HomeMy WebLinkAbout12/05/2006 Blue Sheet Building Code Amendments TOWN COUNCIL MEETING INFORMATION TOWN OF MARANA MEETING DATE: December 5, 2006 AGENDA ITEM: J. 5. a TO: MAYOR AND COUNCIL FROM: Jack Holden, Building Official SUBJECT: Ordinance No. 2006.33: Relating to Building; adopting by refer- ence the 2006 International Building Code, the 2006 International Residential Code, the 2006 International Mechanical Code, the 2006 International Property Maintenance Code, the 2006 Interna- tional Energy Conservation Code, and the 2005 National Electric Code; conditionally adopting by reference the 2006 International Plumbing Code; adopting local amendments to the foregoing codes; adopting the 2006 Marana Pool and Spa Code; amending Marana Town Code Title 7 by revising Section 7-1-2; and provid- ing an effective date. DISCUSSION Every three years the International Code Council publishes new comprehensive codes that are approved through a consensus process for adoption by jurisdiction throughout the United States. This agenda item proposes to adopt the 2006 versions of the codes. The 2006 International En- ergy Conservation Code is a new code proposed to be adopted by this action. The 2006 Interna- tional Plumbing code is adopted conditionally - it will only be effective if the Arizona legislature repeals or amends A.R.S. ~ 9-805, which requires municipalities to adopt the State plumbing code established by the Arizona Uniform Plumbing Code Commission under A.R.S. ~ 41-619. This action also proposes to adopt an updated version of the Marana Pool and Spa Code and the 2005 National Electric Code published by the National Fire Prevention Association. Local amendments to most of these codes are also adopted by this item, to meet local conditions spe- cific to the desert southwest region. If adopted, this ordinance will also make conforming changes to Title 7 of the Town Code, where these particular codes are referenced. This ordinance is effective thirty days after its adoption, but provides for a six-month grace pe- riod within which the Building Official is given the discretion to allow applicants to use the cur- rent codes for projects already in the design phase. Building Code fees are not changed by this ordinance. In a major change from previous practice, this ordinance would eliminate the exemption of agri- cultural buildings from obtaining construction permits. The increasingly urbanized character of {OOO03005.DOC /2} - 1 - 11/29/200612:18 PM FJC the Town and its increased population density make it necessary to permit and inspect agricul- tural buildings to insure the safety of the public. This item does not adopt the 2006 International Fire Code. RECOMMENDATION Staff recommends adoption of Ordinance No. 2006.33, adopting the updated building codes, as amended. WHEREAS the Town is authorized by A.R.S. S 9-467 to require building permits; and WHEREAS the Town is authorized by A.R.S. S 9-802 to adopt codes and public records by reference; and WHEREAS the Town Council finds that the building code regulations established by this ordinance are necessary for the public health, safety and general welfare of the Town of Marana. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, as follows: SECTION 1. The following, declared by Marana Resolution No. 2006-203 to be a public record and available for review in the Town Clerk's office, are hereby adopted by reference: A. The 2006 International Building Code and the local amendments to it. B. The 2006 International Plumbing Code and the local amendments to it, effective if and when A.R.S. S 9-805 is repealed or amended so that local governments are authorized to adopt a plumbing code other than the state plumbing code. C. The 2006 International Residential Code and the local amendments to it. D. The 2006 International Mechanical Code and the local amendments to it. E. The 2006 International Property Maintenance Code and the local amendments to it. F. The 2006 International Energy Conservation Code and the local amendments to it. G. For a six-month period after the effective date of this ordinance, the Marana Building Official is expressly given discretion and authority to allow projects already under de- sign when this ordinance becomes effective to be reviewed based on the codes in effect immedi- ately prior to the effective date of this ordinance. SECTION 4. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed as of the effective date of this ordinance. SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this ordi- nance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, the decision shall not affect the validity of the remaining portions of this ordinance. SECTION 7.
