DISCUSSION/DIRECTION/POSSIBLE ACTION 1. Presentation: Relating to Building; presentation on the possible adoption of the 2012 Benny Sanchez International Building Code. Presented by , Building Official. Mr. Sanchez discussed the community benefits of adopting the 2012 building codes. Among the benefits mentioned were life and health safety issues, elimination of regionalization, and current construction practices. He discussed the benefit to the organization, focusing on Commerce, Community, and Progress & Innovation focus areas. Adopting these regulations will make Marana more regionally competitive and give the Town the ability to participate in future revisions. Codes proposed for adoption are the 2012 International Codes, the 2011 National Electrical Code and the 2009 ICC ANSI A 117.1 ADA Code. Mr. Sanchez noted every three years the codes are revised; however, the state moratorium on building during the recession prevented adoption of the 2009 codes. He then went on to list some of the more significant changes to the new codes such as hazardous materials, reports, live/work units, carbon monoxide detectors, wireless technology for smoke alarms, tamper-resistant receptacles, and plumbing November 13, 2012 Study Session Minutes 1 Regular Council Meeting - December 4, 2012 - Page 7 of 57 Mr. Sanchez requirements for small tenant improvement spaces. indicated the adoption of the building code will be an up- reflecting the most current industry standards. Mayor Honea requested clarification regarding the necessary distant between Council Member Kai homes for fire safety. asked Mr. Sanchez if the current code related to fire safety has flexibility for business owners in special circumstances. Mr. Sanchez explained the Town defers fire safety related issues to Northwest Fire to ensure and maintain public safety. He indicated the Town has played a more active role in the interpretation of the Fire Code revisions while also ensuring the revisions do not lessen the minimum of code requirements. Vice Mayor Comerford expressed concern related to the manner in which Northwest Fire District revises fire codes, indicating the need to develop a balanced solution that meets the needs of citizens while also protecting public safety. Mr. Sanchez ackn fire district and other community stakeholders to address issues related to code compliance and possible revisions. Council Member McGorray motioned to direct staff to continue to review the 2012 Building Code amendments and revisions for council consideration in 2013. Second by Council Member Bowen. Presentation: Relating to Community Facilities Districts; discussion and direction regarding the Saguaro Springs Community Facilities District (Saguaro Bloom project), financing alternatives and elements of the adopted Community Facilities Frank Cassidy District policy. Presented by , Town Attorney, with assistance from Erik MontagueBrian Baehr , Finance Director, and , Vice President of Land Mr. Cassidy Development for Grayhawk Development. summarized the evolution of the Saguaro Springs Community Faculties District from the original developer to Mr. Cassidy purchase by Grayhawk Development. informed Council that Grayhawk Development is ready to begin property development; but requires a Community Facilities District (CFD) development agreement in place to address the costs incurred for the remediation of current prebuilt infrastructure and other as needed property improvements. Mayor Honea asked Mr. Cassidy Mr. Cassidy related to property improvements. stated the property had $30M worth of public infrastructure development and the previous property owners had the expectation of reimbursement by the Town from the CFD once the development . Mayor Honea project was completed followed up with an inquiry if the current Mr. owner will seek repayment from the CFD on any infrastructure improvements. Cassidy affirmed the -payment for such improvements dependent upon the determination of a basis for such reimbursements. Also, he indicated a need for education regarding the CFD so homeowners understand how the CFD interacts with the assessed property value of their property. Council Member Comerford emphasized her concerns that the current pre-built infrastructure may not be adequate and would cost homeowners more in taxes with Vice Mayor Comerford the required remediation. also voiced concern that adoption of a CFD without certain protections and or disclosures may be financially Mr. Cassidy harmful to homeowners. responded that the developer has invested and will continue to invest large amounts of money in infrastructure remedial improvements thus justifying the CFD reimbursement at a $2.50 of $100 assessed valuation. Mr. Montague clarified and defined the type of financial security protocols designed to protect the property owner from potential shocks based on the assessments to the overall tax levy. He explained that the current CFD is general obligation debt and has a two-layer agreement structure. The standby contribution agreement