A minor amendment to the General Ptan of approximately 34.6-acres of la.nd located within a portion of Section 1, Township 12 South, Range 12 East, at the svuthwest corner of Tangerine Road and Camino de Oeste, (the "Rezoning Area"), changing the la�d use des��on � from Low Density Residential to Master Planning Area. 1 � � � L J' Section 2. The zoning of approaimately 34.6-acres of land located within a Portion of Section 1, Town.ship 12 South, Range 12 East, at the southwest corner of Tangerine Road and Camino de Oeste, (the "Rezoning Area"), is hereby changed from Zone "R-36" (Single Family Residential, 36,000 sq. ft. minimwn lot size) to "F" (Specific Plan) creating the Casa Se�+illa Specific Plan. Section 3. A water service a�gr�ment and a master water plan must be submitted by the Deveioper awd accepted by the Town of Marana Utilides Director and/or Tucsoa Water prior to the approval of tl�e water plans. 16. Maximum building height shall be restrict�d to 23 feet. 17. Where a�plicable view fen,cing, similar to wrought iron fe�cing, sball be constructed at t�e rears of the residential units. 18. An annual report shall be submitted the Planning Department within 30 days of tbe anniversary of the Town Council's approval of the Specific Plan in addition to those requiremwts listed in t�e Land Development Code and Specific Plan. 21. Upon adoption of the ordinanece by t�e Mayor and Council approving the Casa Sevilla Specific Plan, the a�plicant shall provide the platu�ing departiment with the following fin,al edition of the Casa Sevilla Specific Plan: one non-bound original; twenty-five bound copies; and, one digital copy in Microsoft Word or other acceptable format, within thirty days of the adoption Section 4. All Ordinances, Resolutions and Motions and parts of Ordir►ances, Resolutions, and Motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of Ordinance No. 2005.13. The project area is located in Marana on the Tortolita Fan, northwest of Tucson and southwest of the Tortolita Mountains. The parcel is bounded by Tangerine Rd. on the north, vacant land to the east, Miggity Lane on the west and residential property on the south. Specifically the project area is located in Township 12 Southq Range 12 East, Section 1. The elevation in theproject area ranges from approximately 2583 feet above sea level at the southwestern corner to approximately 2630 feet above sea level at the northeastern corner. Sediments within the area are mostly sandy with few gravels. Vegetation within the project consists of the standard upland Sonoran Desert species such as ironwood, mesquite, and paloverde trees and mixed cactus varieties. In total, the �pecific Plan includes approximately 34.65-acres, The Casa Sevilla Specific Plan site currently falls under the Town of Marana Jurisdiction. Please refer to Location and Vicinity Map. The Casa Sevilla Specific Plan has been designed to include abundant areas of land to be left intact for the conservation; therefore reducing potential conflicts with the Pygmy Owl. Of the 34.65-acres, 7.85-acres will be graded and developed. V egetative Communities and Associations on the Site The project site is located on the southern flank of the Tortolita 1�/Iountains in the Tortolita Fan and contains native vegetation which is typical of that found in the Arizona Sonoran Desert_ TTie site drains from the northeast to the soutlzwest and there are several well defined washes nlnning through the property. Existing vegetation on the site can be categorized into two distincf communities; A.rizona Sonoran Uplands, a less dense desert scrub in the uplands, and Sonoran Xeroriparian growing along the washes. 1) ?�rizona Sonoran Upland Subdivision, Paloverde-cacti series: Dominated by saguaros and palo verdes, e�isting upland vegetation across the property is diverse and has good structural density. The overstory consists of sa�uaros (Ca�zegiea g foothill palo verdes (Cercidium microphyllzcm), ironwood (Olneya tesota) and ocotillo (Fouqzcieria splendens). Understory contains triangle-leaf bursage (ArnbYOSia ' cleltoiclea), creosote bush (Lan-ea tridentata) and a vaziety of cacti. - � _ The health of existing upland vegetation on site is generally good to fair. The sab aro age structure zs healthy, with a trreat deal of small, � regenezating sa�uaros as weil as numerous lar�e ones over 30-feet tal1, Many of the upland trees are eYhibiting signs of stress due to current � drought conditions. This is evident in the extreme amounts of dead �ood � and infestation of mistletoe. � 2) Sonoran Xeroriparian vegetation: Immediately adjacent to the Sonoran.uplands is riparian vebetation, that vegetation which is associated with the washes running through the property. This communiry is winter deciduous and is dominated by mesquite trees (PYosopis velutina) and �vhitethom acacia (Acacia constricta). � The health of eYisting ripan.an on site is �enerally good. Viewsheds Onto and Across the Site The Casa Sevilla project area is located in an undeveloped area within the Town of Marana, located in southern Arizona. There are no commercial or residential developments iinmediately adjacent to the entire property. Topography within the project area is gently sloping to the southwest. There are no steep hills or significant topographic features. The general landscape is dominated by natural desert upland vegetation with two braided washes, varying in width from 6-20 feet, crossing the project area. Views of the fareground (zero to two miles) are dominated by inature native trees, cacti, and shrubs. It is complex with many shapes and sizes of species of trees, cacti, and perennial shrubs. Views of the middle ground (two to eight miles) are partially obstructed by vegetation in the foreground. However, views of undeveloped natural open space and desert are also present. The middle ground is multileveled and takes on a soft look of the mesquite and palo verde trees contrasting the tall-branched saguaro cacti. Views of the background (greater than eight miles) include the Tortolita, Tucson, and Catalina Mountains. 