RELATING TO MARANA REGIONAL AIRPORT; APPROVING AND AUTHORIZING THE
AIRPORT l��ANAGER TO EXECUTE APRON USE PERMIT AGREEMENT AIVIENDMENT
NO. 1 BETWEEN THE TOWN OF �ZAR.ANA AND SOUTHERN ARIZONA SPORTS CAR
CLUB, INC.
WHEREAS on March l, 2011, the Town Council adopted Resolution No. 2011-33 approving
and authorizing the Public Works Director to execute an Apron Use Fermit Agreement with the
Southern Arizona Sports Car Club, Inc. for the purpose of allowing the Car Club to hold a series of
non-aeronautical special events at the Marana Regional Airport; and
WHEREAS special events conducted within the Town can enrich the quality of life within
the cornmunity and add to the Towr�'s economic prosperity; and
WHEREAS the Town Council fmds that approving an amendment to the Apron Use Permit
Agreement is in the best interests of the Town and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, as follows:
SECTION 1. The Apron Use Permit Agreement Amendment No.1 between the Town of Ma-
rana and the Southern Arizona Sports Car Club, Inc. attached to and incorporated by this reference in
this resolution as Exhibit A is hereby approved, and the Airport Manager is hereby authorized to ex-
ecute it for and on behalf of the Town of Marana.
SECTION 2. The Town's Manager and staff are hereby directed and authorized to undertake
a11 other and fiirther tasks required or beneficial to carry out the terms, obligations, and obj ectives of
this resolution.
PASSED AND ADOPTED by the Mayor and Council of To Mara.na, Arizona,

Recitals
A. Effective March 2, 2011, Owner and I'ermittee executed an l-lpron Use Permit
A�reement (the "Original �lgreeme�lt") governing Permittee's use of t11e I'ermitted
Area from the effective date of the Origii�al Agreement tl�rough Decemb�r 31, 2011.
I3. I'ursuant to paragraph 3 of the Ori�inal Agreement, Owner, at its sole discretion,
may renew the Original Agreem�nt for up to five consecutive one-year periods (a
"renewal period") on the same terms as set forth in the C�riginal Agreernent, by
executing a wri#ten renewal signed by C�zvner and`Permittee.

U. Effective January 1, 2013, Owner and I'�rmittee executed Apron Use I'ermit
Agreement Renewal No. 2, renewing t11e Original �lgreement for the second of five
one-year renewal periods, through December 31, 2013.
L. Owner and Permittee now desire to amend the Original Agreement to revise the
insurance requirements set forth in the Original Agreement.
A�reement
Now, THEt��FOrtE, in consideration of Permittee's representations and promises in th�
Original �greerrient, in Apron Use Permit Agreement IZenewal No. 1 and No, 2 and iri
this Apron Use Permit Agreement Amendment No. 1(this "Amendment No: 1"),
Owner and Permittee hereby agree as follows:
1. Paragraph 14 of the Original Agreement relating to insurance requirements is
1lereby stricken and replaced with t11e following;
Permittee shall obtain commercial general liability insurance for the term of this
Agreeme�lt in minimum amounts of $1,000,0OO.OQ �enerai liability per occurrence
with a minimum $5,OQO,OOQ.00 general aggregate limit per occurrence and
exc�ss/ umbrella liability illsurance coverage of $9,000,000.00 eacli
occurrence/ aggregate from carriers acceptable to Owner. This i�lsurance shall
remain in force throughout the life of this Agreement. Owner shall be named as an
"aaditional insured" under the commercial general liability and excess/umbrella
insurance policy and shall be given at least 30 calendar days' written notice prior to
cancellation or reduction in coverage. Permittee shall deliver one or more certificates
of insurance evidencing coverage as descriUed in t11is paragraph to Owner within 15
calendar days of the execution of this Agreement and any renewal of this
Agreement. If Permittee chooses to provide a separate certificate of insurance for
each event 11e1d on the Permitted l�r�a, Permittee shall deliver one ar mor�
certificates of insurance evidencing coverage as describ�d in this paragraph to
Owiler at least 7 calendar days prior to each e`�ent. Permittee shall also deliver new
certificates of ii�surance eacll time the p�licy(s) is updated. All required certificates

2. A11 other terms and provisions of the Original Agreernent and its exllibits not
specifically c1lan�ed by IZenewal No. 1 or No. 2 or this �mendin�nt No. 1, shall
remain in effect and be binding upoil the I'arties as provided for i�1 t11e C�ri�inal
Agreement.
