REGULAR COUNCIL MEETING
CALL TO ORDER AND ROLL CALL. Mayor Honea called the meeting to order at 7:02
p.m. Records Administrator Hiser called roll. All Council Members were present.
PLEDGE OF ALLEGIANCE/INVOCATION/MOMENT OF SILENCE. Led by Mayor
Honea.
APPROVAL OF AGENDA. Motion to approve by Council Member McGorray, second by
Council Member Post. Passed unanimously.

PROCLAMATIONS
MAYOR AND COUNCIL REPORTS: SUMMARY OF CURRENT EVENTS
Vice Mayor Comerford extended her thoughts and condolences to Mayor Honea on the
anniversary of his wife's passing. Council Member Bowen attended The State of the City for
Tucson on February 19, 2013 and indicated he was impressed with Mayor Rothschild's energetic
direction for the City of Tucson and his initiatives to improve the City's business climate.
Mayor Honea reported he and Deputy Town Manager Del Post attended the Arizona League
of Cities Executive Board Meeting the past week. Mayor Honea stated 30 mayors were present
from a range of jurisdictions and all voiced their opposition to the proposed state legislation
modifying the transaction privilege tax and will try to mitigations the bill by proposing
protections for the local interests.
Mayor Honea also voiced his support of Tucson City Mayor Rothschild's sentiments
encouraging the incorporation of Vail. He agrees with Mayor Rothschild's plan to increase
annexations as a method to increase revenue in Pima County.

MANAGER'S REPORT: SUMMARY OF CURRENT EVENTS
PRESENTATIONS
CONSENT AGENDA. Motion to approve by Council Member Ziegler, second by Council
Member Bowen. Passed unanimously 7-0.
C 1: Resolution No. 2013-012: Relating to Community Development; authorizing the Town
Manager to apply for grant funding from the Governor's Office of Highway Safety under the
Highway Safety Act for the purchase of equipment and the funding of overtime for the Marana
Police Department for fiscal year 2013-2014
C 2: Resolution No. 2013-013: Relating to Marana Regional Airport; approving and
authorizing the Airport Manager to execute Apron Use Permit Agreement Amendment No. 1
between the Town of Marana and Southern Arizona Sports Car Club, Inc.
C 3: Resolution No. 2013-014: Relating to Community Development; formally recognizing
and providing support and assistance to the Community Food Bank, Inc. in its efforts to
anticipate and meet the food needs of the hungry in the community
C 4: Resolution No. 2013-015: Relating to Utilities; approving and authorizing the Mayor to
execute Amendment No. 1 to the Sludge Disposal Services Agreement with Pima County

COUNCIL ACTION
A 1: Resolution No. 2013-016: Relating to Development; approving and authorizing the Mayor
to execute the Development Agreement Regarding Park Development Impact Fee Credits for the
Saguaro Bloom Development Project. Presented by Frank Cassidy. Mr. Cassidy explained the
contract before the Council divides the assumed value of the park dedication into the first three
subdivisions roughly 600 lots. The contract states the developer must build improvements on the
park and when completed the Town will apply a credit to the remaining phases of the
development. The agreement gives roughly $1,290 credit for each of the lots listed in the
agreement against the park impact fee which is currently $3,294 per lot. Mr. Cassidy
emphasized the agreement format is the same as in previous development agreements. Motion
to approve by Vice Mayor Comerford, second by Council Member McGorray. Passed
unanimously 7-0.

D 1: Relating to Legislation and Government Actions; Discussion and possible action regarding
all pending state, federal, and local legislation/government actions and on recent and upcoming
meetings of other governmental bodies. Presented by Del Post. Mr. Post stated the legislature
has introduced almost 1,200 bills this session and all bills must be heard by Friday February 22,
2013 to continue on in the legislative process. Mr. Post explained the Town is closely
monitoring the progression of House Bi112657 relating to the transaction privilege tax
modifications. He informed the Council that the bill passed out of the House Ways and Means
Committee with an 8-0 vote on February 18, 2013. Mr. Post indicated staff will continue to meet
with state representatives advocating for the Town's interests and will present to the Council in
March an extensive overview of the bill's financial impacts for the Town.
Also, Mr. Post provided follow-up information regarding the status of House Bi112527 relating
to the consolidated election cycle. Mr. Post indicated the bill's intent is to allow cities and towns
to lengthen or shorten the terms of elected officials to meet the new legal requirements for the
even year fall election cycle. Mr. Post stated the bill has board support and looks favorable for
passage.
Mayor Honea commented on House Bi112657 stating he had received a call from
Representative Ethan Orr and Representative Adam Kwasman indicating the bill has bi-partisan
support in both houses and will likely pass into law. They faxed Mayor Honea a document
outlining some protections for small jurisdictions and also requested input regarding the
proposed protections.
EXECUTIVE SESSIONS
E 1: Executive Session pursuant to A.R.S. §38-431.03 (A)(3), Council may ask for discussion
or consultation for legal advice with the Town Attorney concerning any matter listed on this
agenda.
E 2: Executive session pursuant to A.R.S. § 38-431.03(A)(3),(4) and (7), for discussion or
consultation with the Town's attorneys and to instruct the Town's representatives concerning (1)
the lawsuit entitled Pima County v. Town of Marana, Maricopa County Superior Court No.
CV2011-099966 and (2) pending legal issues, settlement discussions and contract negotiations
relating to the transition of Marana wastewater collection and treatment from Pima County to the
Town of Marana.
FUTURE AGENDA ITEMS
Notwithstanding the mayor's discretion regarding the items to be placed on the agenda, if three
or more Council members request that an item be placed on the agenda, it must be placed on the
agenda for the second regular Town Council meeting after the date of the request, pursuant to
Marana Town Code Section 2-4-2(B).
ADJOURNMENT. The meeting was adjourned at 7:16 p.m. by Council Member McGorray,
second by Vice Mayor Comerford. Passed unanimously.
