HomeMy WebLinkAbout12/05/2006 Blue Sheet Authorizing Staff to Cancel Public Hearings TOWN COUNCIL MEETING INFORMATION TOWN OF MARAN A MEETING DATE: December 5, 2006 AGENDA ITEM: J. 6 TO: MAYOR AND COUNCIL FROM: Frank Cassidy, Town Attorney SUBJECT: Resolution No. 2006-204: Relating to Administration; directing and authorizing the Town Manager and staff to cancel public hearings if the purpose for them becomes moot by reason of the Governor's issuance of a proclamation concerning the canvass of the November 7, 2006 election. DISCUSSION Town staff has set December 11 and December 12, 2006 public hearings before the Planning Commission and the Town Council, respectively, for the purpose of enacting various land use ordinances prior to the effective date of Proposition 207. By law, Proposition 207 will become effective when Governor Napolitano issues a proclamation concerning the canvass of the No- vember 7, 2006 election. As of this writing, the Secretary of State is scheduled to complete the canvass of the November 7, 2006 election on December 4,2006, and the Governor's proclama- tion can occur at any time thereafter. If the Governor issues the proclamation on or before De- cember 12, 2006, the proposed land use ordinances set for public hearing on December 11 and December 12 will become moot. This item will simply allow the Town Manager and staff to cancel the December 11 and Decem- ber 12 public hearings if they are mooted by the Governor's proclamation. RECOMMENDATION Staff recommends adoption of Resolution No. 2006-204. SUGGESTED MOTION I move to adopt Resolution No. 2006-204. {00003026.DOC /} FJC/cds MARANA RESOLUTION NO. 2006-204 RELATING TO ADMINISTRATION; DIRECTING AND AUTHORIZING THE TOWN MANAGER AND STAFF TO CANCEL PUBLIC HEARINGS IF THE PURPOSE FOR THEM BECOMES MOOT BY REASON OF THE GOVERNOR'S ISSUANCE OF A PROCLAMATION CONCERNING THE CANVASS OF THE NOVEMBER 7, 2006 ELECTION. WHEREAS Town staff has set public hearings before the Marana Planning Commission and the Town Council on December 11 and December 12, 2006, respectively, to consider the enactment of certain land use ordinances prior to the effective date of Proposition 207; and WHEREAS Proposition 207 will become effective upon the issuance of the Governor's proclamation concerning the canvass of the November 7, 2006 election; and WHEREAS the Town Council finds that it is prudent to facilitate the cancellation of the December 11 and December 12, 2006 public hearings if the Governor's proclamation makes the purpose for those hearings moot. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, as follows: SECTION 1. If the Governor's proclamation regarding the canvass of the November 7, 2006 election occurs before one or both of the public hearings scheduled for December 11 and December 12, 2006, the Town Manager and staff are hereby authorized to take all steps necessary to cancel those public hearings. SECTION 2. The Town's Manager and staff are hereby directed and authorized to undertake all other and further tasks required or beneficial to carry out the terms, obligations, and objectives ofthis resolution.
