Civic Center Drive, Marana, Arizona 85653 Cauncil Chambers, June 26, 2012, at or after 6:00 PM Ed Honea, Mayor Patti Comerford, Vice Mayor David Bowen, Council Member Herb Kai, Council Member Carol McGorray, Council Member 7on Post, Council Member Roxanne Ziegler, Council Member SPECIAL COUNCIL MEETING CALL TO ORDER AND ROLL CALL. The meeting was called to arder at 6:59 p.m. by Mayor Honea. Town Clerk Bronson called roll. All Council Members were present, except Council Member Kai, who was excused. There was a quarum present. PLEDGE OF ALLEGIANCElINVOCATIONIMOMENT OF SILENCE. Led by Mayor Honea. APPROVAL OF AGENDA. Motion to approve the agenda as presented by Council Member Mc�orray, second by Council �lember Bowen. Passed unanamously 6-0. CALL TO THE PUBLIC. Vice Mayor Comerford commented on the several ribbon cuttings she attended over the past week, and noted that these are good signs that the economy is improving and that businesses want to be in Marana. PROCLAMATIONS PRESENTATIONS CONSENT AGENDA LIQUOR LICENSES BOARDS, COMMISSIONS AND COMMITTEES COUNCIL ACTION June 26, 2012 Spacial Council Meeting Mayor Honea asked for an executive session on Items A1 and A2. Motion to go into �ecutive session by Council Member MeGorrtty, second by �ee Mayor Comerford. Passed urzanimously 6-0. Council reconvened in special session at 720 p.m. A 1: Ordinance No. 2012.04: Relating to Electians; authorizing a special Town of Marana election an November 6, 2012 for the purpose of voting upon whether the Town of Marana shall be authorized to acquire the Marana Wastewater Reclamation Facility and the wastewater facilities, setback areas, access rights, and current and future service area connected to or associated with it; and declaring an emergency. Mayor �Ionea moved Ordinance No. 2012.04 without the emergency claus� Second by Vice �layor Comerforc� Town Clerk Bronson called the vote. Council Member Bowen — aye; Council Member McGorray — aye; Council Member Post — nay; Coureeil Member Ziegler — nay; Vice �tlayor Comerford — aye; Mayor Honea — ay� ltfation passed 4-2. A 2: Resolution No. 2012-54: Relating to Elections; authorizing the special Town of Marana election on November 6, 2012 to be conducted not as a mail ballot election; and declaring an emergency Mayor Honea moved Resolution 1Vo. 2012-54 without the emergency claus� Second by Vice Mayor Comerford Mayor Honea responded to questions from Council Member Bowen regartling what it means to remove an emergency clause and the reason for nat having a mail in ballot in the November election. ITEMS FOR DISCUSSION/POSSIBLE ACTION E�ECUTIVE SESSIONS E l: Executive Session pursuant to A.R.S. §38-431.03 (A)(3), Council may ask for discussion or consultation for legal advice with the Town Attorney concerning any matter listed on this agenda. E 2: Executive session pursuant to A.R.S. § 38-431.03{A)(3},(4) and (7}, for discussion or consultation with the Town's attorneys and to instruct the Town's representatives cancerning (1} the lawsuit entitled Town of Marana v. Pima Caunty/Pima County v. Marana (eonsolidated), Maricapa County Superior Court No. CV2008-OQ 113 l, Arizona Court af Appeals No. 1 CA CV 11 0381; (2) the lawsuit entitled Pima County v. Town of Marana, Pima, County Superior Court No. C20116094; and (3) pending legal issues, settlement discussions and contract negotiations relating to the transition of Marana wastewater collection and treatment to the Town of Marana FUTURE AGENDA ITEMS. Natwithstanding the mayar's discretion af what items to place on the agenda, if three or more council members request an item to be placed an the agenda, it must be placed upan the agenda for the second regular town council meeting after the da.te of the request {Marana Town Cade, Title 2, Chapter 2-4, Section 2-4-2 B) June 26, 2012 Special Council Meeting 2 Cauncil Member Post asked for a future item to discuss the possibility in an executive session of nominating a council member or a number of cauncil members to negatiate on the Town of Marana's behalf in the wastewater litigation. Council Member Bowen seconded. Mayor Honea stated that he has the authority to put the item on the agenda and he will do so. ADJOURNMENT. Motion by Council Member McGorray, second by CQUncil Memher Ziegler to adjourn.
