RELATING TO COMMUNITY DEVELOPMENT; APPROVING AND AUTHORIZING THE
MAYOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE
TOWN OF MARANA, THE DESERT BLUEGRASS ASSOCIATION AND THE ARIZONA
BLUEGRASS ASSOCIATIONREGARDING THE PLANNING, DEVELOPMENT AND
PRESENTATION OF THE MARANA BLUEGRASS FESTIVAL IN APRIL 2013
WHEREASin March 2012, the Town Council of the Town of Marana adopted the Town
, and under the Community focus area of the Plan,
Initiative 8 is
with a strategy of recruiting community partners to plan and staff signature events; and
WHEREAS the Desert Bluegrass Association is a non-profit organization dedicated to
developing and promoting bluegrass music for the diverse audience in the Greater Tucson Area;
and
WHEREAS the Arizona Bluegrass Association is a non-profit organization with the
mission of promoting and encouraging the uniquely American musical forms of bluegrass, old
time, gospel, and traditional instrumental and vocal music of the United States throughout
Arizona and the Desert Southwest; and
WHEREAS the Town and the Associations desire for the Associations to plan, develop
and present the Marana Bluegrass Festival at Ora Mae Harn Park on April 13 and 14, 2013 with
in-kind support and assistance from the Town; and
WHEREAS the Town Council finds that approval of a Memorandum of Understanding
related to the planning, development and presentation of the Marana Bluegrass Festival as set
forth in this resolution is in the best interests of the Town of Marana and its citizens.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, ARIZONA, as follows:
SECTION 1. The Memorandum of Understanding between the Town of Marana, the
Desert Bluegrass Association and the Arizona Bluegrass Association regarding the planning,
development and presentation of the Marana Bluegrass Festival, attached to and incorporated by
this reference in this resolution as Exhibit A, is hereby approved and the Mayor is hereby

RELATING TO PERSONNEL; REPEALING MARANA RESOLUTION NO. 2008-31
WHICH REQUESTED APPROVAL OF A RECOMMENDED LABOR MARKET OF
COMPARABLE ORGANIZATIONS FOR PURPOSES OF A SALARY AND BENEFITS
SURVEY
WHEREAS on February 19, 2008, the Town Council adopted Resolution No. 2008-31
approving a list of governmental entities as the labor market for classification and compensation
comparisons for a salary and benefits survey to be completed for the Town at that time; and
WHEREAS in December 2012, the Town issued a Request for Proposals to procure a
consultant to complete a new classification and compensation study for the Town; and
WHEREAS as a part of the new classification and compensation study, the consultant is
to recommend benchmark classifications to be used for market survey and analysis and
recommend appropriate market comparisons to be used for the survey to include, if applicable to
a pay structure or employee group, public and private sector data developed on a local, statewide,
regional, or national level; and
WHEREAS the Town Council finds that repealing Resolution No. 2008-31 and allowing
recommend the appropriate labor market at this time for the new
classification and compensation study is in the best interests of the Town of Marana and its
citizens.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, ARIZONA, as follows:
SECTION 1. Resolution No. 2008-31, adopted on February 19, 2008, is hereby repealed.
SECTION 2. The Town Manager and staff are hereby directed and authorized to
undertake all other and further tasks required or beneficial to carry out the terms and objectives
of this resolution.

WHEREAS the Town Attorney is authorized by law and court rules to prosecute
violations of the Marana Town Code and statutes of the State of Arizona which are
within the original or concurrent jurisdiction of the Marana Municipal Court; and
WHEREAS limitations of time and expertise sometimes require the powers and
duties of the Town Attorney to be undertaken and carried out by deputy and assistant
town attorneys; and
WHEREAS the Town Council finds that codification in the Town Code of the
authority of the Town Attorney as prosecutor and the authority of deputy and assistant
town attorneys is in the best interests of the Town and its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL
OF THE TOWN OF MARANA, as follows:
SECTION 1. Marana Town Code Section 3-2-7 (Town Attorney) is hereby
as follows:
7.The town attorney shall prosecute in the name of the town or the state of
Arizona all violations of the town code and statutes of the state of Arizona
within the original or concurrent jurisdiction of the Marana municipal
court or lawfully referred to the town attorney, and any associated or
related appeals.
SECTION 2. Marana Town Code Section 3-2-7 (Town Attorney) is hereby amended by
adding a new paragraph D as follows:
D.Deputies and assistants. At the discretion of the town attorney, the powers
and duties of the town attorney may be undertaken and carried out by deputy
and assistant town attorneys (by whatever rank or title they may be called)
licensed to practice law in the state of Arizona, who shall have the same
authority as the town attorney, under the general supervision of the town
attorney.

RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING THE REVERSION
OF ACREAGE OF THE ARCOBALENO FINAL PLAT
WHEREAS, Johnny Miller, the property owner of Arcobaleno Final Plat property, has
applied for approval of the reversion of acreage of the final plat creating asingle 7.5 acre lot, and
generally located on the northwest corner of N. Coyote Lane and W. Turkey Lane, within
Section 11, Township 12 South and Range 12 East; and
WHEREAS, the Arcobaleno Final Plat was approved by the Town Council on May 6,
2008, as Resolution 2008-059 and
WHEREAS, the Town Council, at their regular meeting on April 2, 2013 has determined
that the reversion of acreage of the Arcobaleno final plat should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, that the reversion to acreage of the Arcobaleno Final Plat and generally

DISCUSSION/DIRECTION/POSSIBLE ACTION
1: Presentation: Relating to Budget; an update of the Town's financial status of the
Erik
General Fund for the seven months of the 2012-2013 fiscal year. Presented by
Montague.
He noted that this update is through January which includes the holiday shopping season.
An item that is included is the general fund Budget in Brief, a high level overview of the
sales taxes,
state shared revenue and licenses, permits and fee - which comprises about 90 percent of
revenue. Sales tax revenues through January is about 59 percent,
which is normal. There are some areas that area lagging contracting sales tax, which is
challenging to predict. A lot of volatility in that area has to do with one capital project
near the Ina/I-10 location. There is some positive traction in new home construction but no
other major construction activity. There is good news in year over year results with bars
^ƚƵĚLJ^ĞƐƐŝŽŶDŝŶƵƚĞƐDĂƌĐŚϭϯ͕ϮϬϭϯWĂŐĞϭŽĨϱ

and restaurants almost 7 percent higher. The largest individual category is retail. For this
in most major categories; that is a positive leading indicator. Manufacturing is lightly
lagging. Overall, collections for this period at $11.8M are 59.3 percent of budget, which is
within expectations. He then referred to a comparison chart of year over year changes for
construction, retail, and restaurants. The overall average through October was about 9
percent less than the previous year. Contracting sales tax was primarily responsible for that
get perspective.
State shared revenues are within budget category. These numbers come to us from the
League and the department of Revenue. State shared sales tax is lagging a bit, but urban
revenue is the same each month and auto lieu tax is lagging slightly. Another key revenue
to the community is from the highway user revenue fund, to be used for major program
maintenance. Those numbers are pretty much on the mark.
About 7 percent of the budget comes from licenses, permits and fees. The largest portion
comes from single family residential permits. We budgeted for 330 and actuals through
January are 344. We issued 52 for February (not included in this report). We have
many
smaller categories that are significantly over due to a variety of reasons. But there is some
96 percent, which is largely a good thing.
Expenditures are trending pretty much as expected. We are running a bit behind on
operating supplies and equipment and capital outlay, sometimes it takes a while to get
going, but most of those will be expended by the end of the year. Cash was transferred out
of the general fund for debt service, to pay for this building
$800K.

self-audit. Last, the elimination of construction sales tax from the job site. The
transactions would instead be taxed at the point of sale for retail transactions.
The challenges for cities and towns is that the Arizona Department of Revenue (ADOR) is
unable to provide accurate and timely return data and delays in the receipt of funds from
ADOR and reliability of the ADOR website. The current option is that a web portal was
created last year to simplify administration and remittance.

