HomeMy WebLinkAboutResolution 2016-050 Approving & Authorizing Amendment of the Anderson - Johns Final Plat Lots 1 & 2MARANA RESOLUTION NO. 2016-050 RELATING TO DEVELOPMENT APPROVING AND AUTHORIZING THE PLANNING' DIRECTOR TO EXECUTE AND RECORD AN AMENDMENT TO GENERAL NOTE NO. 7 ON THE COVER SHEET OF THE ANDERSON / JOHNS FINAL PLAT, LOTS I AND 2 TO CLARIFY BUILDING SETBACK RE AND PROVISIONS WHEREAS the Anderson / Johns Final Plat Lots I and 2 was approved b the Town Council on Januar 19, 2016, b the adoption of Marana Resolution No. 2016-006, and was recorded in the office of the Recorder of Pima Count Arizona, at Se 20160220177, for propert g enerall y located west of Camino de Oeste and south of the Camino del Norte ali and WHEREAS the buildin setbacks depicted for Lots I and 2 on Sheet 2 of the plat indicate onl one scenario for lot fronta determined b the point of vehicular access, and re clarification that other options for lot fronta exist; and WHEREAS amendin General Note No. 7 on the cover sheet of the plat to specif that the setbacks depicted on Sheet 2 are conceptual and for illustrative purposes onl will clarif that other options for vehicular access and, thus, lot fronta are available; and WHEREAS the Town Council has determined that the proposed amendment and this process for makin the amendment are the most efficient wa to address the issue in a manner that g ives full disclosure of the revision to the g eneral public and to purchasers of lots in the subdivision, and should be approved. NOW, THEREFORE, BE IT RESOLVED b the Ma and Council of the Town of Marana, Arizona, that the amendment to General Note No. 7 on the cover sheet of the Anderson / Johns Final Plat Lots I and 2 is hereb approved in substantiall the form attached as Exhibit A to this resolution, and the Plannin Director is hereb authorized to execute and record it on behalf of the Town. PASSED AND ADOPTED b the Ma and Council of the Town of Marana, Arizona, this 17"' da of Ma 2016. - - --- ------ MARAN AA-)7 ATTEST: J ocel y n VBronson, Town Clerk Marana Resolution No. 2016-050 5/512016 9:04 AM BV/FJC Ma Ed H4nea V EXHIBIT A NOTICE OF AMENDMENT TO GENERAL NOTE NO.7 OF ANDERSON 1 JOHNS FINAL PLAT LOTS 1 AND 2 The undersigned, who are the only parties having any fee title interest in the property depicted on the final subdivision plat entitled Anderson 1 Johns Final Plat Lots I and 2 (the "Anderson 1 Johns Plat ") recorded in the Pima County Recorder's Office at Sequence 20160220177, with the consent and approval of the Town of Marana, hereby modify the cover sheet of the Anderson 1 Johns Plat by amending General Note No. 7 to read as follows: "SETBACK REQUIREMENTS (PER R -36 ZONING): FRONT: 30 FEET SIDE: 15 FEET STREET SIDE: 20 FEET REAR: 40 FEET THE SETBACKS DEPICTED ON SHEET 2 OF THIS PLAT ARE CONCEPTUAL AND FOR ILLUSTRATIVE PURPOSES ONLY. SETBACKS WILL BE PROVIDED IN ACCORDANCE WITH THE STANDARDS FOR R -36 ZONING PER THE MARANA LAND DEVELOPMENT CODE."