3. Areas of High Visibility from Adjacent Off-Site Locations The site is bordered By Native Plant Vegetation of which 98% will remain intact through conservation. The only area anticipated to be disturbed is the main entrance road to the site and the exit location where the sanitary sewer easement is proposed. Existing and Proposed Offsite Streets The site is serviced by Tangerine Rd. and intersects with Miggity Rd. and Camino Del Oeste. No off-site roads are proposed as a part of this project other than improvement of 295 ft. of Camino de Oeste from Tangerine Rd. to a point in front of the proposed site entrance. Existing roadways within the project area are shown on Exhibit I. G.1: Traffic. Tangerine Rd. Tangerine Rd. is a 2-lane highway principal arterial with a variable R-O-W expanding to 150' in front of the siteo It is understood that Tangerine Rd. is scheduled to be improved to a 4-6-lane facility with a 300' R-O-W. The posted speed is 50 MPH. The. current ADT is approximately 7000 with a proposed ADT of 23,300. It would be expected that Arizona-DOT would have already evaluated future development immediate to the proposed site and therefore would have accounted for the impact associated with this site. It is anticipated that no additional studies would be necessary. Miggity Lane Miggity Lane is a 60' R-O-W with a 2-lane dirt road section. Location The 34.65 -acre Casa Sevilla Specific Plan property is located in the East-Central portion of the Town of Marana in Section O1 Township 125, Ran�e 12E. The site lies approximately 6 miles east of Interstate 10. Tangerine Rd. is the northern boundary and vacant residential land is the southern boundary. Miggity Lane bounds the site along the western edge. The eastern edge is bound by Camino de Oeste. C. Authority and Scope The Town of Marana Land Development Code provides the uniform procedures and criteria for the preparation, review, adoption and implementation of Specific Plans in Marana. The Casa Sevilla Specific Plan will serve as the zoning and development code for the property. Final plats and any other development approvals will be consistent with the Specific Plan. D. Legal Description Please see Exhibit II.D.1 for Pima County Assessor's parcel record information. E. Goals The goals of this Specific Plan are to create a development plan that utilizes both the Town of Marana General Plan and the proposed residential design to produce a community that will provide marketability and feasibility. Coupled with the above goals, the development is design such that natural open space is maintained, impacts to existing washes are minimal and onsite amenities are provided for the residents. Relationship to Adopted Plans The proposed Specific Plan will conform to the Town of Marana General Plan and the recommendations set forth by regulatory agencies involved in permitting. A cross check has been made between the proposed development and the subdivision requirements within the town. A review illustrated the deviations accordingly. Exhibit II.F.1 G. Land Use Concept Plan 1. The Casa Sevilla Specific Plan consists of the construction of 34 single family units with a 0' lot line. Construction of units will follow applicable building code requirements. The Development will be served by a 1250 ft private drive ending at a cul-de-sac that traverses the site from the northeast to southwest direction. See enclosed Site Plan, Exhibit II.A.1. 2. The density proposed is less than 1 unit per acre. The proposed graded area is 7.85-acres out of the 34.65-acres. It is anticipated that 2.15-acres of the total will be donated to a Public Right of Way. This donated right-of-way includes a 75' strip along the northerly property line. (See Site Plan Exhibit II.A.1 of this section). The remaining (24.6�-acres) will be donated to a Homeowners Association regulated by CC&R's. 3. Individual lot coverage is proposed at 41 %. The building footprints range from approximately 2500 sf to 2700 sf. The footprints will either be single story or two story units. Please see Exhibit II.G.1 through II.G.4 for building elevations. 4. 4-7 ft masonry privacy walls will be constructed between each lot with an open decorative fence along the rear property line facing the natural open area. Recreation Concept Within the developrnent of Casa Sevilla there will be a community center and swimming pool. Approximately 70% of the present gross site area will be left in a natural state for resident enjoyment. Considering the amount of land being set aside for conservation, there will be a large amount of open space utilized for recreation areas. (i.e. walking trails within the natural wash areas) N. Cultural Resources � On August 3, 2003, SWCA, Inc., Environmental Consultants conducted an � archaeological survey of approximately 23.5-acres of privately held land southwest of the intersection of Tangerine Rd and Camino de Oeste, west of Interstate 10. This � � � work was completed under contract with T-K Engineering & Design Group, Inc. who proposes to develop the parcel (SWCA Project No. 7158-067.) The Casa Sevilla parcel is located in Township 12 South, Range 12 East, Section 1, (G&SRB&MO). Prior to fieldwork, SWCA conducted a site file search of the on-line AZSITE database for records of previously conducted cultural surveys and known '� archaeological sites within or near the project area. The search revealed that the project area had previously been surveyed in the early 1980's. No