Civic Center Drive, Marana, Arizona 85653 Council Chambers, May 22, 2013, at or after 7:00 PM Ed Honea, Mayor Patti Comerford, Vice Mayor David Bowen, Council Member Herb Kai, Council Member Carol McGorray, Council Member Jon Post, Council Member Roxanne Ziegler, Council Member REGULAR COUNCIL MEETING CALL TO ORDER AND ROLL CALL. Called to order by Mayor Honea at 7:00 p.m. Town Clerk Bronson called roll. Council Members Post and Ziegler were excused; there was a quorum present. PLEDGE OF ALLEGIANCE/INVOCATION/MOMENT OF SILENCE. Led by Mayor Honea. APPROVAL OF AGENDA. Motion to approve by Council Member Bowen, second by Council Member McGorray. Approved unanimously 5-0. CALL TO THE PUBLIC. David Morales first offered his condolences on the death of the Mayor's father. He then spoke regarding the need for careful budgeting and spending as a result of several things happening to the global economy. PROCLAMATIONS MAYOR AND COUNCIL REPORTS: SUMMARY OF CURRENT EVENTS Council Member McGorray spoke about the high school graduations and the students' enthusiasm about giving back to the community. She also noted that Rotary scholarships given to graduating seniors. Mayor Honea noted that Trish Hein passed away this week. Trish was married to one of Marana's former Town Managers, Mike Hein. She was a great lady and will be missed. He gave details of the memorial service. MANAGER'S REPORT: SUMMARY OF CURRENT EVENTS Meeting Minutes for May 22, 2013 Page 1 of 5 Gilbert Davidson reported that the Marana pool will be opening May 25 through the summer season. The Town will again be partnering with the YMCA to offer swim lessons for children throughout the community. The pool schedule is available on the Town's website. He also recognized the Optimist Club that has done amazing work to help those unable to afford swim fees by donating over $15,000 in the last eight years. Also tied to the opening of the pool is the Splash N Dash, which will begin tomorrow. It has a swimming and a running component. Last year at the end of the first season, it was amazing to see how many people were showing up for this event. He also remarked on the reason for holding the Council meeting tonight instead of its regular day. May 21 was the general election with one important ballot measure before the voters — the Alternative Expenditure Limitation. The results were positive in that the voters reauthorized the use of available revenues over the next four years. Without the passage of that measure, it would have severely impacted the Town's ability to operate. PRESENTATIONS CONSENT AGENDA. C 1: Resolution No. 2013-047: Relating to Community Development; approving and authorizing the Mayor to execute Intergovernmental Agreement Amendment Number Two between Pima County and the Town of Marana for the management and implementation of the 2010-2011 Community Development Block Grant program C 2: Approval of Apri130 and May 7, 2013 draft meeting minutes. LIQUOR LICENSES BOARDS, COMMISSIONS AND COMMITTEES B 1: [Marana Town Council acting as the Gladden Farms Community Facilities District Board of Directors]: A Resolution of the District Board of Gladden Farms Community Facilities District, a Community Facilities District of Arizona, approving a tentative budget for fiscal year 2013-2014 pursuant to ARS §48-716; setting a public hearing date on said tentative budget; filing statements and estimates of the operation and maintenance expenses of the district, the costs of capital improvements to be financed by the approved ad valorem tax levy, and the amount of all other expenditures for public infrastructure and enhanced municipal services proposed to be paid from the tax levy and of the amount to be raised to pay general obligation bonds of the district, all of which shall be provided for by the levy and collection of ad valorem taxes on the assessed value of all the real and personal property in the district; providing for notice of filing the statements and estimates, and notice of a public hearing on the portions of the statements and estimates not relating to debt service on general obligation bonds; and providing that this resolution shall be effective after its passage and approval according to law. B 4: [Marana Town Council acting as the Vanderbilt Farms Community Facilities District Board of Directors]: A Resolution of the District Board of Vanderbilt Farms Community Facilities District, a Community Facilities District of Arizona, approving a tentative budget for fiscal year 2013-2014 pursuant to ARS §48-716; setting a public hearing date on said tentative budget; filing statements and estimates of the operation and maintenance expenses of the district, the costs of capital improvements to be financed by the approved ad valorem tax levy, and the amount of all other expenditures for public infrastructure and enhanced