RELATING TO TRANSACTION PRIVILEGE TAX; EXPANDING AND CLARIFYING THE
DESIGNATED USE OF CERTAIN TAX RECEIPTS; AND SETTING AN EFFECTIVE DATE
WHEREAS Town of Marana Resolution 2001 -08 designated that three- fourths of the tax
revenue generated from construction contracting activity within the Town of Marana be used
solely for "transportation capital improvements "; and
WHEREAS the Mayor and Council of the Town of Marana find that this resolution
expanding and clarifying the designated use of certain tax receipts is in the best interests of the
Town of Marana and its citizens for reasons that include fewer available alternative financial
resources and an increased demand and desire for multimodal forms of transportation.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, as follows:
Section 1. Marana Resolution No. 2001 -08 is hereby modified to provide that three -
fourths of the tax revenue generated pursuant to sections 8 -415, 8 -416, and 8 -417 of the Marana
Town Code from construction contracting activity within the Town of Marana, and all interest
generated from it, shall be used solely for all transportation improvements within public roadway
rights -of -way and within public easements adjacent to the roadway rights -of -way, including
roadways, sidewalks, shared use paths, bus pullouts, and ancillary construction needed to affect
such improvements, such as utility relocations and drainage improvements.
Section 2. The various town officers and employees are authorized and directed to
perform all acts necessary or desirable to give effect to this resolution.
Section 3. All resolutions or motions and parts of resolutions or motions of the Council in
conflict with the provisions of this resolution are hereby repealed, effective as of the effective
date of this resolution.
Section 4. If any portion of this resolution is for any reason held to be invalid or
unconstitutional by the decision of any court of competent jurisdiction, the decision shall not
affect the validity of the remaining portions of this resolution.

Section 5. This resolution shall become effective on July 1, 2014.
