March 19, 2013 - Page 5 of 131 MARANA RESOLUTION NO. 2013-022 RELATING TO THE POLICE DEPARTMENT;APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE SECOND AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE TOWN OF MARANA, PIMA COUNTY AND OTHER PARTICIPATING JURISDICTIONS REGARDING THE PIMA REGIONAL SPECIAL WEAPONS AND TACTICS (S.W.A.T.) TEAM WHEREASon December 18, 2007, the Town Council adopted Resolution No. 2007-225, approving and authorizing execution of an intergovernmental agreement (IGA) between the Town of Marana, Pima County and other participating jurisdictions regarding the formation, operation and maintenance of the Pima Regional S.W.A.T. Team; and WHEREAS the Pima Regional S.W.A.T. Team IGA had an initial term of five years from the date of recordation at the Pima Coun had the option to extend the IGA for two additional five-year periods; and WHEREAS the Town Council finds that extension of the Pima Regional S.W.A.T. Team IGA for a five-year period as set forth in this resolution is in the best interests of the Town of Marana and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, as follows: SECTION 1. The second amendment to the IGA between the Town of Marana, Pima County and other Participating Jurisdictions regarding the Pima Regional Special Weapons and Tactics (S.W.A.T.) POLLARD AS MAGISTRATE PRO TEMPORE FOR THE MARANA MUNICIPAL COURT WHEREAS Section 5-2-1 of the Marana Town Code provides that the Town Council may appoint special magistrates or acting magistrates, also known as magistrates pro tempore, for the purposes of hearb- sence; and WHEREAS the Town Council, upon recommendation of the Town Magistrate, the Honora- ble Charles Davies, has determined that it is necessary to appoint qualified individuals to serve as magistrates pro tempore on an as-needed basis in the Marana Municipal Court; and WHEREAS Tucson City Court, in collaboration with participating jurisdictions, has estab- lished a Regional Municipalities Veterans Treatment Court (RMVTC) for the purpose of serving veterans living in the municipalities of Pima County who have been charged with an offense within the jurisdiction of the variour- ans Administration; and WHEREAS the Town Magistrate has agreed to refer appropriate Marana Municipal Court cases to the RMVTC at Tucson City Court; and WHEREAS the Town Magistrate recommends that the Town Council appoint the Honorable Michael P. Pollard, Tucson City Court magistrate, as amagistrate pro tempore for the Town of Ma- rana for the purpose of allowing Judge Pollard to preside over Marana Municipal Court cases re- ferred to the RMVTC; and WHEREAS the Town Council finds that Judge Pollard meets the qualifications imposed by Arizona law and possesses the requisite skill and character to perform as amagistrate pro tempore. 12 Page of Marana Resolution No. 2013-023 Regular Council Meeting - March 19, 2013 - Page 11 of 131 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that the Town Council hereby appoints the Honorable Michael P. Pollard as magistrate pro tempore for the Town of Marana for the purpose of authorizing Judge Pollard to preside over those Marana Municipal Court cases referred to the Regional Municipalities Veterans Treatment Court at Tucson City Court. and WHEREAS Pima County has been awarded funding from the U.S. Department for Housing and Urban Development under the CDBG program; and WHEREAS the Town of Marana has been selected as a sub-grantee through Pima WHEREAS the parties may contract for services and enter into agreements with one another for joint or cooperative action pursuant to A.R.S. § 11-952, et seq.; and WHEREAS the Mayor and Council of the Town of Marana find it is in the best interests of its citizens to enter into this intergovernmental agreement. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, as follows: SECTION 1. The intergovernmental agreement between the Town of Marana and Pima County attached to and incorporated by this reference in this resolution as Exhibit A is hereby approved, and the Mayor is hereby authorized and directed to execute it for and on behalf of the Town of Marana. Presented by explained the contract before the Council divides the assumed value of the park dedication into the first three subdivisions roughly 600 lots. The contract states the developer must build improvements on the park and when completed the Town will apply a credit to the remaining phases of the development. The agreement gives roughly $1,290 credit for each of the lots listed in the agreement against the park impact fee which is currently $3,294 per lot. Mr. Post explained the Town is closely monitoring the progression of House Bill 2657 relating to the transaction privilege tax modifications. He informed the Council that the bill passed out of the House Ways and Means Committee with an 8-0 vote on February 18, 2013. Mr. Post indicated staff will continue to meet to the Council in March for the Town. Also, Mr. Post provided follow-up information regarding the status of House Bill 2527 relating to the consolidated election intent is to allow cities and towns to lengthen or shorten the terms of elected officials to meet the new legal requirements for the even year fall election cycle. Mr. Post stated the bill has board support and looks favorable for passage. Mayor Honea commented on House Bill 2657 stating he had received a call from Representative Ethan Orr and Representative Adam Kwasman indicating the bill has bi-partisan support in both houses and will likely pass into law. They faxed Mayor Honea a document outlining some protections for small jurisdictions and also requested input regarding the proposed protections. Mr. Cassidy further noted that there was some ambiguity in the document. He asked to read