DEED RESTRICTIONS
DKL has agreed to place the following Deed
Restrictions on the Landfill Property:
• The landfill shall be used only for the final disposal of Non-
Hazardous Solid Waste in accordance with Federal and Arizona
state laws and the terms of any governmental authorizations
applicable to the Project or the Property.
• No Rail Spur. The Property shall not be connected to a rail s pur,
nor shall a rail spur be constructed on the Property.
• No Access from West Silverbell Road.

Conditions Necessary for MRLF to Pose a Risk to Public Health
ALL three of the following conditions must be satisfied:
1. There must be hazardous chemicals or other substances in the
landfill; AND
2. There
must
be
mechanisms by which the substances could be
released
from
the
landfill;
AND
3. There must be completed exposure pathways by which people
eat, drink, or breathe hazardous substances.
If ANY of these conditions is not met, then there is no risk.
