation, an Arizona corporation under Trust No. 4942 and First American Title Insurance Company, a California Corporation under Trust No. 9022 and the Town of Marana, regarding Continental Reserve Blocks 18, 19 and a Portion of Block 17 as depicted on Exhibit A. Continental Reserve Blocks 18, 19 and a Portion of Block 17 is comprised of lots 1 through 102 and Common Area 'A'. In releasing said Assurance Agreement, the Town of Marana will accept for maintenance, including regulatory traffic control signs and street signs, approximately 0.76 miles of the following paved streets: . Amber Burst Drive . Amber Burst Court . Glowing Star Drive . Wayward Star Drive . Brilliant Star Drive . Dimming Star Drive ATTACHMENTS Exhibit A - Map of streets to be accepted. RECOMMENDATION Staff recommends that Mayor and Council release the Assurances for Continental Reserve Blocks 18, 19 and a Portion of Block 17and accept the public improvements for maintenance. SUGGESTED MOTION I move to approve Resolution No. 2006-155. Continental Reserve Blocks 18, 19, & Portion of 17 Full Release MARAN A RESOLUTION NO. 2006-155 RELATING TO SUBDIVISIONS; APPROVING A RELEASE OF ASSURANCES FOR CONTINENTAL RESERVE BLOCKS 18, 19, AND A PORTION OF 17 AND ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR MAINTENANCE. WHEREAS, Continental Reserve Blocks 18, 19 and a portion of 17 is a 25.51 acre subdivision located on Continental Reserve Loop, west of Silverbell Road, containing lots 1-102, and common area 'A', and is recorded at the Pima County Recorder's Office in Book 58 of Maps and Plats, Page 36; and WHEREAS, the Town has previously entered into an Assurance Agreement with Taro Properties Arizona I, LLC Corporation, an Arizona Limited Liability corporation (beneficiary) and Meritage Homes Corporation an Arizona Corporation (subdivider) under Trust No. 4942 and First American Title Insurance, a California corporation, (trustee), under Trust No. 9022 recorded at the Pima County Recorder's Office at Docket 12297, Page 3817, assuring the completion of public improvements; and WHEREAS, Meritage Homes Corporation has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Continental Reserve Blocks 18, 19 and a Portion of 17. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Continental Reserve Blocks 18, 19 and a Portion of 17 is hereby released from the Assurance Agreement with Meritage Homes Corporation under Trust No. 9022 and First American Title Insurance. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 0.76 miles of paved streets for the following appurtenances, as depicted on Exhibit A: A. Amber Burst Drive B. Amber Burst Court C. Glowing Star Drive D. Wayward Star Drive E. Brilliant Star Drive F. Dimming Star Drive Marana Resolution No. 2006-155 Page lof2 Section 3. The Town accepts for maintenance, a potable water system including appurtenances, valves, water meters and fire hydrants for the above referenced project.