into the record the way the water condition probably ought to read. This is something of great concern by the property owner. They want to be able to farm until the last possible moment. The water lawyers, Steve Weatherspoon for the property owner, and Rita McGuire got together and any portion of the rezoned land shall commence and proceed with the administrative process of the Arizona Department of Water Resources, in accordance with Arizona Administrative Code, sections R12-15-723 and R12-15-727, to extinguish the irrigation grandfathered rights appurtenant to the land upon which irrigation has ceased. In no event shall the process to extinguish the irrigation grandfathered right be initiated more than 60 days after approval of any final plat on any of the rezoned land. No later than 60 days following the issuance of any extinguishment credit to the Developer by the Arizona Department of Water Resources, the Developer shall transfer all such issued extinguishment credits to the Town. The main part of the plan is Heritage. The goal of the focus area is to link the past, present and future and create a more thriving, dynamic community. Research from around the country showed us that Marana has a tremendous opportunity with this park. Although we may not be able to create a park with as much impact as some of those parks illustrated, we will be able to market it as well as others have done in their communities. The park will not be a passive way to display it will be interactive. He highlighted a couple of things about the master and the community engagement that went on, identifies partners and activity centers. Tom Ellis then talked about the different activity centers in the park. He noted that he has been Plan as well as the Parks & Recreation Master Plan. It shows that that putting a site plan together like this takes the effort of many groups. The concept takes into account all the past planning efforts of resident and business surveys, staff task forces, utility available and many exhibits. It was intended to be a construction document, but now gives project planners something to work from. The site plan allows for a robust collaboration of partnerships. It contains 124 acres and 1 ½ miles along the Santa Cruz River. The distinct cultural activity centers work together and acres of state land the town purchased recently. There will be opportunities for retail and farming. The Heritage Plaza activity center is 20 acres and builds on the agricultural story of the farms that made Marana a strong and diverse community. There will be building spaces, interpretive displays and retail shops. The Heritage Park activity center is anchored by the existing community park and focuses o connection to the shared use path system. The Heritage Ranch activity center celebrates experience Marana. This is a huge project. The capital investment will come from park impact fees, public and private partnerships, grants, donations and legacy endowments. Operational sustainability comes from user fees, leasing proceeds, sales tax and other funding opportunities. Amanda Jones strategy is focused on generating activity and foot traffic to ensure future success. The phasing will be a display garden, then a community garden, then a space. Partners will be the Heritage Conservancy, the Community Food Bank UA, commercial developers and longtime residents. Phasing of the ranch will begin with the equestrian trailhead, covered arenas and corrals, grandstands/concessions and a steakhouse and tack room. The plaza phase will start with trails/exhibits, an event center and commercial space. Partners will be the heritage conservancy, longtime community members, etc. Neighborhood Park Expansion phasing will begin with gathering spaces, a splash park and then an amphitheater. Start small get people to the park, and expand. Del Post then discussed next steps. Approval of the concept, marketing the concept and then identifying funding and partnerships hopefully to begin in the next fiscal year. and WHEREAS the Council Committee for Planning Commission and Board of Adjustment Appointments has reviewed applications for the vacancies on the Planning Commission and has made its recommendations to the full Council; and WHEREAS the Mayor and Council desire to fill existing vacancies and find that the appointments addressed by this resolution are in the best interest of the town and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, as follows: SECTION 1. Don Duncan is appointed to the Marana Planning Commission with a term expiring June 30, 2013. SECTION 2. Thomas Schnee is appointed to the Marana Planning Commission with a term expiring June 30, 2015. March 19, 2013 - Page 74 of 131 MARANA ORDINANCE NO. 2013.004 RELATING TO DEVELOPMENT; APPROVING AMENDMENTS TO THE MARANA MAIN STREET SPECIFIC PLAN WHEREAS, the Town of Marana is representing the property owners of approximately 28 acres of land located within the southwest quarter of Section 22, Township 11 South, Range 11 East, as described on Exhibit "A", attached hereto and incorporated herein by this reference; and, WHEREAS, The Marana Main Street Specific Plan was adopted by the Marana Town Council November 18, 2008, by Ordinance 2008.24; and, WHEREAS, the Marana Planning Commission held a public hearing on February 27, 2013, and at said meeting voted unanimously to recommend that the Town Council approve said amendment, adopting with the recommended conditions; and, WHEREAS, the Marana Town Council heard from staff and members of the publicat the regular Town Council meeting held March 19, 2013, and has determined that the amendment to the Marana Main Street Specific Plan should be approved. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1. The Marana Main Street Specific Plan is hereby amended by updating the Introduction, Development Plan and the Development Regulations of the current plan. Amendments include creating additional land use designations, addressing freeway signage, amend the criteria for drive-through facilities and modify the street section for Marana Main Street. Section 2. The purpose of this amendment is to modify the specific plan to clarify, and provide opportunities similar to other developments, in developing the commercial project design, subject to the following conditions, the violation of which shall be treated in the same manner as a violation of the Town of Marana Land Development Code (but which shall not cause a reversion of this rezoning ordinance): 1. the time of any subsequent development including, but not limited to, requirements for public improvements. 2.Any preliminary plat or development plan shall be in general conformance with the Land Use Concept of the Marana Main Street Specific Plan. 3.This project is located within the Northwest Marana Transportation, Lower Santa Cruz River Levee, and Marana Park Benefit Areas, and will be subject to those fees at time of permitting. Marana Ordinance No. 2013.004 Page 1 of 3 Regular Council Meeting - March 19, 2013 - Page 75 of 131 4.The property owner shall not cause any lot split of any kind without the written consent of the Town of Marana. 5.No approval, permit or authorization by the Town of Marana authorizes violation of any federal or state law or regulation or relieves the applicant or the land owner from responsibility to ensure compliance with all applicable federal and state laws and regulations, including the Endangered Species Act and the Clean Water Act. Appropriate experts should be retained and appropriate federal and state agencies should be consulted to determine any action necessary to assure compliance with applicable laws and regulations. 6.The Developer shall dedicate, or cause to have dedicated, the necessary rights-of-way for Marana Main Street and Sandario Road. 7.A drainage study must be submitted by the Developer and accepted by the Town prior to approval of any preliminary plat or development plan. 8.Potential buyers shall be notified that some or all of the property in this rezoning may be subject to an annual tax and assessment by Cortaro Marana Irrigation District and Cortaro Water Users' Association 9.A detailed traffic analysis shall be submitted and accepted by staff prior to approval of any preliminary plat or development plan. 10.The developer will be responsible for the design and construction of any roadway improvements that the Town requires based on the data and findings of the accepted traffic impact analysis and other traffic studies that will be required at the platting or development plan stages of this project. 11.A Sewer Service Agreement and Sewer Plan shall be submitted by the Developer and accepted by the wastewater provider and the Town Engineer prior to the approval of any preliminary plat or development plan. 12.The property owner shall transfer, by the appropriate Arizona Department of Water Resources form, those water rights being IGR, Type I or Type II to the Town of Marana for the Town providing designation of assured water supply and water service to said property. If Type I or Type II are needed on said property, the Town and developer/landowner shall arrive at an agreeable solution to the use of those water rights appurtenant to said land. 13.To ensure that the historical heritage of the site is remembered, in the first phase of this development the developer will build and install to Town specifications a marker commemorating the cotton production and processing that occurred on this site. Maintenance of the heritage marker will be the responsibility of the Town of Marana. 14.The Specific Plan document may be subject to minor grammatical and illustrative changes prior to Town Council consideration. 15.An annual report shall be submitted within 30 days of the anniversary of the Town C approval of the Specific Plan in addition to those requirements listed in the Land Development Code and Specific Plan. 16.Upon adoption of the ordinance by the Mayor and Council approving the Marana Main Street Specific Plan, the applicant shall provide the Planning Department with the following final edition of the Marana Main Street Specific Plan: one non-bound original; five bound copies; Marana Ordinance No. 2013.004 Page 2 of 3 Regular Council Meeting - March 19, 2013 - Page 76 of 131 and three digital copies in Microsoft Word or other acceptable format within sixty days of the adoption. 17.The developer of each lot in this project will be responsible for the design and construction project property. Section 3. This Ordinance shall not be effective until the Town files with the county recorder an instrument (in a form acceptable to the Town Attorney), executed by the Property Owners and any other party having any title interest in the Rezoning Area, that waives any potential claims against the Town under the Arizona Property Rights Protection Act (A.R.S. § 12-1131 et seq., and specifically A.R.S. § 12-1134) resulting from changes in the land use laws that apply to the Rezoning is not recorded within 90 calendar days after the motion approving this Ordinance, this Ordinance shall be void and of no force and effect. Section 4. All ordinances, resolutions and motions and parts of ordinances, resolutions, and motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of this Ordinance. Section 5. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, as follows: SECTION 1. That the total number of ballots cast at said primary election, as confirmed by the Pima County Elections Department, was _______. SECTION 2.