is a set aside of certain funds to meet debt requirements. If in any given year the taxes obtained from the district do not meet the debt requirement, the developer would be required to pay the shortfall. The second layer of security is the depository agreement. The Town will continue to pay particular attention to the entity that holds the overall responsibility for the agreement. Council Member In response to inquiry of where Grayhawk Development Mr. Baehr is at in the development process, stated they have identified a legitimate builder for parcel one and hope to see construction begin by the end of the year. However, he indicated Grayhawk intends to spend $12M to $15M to remediate the existing infrastructure on the property and may spend an additional $15M to $20M . Mr. Baehr in public and lot property improvements expectation that homeowners receive education regarding the CFD at time of purchase and explained that his company does practice such disclosure and education with its customers. Additionally, he noted that before development can begin, the buyer needs the CFD development agreement articulating financial obligations. 3. The study will include a half-day review session with Town management staff explaining how and why culture affects behavior. At the conclusion of the review session, management will collect stories that define organizational excellence from employees to assist in the development of leadership core values. The second half- day session will include sharing the stories and highlighting behaviors that define excellence including employee outreach to refine the core value statements that will guide the development of leadership within the Town. Mr. Montague stressed that the Town implementation of priority-driven budgeting is to extend and support public transparency. Priority-based budgeting defines the value to the community while also continuing to achieve service goals. This method of budgeting clearly explains the reasons for available resource allocation and reflects Using the past three budgetary cycles as foundational analysis, the priority basis budgeting method helps determine if a department or program organization is achieving its stated goals within the Strategic Plan. The final analysis will ensure the most appropriate allocation of funds based on service priority and creating accountably for results. This method offers an improvement in organizational decision making related to fund allocation. Mr. Montague indicated the Town is currently seeking feedback from other municipalities utilizing priory based budgeting techniques. This information will assist in the implementation of the priority based budgeting initiative. Mayor Honea Mr. Davidson currently employs an outcome based budgeting process. expanded on the priority based budgeting process articulating this method helps to define the review that best achieves the goals of the Strategic Plan. Honea reported he attended the Marana Regional Airport Cook-Out during the week of November 12. He also met with the American Cancer Society which plans to host a fundraising walk event in early May at the Crossroads Park. He attended his first League of Cities and Towns Board meeting. Also, he participated in a ribbon cutting ceremony on November 17 at the new VFW post located at El Tiro Road and Trico Road. The Arizona Youth Partnership currently uses the old Health Center Building for its before and after school programs and starting in August 2013 will open its kindergarten to fourth grade school at the facility. He and other council members attended the mobile Town Hall last week and met with citizens. Del Post, Deputy Town Manager, and Laine Sklar, Assistant Town Attorney. The th event will be held on December 13 at the Doubletree Hotel. He recognized Tom Ellis and his staff who put together the holiday decorations and preparations for the December 1 tree lighting . PRESENTATIONS P 1: Presentation: Relating to Strategic Planning; update on the status of Strategic Plan Gilbert Davidson II after the first quarter of Fiscal year 2013. Presented by . He recognized a group of staff members who worked hard to gather the information: Amanda Jones, Breanne Lorefice, Kelsie Wiebe and various department heads. He highlighted the quarterly success indicators and then some of the completed items. Commerce is the foundation of the community. Without business generating profits and bringing money into the town, there would be no amenities. We are trending in a positive direction with retail sales tax. There have been over 89 new business licenses issued within this time frame. Staff is working on an enhanced permitting process, and that data is still being prepared. There is a slight increase in jet fuel sales at the airport and a general increase in aircraft. Staff has been able to complete the allocation of funds to help us be more involved in economic development throughout the state. A database of properties will be demonstrated on a new web page for commercial and industrial uses. Under