different auditors. The current option for single point of audit is that a multi-jurisdictional
audit coordinator already exists. The challenge is that the crime rate for those is pretty high.
ADOR lacks the resources to conduct all audits due to a downsizing of the department
which is just now beginning to turn around. And ADOR already has millions of dollars in
unpaid audit receivables sitting on the books.
The elimination of the construction sales tax means taxable transactions move from the job
constructions sales tax represents 12% of tax revenues budgeted ($2.4M/$19.8M). For the
Transportation fund, that represents 100% of revenues for budgeted year. As part of the
transportation fund. Those dollars are key to provide for our current and future obligations.
With the change, we would move from a four percent to a two percent sales tax. Some of
the dollars have been allocated to pay the annual debt service allocated to the
Transportation Fund. The current option or idea that the League of Cities and Towns is
trying to float is to keep contracting largely as it is with respect to contracting and make
changes to trades (plumbers, HVAC, etc.).
He then reviewed what the town uses TPT revenues for. We are averaging about a quarter
significant to our community. We
work hard to establish and maintain a balanced budget. These dollars are one-time dollars.
They do not support ongoing obligations. The positive to that if there is a new business,
there is a one-time element and also a

transportation projects. One thing we did do was to identify significant projects such as the
Twin Peaks Interchange and Crossroads District Park, and we advanced funded those
projects by issuing bonds in the amount of $39.8M in 2008 in anticipation of the collection
of future construction sales tax dollars. We de-leveraged ourselves on a portion of them as
additional dollars came through on Series A and Series B bonds, so that from time to time
thos
to fund that $2.4M delta.
So with audit revenue loss, those one-time revenues provide key projects and vital program
such as a classification and compensation study. There are other projects and programs
those dollars, because some of those dollars will come back to our community through
retail and some through additional shared sales tax. We will not be made whole and will be
debt. Should this measure continue to move forward, we need to identify current resources
and strategize allocating them toward future debt service.
The bill is currently being held in committee. The bill has been held for a number of days
with the intent or expectation that the two sides which are significantly apart at this point,
will come together with meaningful and agreeable solutions for both. A number of
proposals have been submitted by the League and cities and towns as well as the other side.
One amendment (Mesnard) has been adopted that has been identified as a workable
Council Member Bowen regarding the circumstances under which the town would want to
collect its own sales tax. First, is the availability of the information from ADOR. Second,

verify the accuracy of the data. The flip side of self-auditing is the cost of hiring additional
staff to run the data, but he believes that the savings that could be obtained by getting
accurate data would make this cost-

on Sandario Road. Staff is looking at updating the introduction, the development plans and some
of the regulations to the specific plan as new policies which have come into play since the
original specific plan was brought forward. One of the key amendments is the creation of an
additional land use designation to include a highway opportunities area for travelers. Hospitality
acreage is still there as is an enlarged area for drive-through (a conditional use process required)
to avoid clogging up the Main Street area with in and out traffic. The other significant item is a
gateway sign, up to an 85-foot tall sign with an electronic message board. This will also require
a conditional use permit. This would not be a power center type of signs such as Pavilions.
So the highway portion and along Sandario is the only significant change to require some

setbacks for a nice corridor to maintain the character of Marana Main Street.

asked how Sandario will be affected. responded that the improvements along
Sandario are meant to spur some reinvestment activity for the town. This will start the upgrade
with individual parcels. If we can create the reinvestment fund, we can help existing businesses

A 2: Resolution No. 2013-027: Relating to Elections; declaring and adopting the results of the
primary election held on March 12, 2013. Ms. Bronson noted that the Official Canvass was
placed on the dais as well as a copy of the resolution, now completed as of March 15. There
were approximately 205 ballots not counted on election night. There were 6,169 ballots case; 16
were rejected. This is about a seven percent increase over the 2011 election. Each incumbent
received over half of the ballots cast and are therefore deemed elected at the primary. Both
ballot questions passed by about a three to one margin. Council Member Bowen asked about the
increase in votes over 2011 and whether we have ever had that many votes cast in prior elections.
Ms. Bronson
responded that the highest number of votes cast was about 23 percent in the 2011
primary. Voter turnout for this election was about 31 percent. Motion to approve by Council
Member Bowen, second by Council Member Ziegler. Passed unanimously.

has gained the most notoriety among cities and towns is the tax simplification bill, HB 2657.
There has been some movement. It was held up in the House Appropriations regarding the
collections of revenues, the auditing functions and the construction sales tax. To get around
those issues, last night there was a strike all amendment introduced by the Governor in the
Senate. The strike all amendment contains every provision that the previous bill contain all of
the negative language that cities and towns were concerned about. In terms of strategy, the
League continues to work with the Governor. In fact we thought they had made quite a bit of
progress regarding the collection issue and the auditing issue to the point that we were satisfied
continue to provide updates as they occur.
