REGULAR COUNCIL MEETING
CALL To ORDER AND ROLL CALL: Mayor Honea called the meeting to order at
7:01 p.m. Deputy Town Cleric Hilary Hiser called the roll, all council members were
present constituting a quorum.
PLEDGE OF ALLEGIANCE/INVOCATION/MOMENT OF SILENCE: Led by Mayor
Honea,
APPROVAL OF AGENDA: Mayor Honea stated he was moving item C4, relating to
the Lazy K Development, from Consent, and placing it as the first item. on Action pre
the request of several council members
Council Member I<ai motioned to approve the agenda with a second provided by
Council Member Ziegler. Motion passed unanimously 7--0.
CALL To THE PUBLIC:

Elaine Andaloro addressed the Council expressing her concerns about the quality of
the drinking water in Continental Reserve. She asked the Council to consider
reimbursing families living in the area who purchase bottled drinking water.
Clint Harris stated that he purchased a home located. in Continental Reserve in May.
He was not advised about the contaminated water upon purchase of his home. He
stated that if the Town thought it had an ethical obligation to inform current residents
about the water quality then it also had an obligation to inform future residents of the
water quality. Mr. Harris noted that the EPA has classified these containments as cancer
causing agents. He wants to know if the Town of Marana is enlisting the aid of other
government agencies to assist with the clean-up. Mr. Harris also asked the Town
Council to schedule a town hall with residents to engage in a productive and
transparent dialogue regarding the water issues.
Mary Hoover presented a cartoon published in the Sunday paper lampooning Marana's
water issue. She asked for quick action by the Council to address this problem, so as to
avoid future negative criticism of the Town.
David Morales spoke briefly about the issues related to the ingress/ egress of the San
Lucas housing development. He noted that residents of the area need an additional
road in the event of a train blocking McKenzie Load.
Jack Neubecic also expressed conceal regarding the lack of additional ingress/egress
options for residents in the San Lucas area to use in the event of an emergency. He
related several stories from residents who have had negative experiences with the
single ingress/ egress. Mr. Neubeck asked the Town to consider an alternative
temporary road option use of the maintenance road near the C.A.P. canal until the
construction of a permanent alternative.
Jack Ferguson noted that a recent KVOA news story reported that the Council had not
picked a plan of action to address the water issues, but was only going to conduct a
study. He asked the Council to make a decision regarding the proper course of
treatment and stick to it.
William Eldridge also spoke about the water quality issues. He asked if the Council
would move forward with a study to see hove the residents' use of filtration systems
addresses the water quality coming into homes. He wondered if there might be a way
for residents to be reimbursed by the Town for the expense of putting in a filter system.
Mr. Eldridge noted that the water issues are starting to negatively impact the businesses
and home builders in the area.
Barbara Rose addressed the Council regarding the mazy K Bar Ranch. She wrote a
poem expressing her views regarding the development. She also read several notes
from residents who signed a petition in protest of the development. All the comments

were in opposition to the approval of the Lazy K Bar Ranch and asked the Council to
vote no on the development and work to preserve the area as is.
Council Member Ziegler asked Mr. Montague to consider the possibility of providing
residents drinking water and to investigate the possibility of hosting a town hall before
the end of the month regarding the Town's response to the water issues.
PROCLAMATIONS:
P1 Proclamation honoring Jocelyn C. Bronson's 22 years of service to the Town of
Marana. Dead by Deputy Town Manager Erik Montague. Retiring Town. cleric
Jocelyn Bronson addressed the Council and audience thanking them for providing her
a wonderful opportunity to grow professionally. She stated how proud she was to work
for the Town of Marana and its citizens feeling privileged to have created such lasting
friendships with her coworkers and the community. Ms. Bronson is looking forward to
staying in engaged with Marana as a volunteer and considers the people of Marana part
of her extended family. Mayor Honea stated that Ms. Bronson is a passionate advocate
for the Town of Marana and all who have worked with her will miss her presence.
Mayor Honea thanked Ms. Bronson for all her years of service.
P2 Proclaiming September 2018 as National Preparedness Month. Mayor Honea
read the title into the record.
P3 Proclaiming September 17 through September 23, 2018 as Constitution week.
Read by Deputy Town cleric Hilary Hiser. Debra Kielley of the Old Pueblo Chapter of
the National Society of the Daughters of the American Devolution briefly addressed the
Council. Ms. Kielley stressed the importance of studying the United States Constitution
as a way for citizens to understand our government structure and to appreciate the
freedoms this founding document bestows on all citizens.
P4 Proclaiming September 24-30, 2018 Diaper Need. Awareness week. Mayor
Honea read the title into the record.
MAYOR AND COUNCIL REPORTS: SUMMARY OF CURRENT EVENTS:
Council Member officer stated he is grateful for the opportunity to continue to serve
the Town of Marana as a council member. He thanked his mother and wife for their
continued support in his community service endeavors. Council Member Officer also
thanked retiring Town clerk Jocelyn Bronson for her continued encouragement to
become more involved in the community and mentorship through the years.
Council Member Ziegler also thanked Town clerk Jocelyn Bronson for all of her hard
work through the years and working with the Council. She also congratulated Council
Member officer on his election win at the August 28 Primary. council Member Ziegler
expressed disappointment in the Pima County Board of Supervisors' vote against

