HomeMy WebLinkAboutResolution 2013-039 2002 Richard and Mary Park quitclaim deedMARANA RESOLUTION NO. 2013-039 RELATING TO REAL ESTATE; AUTHORIZING THE MAYOR TO EXECUTE A DECLARATION OF SCRIVENER'S ERROR ON BEHALF OF THE TOWN OF MARANA, CORRECTING THE RECEIVING PARTY'S NAME ON A 2002 QUIT CLAIM DEED FROM THE TOWN OF MARANA WHEREAS the Town of Marana recorded a quit claim deed to "Richard M. and Mary M. Park" on January 4, 2002 at Docket 11709 Page 1740, Pima County Recorder's office; and WHEREAS the same quit claim deed with a scrivener's revision showing the receiving party's name as "Raymond M. and Mary M. Paxk" was recorded by the Town of Marana on May 3, 2002 at Docket 11792 Page 887, Pima County Recorder's office; and WHEREAS the receiving party's name on the quit claim deed should have been "The Park Trust dated July 16, 1990," which was the then-owner of the adjacent land; specifically, Lot 9 of Continental Ranch Parcel 50 according to the plat of record in the office of the Pima County Recorder in Book 42 of Maps and Plats at page 54; and WHEREAS Long Title Agency, LLC has requested the Town to file a declaration of scrivener's error to correct the title; and WHEREAS the Mayor and Council of the Town of Marana find that this resolution is in the best interests of the Town of Marana and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, authorizing the Mayor to execute a declaration of scrivener's error in substantially the form attached to this resolution as Exhibit A, with such minor revisions as are mutually acceptable to the Town Attorney and Long Title Agency, LLC. IT IS FURTHER RESOLVED that the Town Manager and staff are hereby directed and authorized to undertake all other and further tasks reasonably required or beneficial to carry out this resolution.
