SPECIAL COUNCIL MEETING
CALL TO ORDER AND ROLL CALL. The meeting was called to order at 6:59 p.m. by Mayor
Honea. Town Clerk Bronson called roll. All Council Members were present, except Council
Member Kai, who was excused. T'here was a quorum present.
PLEDGE OF ALLEGIANCEIINVOCATIONlMOMENT OF SILENCE. Led by Mayor
Honea,
AP'PROVAL OF AGENDA. Motion to approve the agenda as presented by Council Member
McGorray, second by Council Member Bowen. Passed unanimously 6-Q.
CALL TO THE PUBLIC. Vice Mayor Comerford commented on the several ribbon cuttings
she attended over the past week, and noted that these are good signs that the economy is
improving and that businesses want to be in Marana.

Council reconvened in special session at 7:20 p.m.
A 1: Ordinance No. 2012.04: Relating to Elections; authorizing a special Town of Marana
election on November 6, 2012 for the purpose of voting upon whether the Town of Mazana shall
be authorized to acquire the Marana Wastewater Reclamation Facility and the wastewater
facilities, setback areas, access rights, and current and future service area connected to or
associated with it; and declaring an emergency.
Mayor Honea moved Ordinance No. 2412.04 without the emergency clause. Second by Vice
Mayor Comerfora� Town Clerk Bronson called the vote. eouncil Member �owen — aye;
Council Member McGorray — aye; Council Member Post — nay; Council Member Ziegler —
nay; Vice Mayor Comerford — aye;ll�ayor Honea — aye. Motivn passed 4-2.
A 2: Resolution No. 2012-54: Relating to Elections; authorizing the special Town of Marana
election on November b, 2012 to be conducted not as a mail ballot election; and declaring an
emergency
Mayor Honea moved Resolution No. 2412-54 without the emergency clause. Second by �ce
Mayor Comerfora� Mayor Honea responded to questions frorn Council Member Bowen
regarding what it means to remove an emergency clause and the reason for not having a mail in
ballot in the November election. Town Clerk Bronson ealled the vote. Council Member Bowen
— aye; Council Member McGorray — aye; Council Member Post — aye; Council Memher
Ziegler — aye; V'ue Muyor Comerfard — aye; Mayor Honea — aye. Motion prassed 6-0.

or consultaxion for legal advice with the Town Attomey concerning any matter listed on this
agenda.
E 2: Executive session pursuant to A.R.S. § 38-431.03(A)(3),(4) and (7), for discussion or
consultation with the Town's attorneys and to instruct the Town's representatives concerning (1)

the lawsuit entitled Town of Marana v. Pima County/Pima County v. Marana (consolidated),
Maricopa County Superior Court No. CV2048-001131, Arizona Court of Appeals No. 1 CA CV
11 0381; (2) the lawsuit entitled Pima County v. Town of Marana, Pima County Superior Court
No. C20116094; and (3) pending legal issues, settlement discussions and contract negotiations
relating to the transition of Marana wastewater collection and treatment to the Town of Marana
FUTURE AGENDA ITEMS.
Notwithstanding the mayor's discretion of what items to place on the agenda, if three or more
council members request an item to be placed on the agenda, it must be placed upon the agenda
for the second regular town council meeting after the date of the request (Marana Town Code,
Title 2, Chapter 2-4, Section 2-4-2 B)
Council Member Post asked for a future item to discuss the possibility in an executive session
of nominating a council member or a number of council members to negotiate on the Town of
Marana's behalf in the wastewater litigation. Council Member Bowen seconded. Mayor
Honea stated that he has the authority to put the item on the agenda and he will do so.
ADJOURNMENT. Motian by Council Member McGorray, seeond by Council Member
2iegler ta adjourn. Fassed unanimously 6r-0 at 7:25 p.m.
