OF PAGES: SEQUENCE: MAIL AMOUNT PAID $ 8.00 ~ MARANA ORDINANCE NO. 2006.33 RELATING TO BUILDING; ADOPTING BY REFERENCE THE 2006 INTERNATIONAL BUILDING CODE, THE 2006 INTERNATIONAL RESIDENTIAL CODE, THE 2006 INTERNATIONAL MECHANICAL CODE, THE 2006 INTERNATIONAL PROPERTY MAINTENANCE CODE, THE 2006 INTERNATIONAL ENERGY CONSERVATION CODE, AND THE 2005 NATIONAL ELECTRIC CODE; CONDITIONALLY ADOPTING BY REFERENCE THE 2006 INTERNATIONAL PLUMBING CODE; ADOPTING LOCAL AMENDMENTS TO THE FOREGOING CODES; ADOPTING THE 2006 MARANA POOL AND SPA CODE; AMENDING MARANA TOWN CODE TITLE 7 BY REVISING SECTION 7-1-2; AND PROVIDING AN EFFECTIVE DATE. WHEREAS the Town is authorized by A.R.S. S 9-467 to require building permits; and WHEREAS the Town is authorized by A.R.S. S 9-802 to adopt codes and public records by reference; and WHEREAS the Town Council finds that the building code regulations established by this ordinance are necessary for the public health, safety and general welfare of the Town of Marana. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, as follows: SECTION 1. The following, declared by Marana Resolution No. 2006-203 to be a public record and available for review in the Town Clerk's office, are hereby adopted by reference: A. The 2006 International Building Code and the local amendments to it. B. The 2006 International Plumbing Code and the local amendments to it, effective if and when A.R.S. S 9-805 is repealed or amended so that local governments are authorized to adopt a plumbing code other than the state plumbing code. C. Section 7-1-2 of the Marana Town Code is hereby revised as follows (with deletions shown with strikeouts and additions shown with double underlinin2:): Section 7-1-2 Building codes adopted A. The Marana building code, codified in this title, consists of adopts by refer ence the 2000 International Building Code as amended, of the International Code Council, together with the following code documents incoroorated bv this reference in this title. all of which are on file with the town clerk's office: 1. L The Arizona state plumbing code; orovided. however that if and when A.R.S. & 9-805 is reoealed or amended so that local aovernments are au- thorized to adoot a olumbina code other than the state olumbina code. the state olumbina code is automaticallv reolaced with the 2006 international olumbina code. with local amendments. .3...2-,. B. The Marana building code adopts by reference the following local ordinances and codes. which are on file with the town clerk's officeby reference: 1. The 2006 Marana 0001 and soa codc1996 Tucson/Pima County spa/pool ooGe;-,!, 2. The 2003 Marana outdoor lighting code. SECTION 3. For a six-month period after the effective date of this ordinance, the Marana Building Official is expressly given discretion and authority to allow projects already under de- sign when this ordinance becomes effective to be reviewed based on the codes in effect immedi- ately prior to the effective date of this ordinance. If any section, subsection, sentence, clause, phrase or portion of this ordi- nance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, the decision shall not affect the validity of the remaining portions of this ordinance. ~~I 11,:," 'F! :~~~ Fl ~~~ SECTION 6.
