RELATING TO MUNICIl'AL COURT; APPROVING THE REAPPOINTMENT OF
MAGISTRATES PRO TEMPORE AND CIVIL TRAFFIC VIOLATION HEARING OFFICERS
FOR THE MARANA MUNICIPAL COURT.
WHEREAS Section 5-2-1 of the Marana Town Code provides that the Town Council may
appoint special magistrates or acting magistrates, also known as magistrates pro tempare, for the
purposes of hearing a particular case or acting as the Town Magistrate in the Town Magistrate's ab-
sence; and
WHEREAS the Town Council, upon recommendation of the Town Magistrate, the Honora-
ble Charles Davies, has determined that it is necessary to appoint qualified individuals to serve as
magistrates pro tempore on an as-needed basis in the Marana Municipal Court; and
WHEREAS on November 16, 2010, via Resolution No. 2010-108, the Town Council ap-
pointed Kenneth Bowman, David Dingledine, Eugene Hays and Keith Singer as magistrates pro
tempore; and
WHEREAS the Town Magistrate recommends that the Town Council reappoint Kenneth
Bowrnan, David D!ingledine and Eugene Hays to continue their service as magistrates pro tempore on
an as-needed basis; and
WHEREAS the Town Council finds that these individuals meet the qualifications imposed by
Arizona law and possess the requisite skill and character to perform as magistrates pro tempore; and
WHEREAS Section 5-2-3 of the Town Code provides that the Town Magistrate, with the ap-
proval of the Town Council, may appoint one or more hearing officers to preside over civil traffic
violation cases; and
WHEREAS on November 16, 2010, via Resolution No. 2010-108, the Town Council ap-
pointed George Anderson and Sandra Celaya as �ivil traffic violation hearing officers; and
WHEREAS the Town Magistrate wishes to reappoint Gec>rge Anderson and Sandra Celaya to
continue their service as civil traffic violation hearing officers on as-needed basis; and
WHEREAS the Town Council finds that these individuals meet the qualifications imposed by
Arizona law and possess the requisite skill and character to perform as civil traffic violation hearing
officers.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF I�ti�KANA, ARIZONA, AS FOLLOWS:
SECTION 1. The Town Council hereby reappoints the following individuals to continue
their service as magistrates pro tempore on an as-needed basis: Kenneth Bowrnan, David Dingledine
and Eugene Hays.
SECTION 2. The Town Council hereby reappoints George Anderson and Sandra Celaya to
continue their service as civil traffic violation hearing officers on an as-needed basis.
SECTION 3. The Town Council hereby directs that the reappointment of these magistrates
pro tempore and hearing officers is effective September l, 2012, and that their terms shall expire on
August 31, 2014.
SECTION 4. The Town Council further directs that the magistrates pro tempore shall be
paid at the rate of $125.00 per half-day and $250.00 per full-day of service and that the hearing of-
ficer, George Anderson, sha11 be paid $'75.00 per half-day and $150.00 per full-day of service, as in-
dependent contractors to the Town.
SECTION 5. The Town Council further directs that the hearing officer, Sandra Celaya, who
is a regular employee of the Town, shall receive no additional compensation as hearing officer other
than her regular pay and benefits as an employee of the Town.
PASSED AND ADOPTED BY THE MAYOR AND COUNCIL OF THE TOWN OF MA-
RANA, ARIZONA, this 21 St day of August 2012.
