WHEREAS, Acacia Trails is a 10-acre subdivision located on Coachline Road, north of Twin Peaks Road, containing lots 1-51, and common area 'A', and is recorded at the Pima County Recorder's Office in Book 59 of Maps and Plats, Page 58; and WHEREAS, the Town has previously entered into an Assurance Agreement with Pulte Home Corporation, a Michigan Corporation (beneficiary) and Lawyers Title of Arizona, an Arizona corporation, (trustee), under Trust No. 7924-T recorded at the Pima County Recorder's Office at Docket 12537, Page 3929, assuring the completion of public improvements; and WHEREAS, Pulte Home Corporation has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Acacia Trails Continental Ranch Parcel 39; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Acacia Trails Continental Ranch Parcel 39 is hereby released from the Assurance Agreement with Pulte Home Construction, Inc. under Trust No. 7924-T and Lawyer's Title of Arizona. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 0.30 miles of paved streets for the following appurtenances, as depicted on Exhibit A: A.