municipal services proposed to be paid from the tax levy and of the amount to be raised to pay general obligation bonds of the district, all of which shall be provided for by the levy and collection of ad valorem taxes on the assessed value of all the real and personal property in the district; providing for notice of filing the statements and estimates, and notice of a public hearing on the portions of the statements and estimates not relating to debt service on general obligation bonds; and providing that this resolution shall be effective after its passage and approval according to law. COUNCIL ACTION A 1: Resolution No. 2013-048: Relating to Budget; adopting the fiscal year 2013-2014 tentative budget. Presented by Erik Montague, who gave a high level overview of the tentative budget, with emphasis on the 2014 General Fund and Reserves, a summary of authorized positions and the sources of revenues to support the budget. Aspects and details of this presentation have been presented periodically to Council over the past several months. Motion to approve by Vice Mayor Comerford, second by Council Member McGorray. Passed unanimously 5-0. A 2: Resolution No. 2013-049: Consideration and possible adoption of a resolution approving the sale and execution and delivery of pledged excise tax revenue and revenue refunding obligations evidencing a proportionate interest of the owners thereof in a purchase agreement from the Town; approving the form and authorizing the execution and delivery of such purchase agreement and other necessary agreements for such sale; delegating authority to determine certain matters and terms with respect to the foregoing; authorizing the taking of all other actions necessary to the consumination of the transactions contemplated by this resolution and declaring an emergency. Mayor Honea noted that there would be no emergency clause attached to this item as an emergency clause requires three-quarters of the Council to be present. Presented by Erik Montague. Motion to approve by Vice Mayor Comerford, second by Council Member McGorray. Passed unanimously 5-0. A 3: Resolution No. 2013-050: Consideration and possible adoption of a resolution authorizing the defeasance of payment obligations of the Town with respect to the Fourth Supplement to Amended and Restated Town Lease and Series 1982 Town Lease with Town of Marana Municipal Property Corporation as determined by the Finance Director of the Town; authorizing the taking of other actions necessary to the consummation of the transactions contemplated by this resolution and declaring an emergency. Mayor Honea noted that there would be no emergency clause attached to this item as an emergency clause requires three-quarters of the Council to be present. Presented by Erik Montague. Motion to approve by Council Member Bowen, second by Council Member Kai. Passed unanimously 5-0. ITEMS FOR DISCUSSION/POSSIBLE ACTION D 1: Relatin to Legislation and Government Actions; Discussion and possible action regarding all pending state, federal, and local legislation/government actions and on recent and upcoming meetings of other governmental bodies. Presented by Del Post, who noted that the issue which dominates discussion among cities and towns is the TPT t� simplification bill, still stalled in the Senate. He hopes to have more news next week. Mayor Honea added to the report by noting that he attended a League executive meeting last week. It looks like of the ten points in the TPT bill, the construction sales tax issue will be dropped off the bill. He and Council Member McGorray met with Rep. Adam Kwasman last week, and he indicated the same thing. The other issue that's a sticking point is audit and whether it's a single audit for an entity every year — if we do an audit on a large corporation, can the state do an audit, and vice versa. The League has been Meeting Minutes for May 22, 2013 Page 4 of 5 working really hard and lobbying every day, and Mayor Christian Price of Maricopa is at the Legislature every day. So it looks like there is a chance that construction sales tax will stay whole, but there is no guarantee until the end of the session. EXECUTIVE SESSIONS E 1: Executive Session pursuant to A.R.S. §38-431.03 (A)(3), Council may ask for discussion or cansultation for legal advice with the Town Attorney concerning any matter listed on this agenda. FUTURE AGENDA ITEMS Notwithstanding the mayor's discretion regarding the items to be placed on the agenda, if three or more Council members request that an item be placed on the agenda, it must be placed on the agenda for the second regular Town Council meeting after the date of the request, pursuant to Marana Town Code Section 2-4-2(B). ADJOURNMENT. At 7:39 p.m., Council Member McGorray made a motion to adjourn, seconded by Vice Mayor Comerford. Passed unanimously S-0.
