AGENDA TITLE: Resolution No. 2006-163: Relating to Subdivisions; approving a
release of assurances for Continental Reserve Block 10 and
acceptance of public improvements for maintenance.
DISCUSSION
Approval of Resolution No. 2006-163 will release the Assurance Agreement between Canoa
Homes Corporation, an Arizona corporation under Trust No. 60,005 and Fidelity National Title
Company, Inc., an Arizona Corporation and the Town of Marana, regarding Continental Reserve
Block 10 as depicted on Exhibit A. Continental Reserve Block 10 is comprised of lots 1-69 and
common areas 'A' through 'H'.
In releasing said Assurance Agreement, the Town of Marana will accept for maintenance,
including regulatory traffic control signs and street signs, approximately 0.58 miles of the
following paved streets:
Sombrero Point Drive
Lazy K Place
Taltson Drive
Lucky Star Place
Vista Point Court
White Stallion Place
The Town will accept for maintenance, a potable water system including appurtenances, valves,
water meters and fire hydrants for the above referenced project.

RECOMMENDATION
Staff recommends Mayor and Council release the Assurances for Continental Reserve Block 10
and accept the public improvements for maintenance.

Continental Reserve-Block 10 Full Release
MARAN A RESOLUTION NO. 2006-163
RELATING TO SUBDIVISIONS; APPROVING A RELEASE OF ASSURANCES FOR
CONTINENTAL RESERVE BLOCK 10 AND ACCEPTANCE OF PUBLIC
IMPROVEMENTS FOR MAINTENANCE.
WHEREAS, Continental Reserve Block 10 is a 24.88 acre subdivision located on
Continental Reserve Loop, west of Silver bell Road, containing lots 1-69, and common areas "A"
through "H" and is recorded at the Pima County Recorder's Office in Book 56 of Maps and Plats,
Page 9; and
WHEREAS, the Town has previously entered into an Assurance Agreement with Canoa
Homes Corporation, an Arizona Corporation under Trust No. 60,005 and Fidelity National Title
Company, Inc. an Arizona corporation recorded at the Pima County Recorder's Office at Docket
12455 and Page 1488 assuring the completion of public improvements; and
WHEREAS, Canoa Homes has completed the public improvements acceptable to Town
standards in accordance with the Assurance Agreement for Continental Reserve Block 10.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana as follows:
Section 1. Continental Reserve Block 10 is hereby released from the Assurance
Agreement under Trust No. 60,005 and Fidelity National Title Company.
Section 2. The Town accepts for maintenance, including maintenance of regulatory
traffic control and street signs, 0.58 miles of paved streets for the following appurtenances, as
depicted on Exhibit A:
Sombrero Point Drive
Lazy K Place
Taltson Drive
Lucky Star Place
Vista Point Court
White Stallion Place
Section 3. The Town accepts for maintenance, a potable water system including
