PAGES: ORDIN PICK UP AMOUNT PAID: MARANA ORDINANCE NO. 2014.016 RELATING TO FINANCE; ADOPTING THE AMENDED TOWN OF MARANA COMPREHENSIVE FEE SCHEDULE; ELIMINATING CERTAIN POOL FEES IMMEDIATELY; AND DESIGNATING AN EFFECTIVE DATE WHEREAS the Town Council is authorized by A.R.S. § 9 -240 (A) to control the finances of the Town; and WHEREAS Marana Ordinance No. 2009.11, adopted on June 9, 2009, established the Town of Marana Comprehensive Fee Schedule, which was made a public record by the adoption of Marana Resolution No. 2009 -87; and WHEREAS Town staff has completed its annual review of the Comprehensive Fee Schedule and recommends amendments to the schedule based on this review; and WHEREAS pursuant to A.R.S § 9- 499.15, written notice that the Town Council would meet to consider approving new fees and/or fee increases on May 20, 2014 was duly made; and WHEREAS the Town Council finds that amending the Comprehensive Fee Schedule is in the best interests of the Town and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, as follows: SECTION 1. The amended Town of Marana Comprehensive Fee Schedule, three copies of which are on file in the office of the Town Clerk of the Town of Marana, Arizona, which was made a public record by and attached as Exhibit A to Resolution No. 2014 -050 of the Town of Marana, Ari- zona, is hereby referred to, adopted and made a part of this Ordinance as if fully set out here. SECTION 2. The various town officers and employees are authorized and directed to per- form all acts necessary or desirable to give effect to this Ordinance. SECTION 3. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this Ordinance are hereby repealed, effec- tive as of the effective date of this Ordinance. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent ju- risdiction, such decision shall not affect the validity of the remaining portions hereof. -1- SECTION 5. Notwithstanding the effective date set forth in Section 6 below, the following fees in the Comprehensive Fee Schedule adopted pursuant to Ordinance No. 2013.012 and effective July 22, 2013, shall be eliminated effective immediately upon adoption of this ordinance.
