R.ELA.TING TO DEVELOPMENT; APPROVING A CONDITIONAL USE PERMIT TO
ALLOW THE DEVELOPMENT OF A NEW WIRELESS COMMUNICATION FACILITY AT
5541 WEST LINDA VISTA BOULEVARD
WHEREAS, Verizon Wireless has applied to the Town of Marana for approval to
develop a new wireless communication facility at 5541 West Linda Vista Boulevard, generally
located on the south side of Linda Vista Boulevard approximately 980 feet west of Hartman
Lane; and
WHEREAS, the subject property is the site of an existing Town of Marana water
reservoir and pump station, and is currently zoned as "MR -I" (Multi Family High Density); and
WHEREAS, the development of the site will include the construction of a new 54 -foot
antenna tower camouflaged as a palm tree (monopalm) as well as a block enclosure to contain
the associated ground - mounted equipment cabinets; and
WHEREAS, the Marana planning Commission considered the request for the approval of
the conditional use permit on October 28, 2015, and voted 7 -0 to recommend that the Mayor and
Town Council approved the conditional use permit; and
WHEREAS, the Marana Mayor and Town Council has heard from the representative(s)
of the owner, Town staff, and members of the public at the regular Town Council meeting held
November 17, 2015, and has determined that the conditional use permit should be approved.
NOW, rF IEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MAI2AN A, that the request fled by Verizon Wireless for a conditional use permit to
allow for the development of a new wireless communication facility to be located at 5541 W.
Linda Vista Boulevard is hereby approved subj ect to the following conditions:
1. Compliance with all applicable provisions of the Town of Marana Codes and ordinances
including, but not limited to, Title 23 of the Land Development Code that are current at
the time of development.
2. The applicant or designed representative shall obtain all required building permits prior
to development of the wireless communication facility.
3. The applicant shall submit a written statement from the Federal Communication
Commission (FCC) and the Federal Aviation Agency (FAA) that the proposed tower and
its communications use by the applicant complies with applicable regulations
administered by those agencies or that the tower is exempt from those regulations.
4. The applicant will be required to plant a minimum of two live palm trees similar in
appearance and height to the monopalm. The trees must be provided with permanent
irrigation.