previously � recorded sites were located within the parcel. � � � � � As a result of the current survey, one previously unknown archaeological site was recorded. AZ AA 12:931 (ASNI) is considered ineligible for the National Register of Historic Places. One isolated occurrence was also found within the project area. SWCA recommends no further archaeological work for the surveyed parcel. Casa Sevilla Specific Plan Apri12005 -IS- Development Plan O. Viewsheds This project is designed to have little to no effect on viewsheds from adjoining properties. Views and vistas of both the onsite vegetation and offsite features, such as the Tortilita Mountains, will not be inhibited by this project. Homes will be situated to take advantage of the distant views while natural buffers shall be maintained along the property perimeter to help maintain the rural character of the project. P. Public Utilities & Due Diligence 1. Sewer: Sanitary sewer service will be provided by a private gravity sewer system to a private lift station. The force main will be maintained in a 20 ft easement and will be constructed in a manner as to minimize any disturbance in the existing riparian habitants within the wash. (Exhibit II.P.1) 2. Glover St. The closet high school to the site is Mountain View High School located at 3901 W. Electric Service Electric service is expected to be obtained from Trico Electric Cooperative, Inc. of which currently exists along Tangerine Rd. 6. GeotechnicalInvestigation A report by AMEC Earth & Environmental, Inc. has been prepared and is available in appendices as Exhibit II.P.3. The findings and recommendations will provide for the basis of pavement design, foundation design and retaining wall design. No extraordinary circumstances exist. Purpose ancl Intent These regulations are to serve as the basis of design far the proposed 34-unit development. The �Casa Sevilla Specific Plan is a 34-unit gated residential community with a central recreational area. Significant open space will be maintained and donated to a Homeowners Association regulated by CC&R's. B. Applicability of Town of Marana Zoning Code The Town code is the foundation for applicable requirements as such this Specific Plan follow in some detail yet deviated in areas that are necessary to make it a viable project. C. Residential The following regulations shall apply to the Residential Area Designation (RA): 1. Permitted Uses: a. Site Build Residential Dwelling Units b. Community Recreation Facilities c. Parking d. Utilities e. Emergency Access Drive 2. Open Space Open Space Regulations shall apply to the Open Space Designation (total land outside the developed portion of the RA areas), The lands within the Open Space areas �hall be preserved as natural undisturbed areas. 1. Environmental Standards: a. The Opem Space land use designation shall be preserved for habitat mitigation. b. All disturbed areas will be landscaped re re-vegetated in accordance with the Casa Sevilla Landscape Preservation Plan. c. Natural Open Space areas of vegetation designated to be preserved shall be protected during grading and construction activities by fencing and flagging, and in accardance with the Casa Sevilla Landscape Preservation Plan. 2. Maintenance: a. A Homeowner's Association regulated by CC&R's shall manage all Open Space areas and undeveloped Residential Areas to ensure continued preservation of these lands. b. The Conservation Plan shall implement the guidelines of the U.S. Fish and Wildlife Service that relate to this site. Casa Sevilla Specifc Plan Apri12005 -4- Development Regulations E. Minimum Roadway Development Standards 1. Application These minimum stxeet standards are additions to the existing Town roadway standards and cross-sections and may be used in addition to the specified details of the Town roadway standards. All internal roadways shall be private roadways, owned by the Casa Sevilla Homeowner's Association. 2. Functional Classifications Defined Within Casa Sevilla, the local streets may carry Average Daily Traffic Volumes (ADT) of up to 199 vehicles. Design speed far these local streets is 25 mph. The Directional Distribution is estimated at 50% entering and 50% existing. 3. Cul-de-sacs Restrictions on the length of cul-de-sacs contained within the Town of Marana Street Standards do not apply to Casa Sevilla. There is no restriction on cul-de- sac length. The minimum turnaround right-of-way radius shall be 45 feet to the backface of wedge curbo "T" and "Y" shaped turnarounds may be used without curbs. 4, Curbing and Sidewalks Roadway layouts in Casa Sevilla should have minimum affect on existing drainage patterns in either sheet flow areas or defined channels. Wedge curbs are appropriate for Casa Sevilla and will be a minimum of 1_0 foot wide. Sidewalks are planned for the development. Casa Sevilla Specific Plarz Apri12005 -5- Development Regulations Landscaping or revegetation in accordance with the Casa Sevilla Landscape Preservation P1an shall be employed to revegetate back to the edge of curb. 5, Travel Lanes In Casa Sevilla, vehicular travel lanes are to be a minimum 12.0 feet pavement section with 2 foot wedge curbing for a total width of 28 feet. The entryway with access from Camino de Oeste will have a variable right of way right-of-way (28 foot minimum) constructed with two 14 foot lanes in each direction with a divided median and will taper to a 24 foot width pavement section. The proposed entrance will be gated. The local streets within Casa 5evilla will have a minimum of 24 feet of pavement with a 2 foot wedge curb and a total right-of-way of 28 feet. Due to the presence of washes to both the east and west, secondary access will not be provided. Sprinkler systems will be installed in all building structures.