Community, this is where we see how to strengthen the communication with citizens. One of the key elements is a public safety piece, and we are trending in the right way to be responsive. One of the broad goals is to be one of the best police departments in the state through improved response times. There has been a tremendous effort to be prepared for emergencies. There was a team put into place from throughout the organization who have been meeting throughout the year. The next phase is practice and with our efforts. He then introduced Keith Brann who showed a plaque showing that the town was 26 November 20, 2012 Regular Meeting Minutes Page of Regular Council Meeting - December 4, 2012 - Page 13 of 57 recently accepted into the FEMA CRS program - recognizing Every community that joins the national flood insurance program has the ability to provide flood insurance, emergency response, etc. You can go above and beyond the minimum requirements of FEMA, and the town has done that. The town has a floodplain code In addition we also track our floodplains well and provide exceptional community outreach. Doing those things puts you on a point system with FEMA. The Town entered at a Level 8 which entitles everyone in a floodplain to a 10% discount. Going down each level, we get another 5% off. Gilbert acknowledged the great efforts of Keith Brann in this regard, who is being asked to outline his plan to other organizations. Gilbert then talked about the Crystal Legacy and Branding Iron awards which were given at the State of the Town dinner. Staff has been working on a community calendar and update system to reach out to citizens and community groups. We are always looking for ways to keep citizens informated. For relationship opportunities, there are programs such as Out & About in Marana Community Connections. In conjunction with the Connections program, an employee component was added. This helps new employees get fully immersed in the history of the town and the culture of the organization. We are always looking for ways to use less paper going to iPads for Council. Through Novus, we have gone to a paperless agenda. We have also done that with Munis with our financial data system. We will be adding components to streamline that process even further. We launched a My Marana app and have gotten phenomenal usage results each month. This has helped community as well. We continue to work on a technology master plan. The town acquired some additional property for the Heritage Park and staff has been putting tremendous effort in cleaning it up and has launched a long-term plan to be added to the park. That includes a partnership with the UA Drachman Institute. We continue to educate and have information available through the website for our citizens. The capstone is to attract more families and businesses. We are working with Oro Valley on marketing the area. We are a finalist for the Arizona State Trail Status for the Santa Cruz Shared Use Path. The Silverbell Park was awarded best park facility 2012 by the Arizona Parks and Recreation Association. Council Member Ziegler remarked on the quick response times of the Marana Police Department, and the use of the My Marana app. 36 November 20, 2012 Regular Meeting Minutes Page of Regular Council Meeting - December 4, 2012 - Page 14 of 57 P 2: Presentation: Relating to Alternative Expenditure Limitation (Home Rule) . Erik Montague introduced why this is important to the community. Every four years the voters must consider the home rule option. In 1979-1980, the town had fewer population we get a new number each year as to what our spending limit should be. There is currently a gap of about $16M from what the town has in the general fund budget and what the state cap would be. There is an option, - the Home Rule Option allows the Town to create a local spending limit and present it to the voters for approval. This allows Council to set a spending limit based on local priorities. The annual adopted budget which is based on available revenues, sets the annual limit. Once approved, the option is effective for four years. This was first approved by town residents in 1985. The current option was approved at the general election in May, 2009. That will be in effect until May, 2013. He then discussed the timeline, and noted there will be in. There will be two public hearings, one on December 18 and one on January 15, 2013. CONSENT AGENDA. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, as follows: SECTION 1. The amendments to the Marana Town Code Chapter 9-4 Massage Establishmentsthree copies of which are on file in the office of the Town Clerk of the Town of Marana, Arizona, which were made a public record by and attached as Exhibit A to Resolution No. 2012-098 of the Town of Marana, Arizona, are hereby referred to, adopted and made a part of this ordinance as if fully set out here. SECTION 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. SECTION 3. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. SECTION 4.