accepting the Stonegarden Grant. Since Pima County is a funnel -through agency for the
grant, she stated this no vote would negatively impact the Marana Police Department's
operations. Council Member Ziegler asked residents to contact Supervisor Sharon
Bronson and express their displeasure.
Council Member Kai also expressed his appreciation of Town clerk Jocelyn Bronson "s
many years of service and wished her a happy retirement.
Council Member Bowen offered his congratulations to all the council members that
won reelection. He congratulated challenger Jack Neubeck on a well-run campaign.
Council Member Bowen also thanked Town Clerk Jocelyn. Bronson for all her
assistance through the years.
Council Member Comerford thanked everyone who supported her campaign and the
continued support of the citizens of Marana. She vowed to keep listening to the needs
of residents and working to address the issues that come up in the community. She
encouraged citizens to reach out to her if they have any questions or concerns regarding
the town.
Vice Mayor Post also expressed his gratitude to the citizens of Marana and stated he
was heartened by the election results making him feel good about the work he and the
Council have done over the years. He stated that the results have helped point him in a
direction of where the people want the town to go in the future. Vice Mayor Post also
thanked Town Clerk Jocelyn Bronson for her service to the Town.
Council Member Comerford stated she would be remiss if she did not acknowledge
the hard work of the Marana Police Department as the Town of Marana was named the
sixth safest town in the State of Arizona. She also thanked Town clerk Jocelyn. Bronson
for all her hard work for the Town of Marana.
Mayor Honea congratulated all the council members on their re --election. He reported
the successful grand opening of the new Tangerine Sky Park. Mayor Honea also stated
that he and Council Members Officer and Comerford attended the League of Cities and
Town the previous week. He was really impressed with the event and very happy to
participate on the committees. Mayor Honea indicated he had a productive
conversation with Congresswoman Martha McSally regarding the water quality issues
in Marana even identifying some possible avenues for financial reimbursement from
the federal government for treating the water containments.
MANAGER'S REPORT: SUMMARY of CURRENT EVENTS:
Deputy Town Manager Erik Montague reported that Governor Ducey appointed
former Senator Jon Kyle to fill the seat vacated by Senator McCain's death. Senator Kyle
indicated he is not intending to serve through to the 2020 Special Election.

Mr. Montague also noted that with Pima County's vote against renewal of the
Stonegarden Grant, staff is looking at what financial impact that will have on the Town.
He indicated there might be supplemental funding available from the State of Arizona
as the new grant cycle starts and as additional information becomes available he will
inform the Council.
Mr. Montague directed the Council's attention to the new Executive Report showcasing
a strong month for residential housing permits issued. The total to date is 570 permits
issued during the 2018 calendar year. Mr. Montague also highlighted the social events
occurring during September in Marana which include free music concert in the park on
September 8, a local town hall event regarding criminal justice on September. 14 at the
Highlands Dove Mountain, and the Marana Farre Festival on September 29.
Council Member Ziegler asked for clarification regarding the Stonegarden Grant. Mr.
Montague responded that staff is still reviewing the impact of the vote. After a
preliminary conversation with state representatives, Mr. Montague said there plight be
resources available in the next funding cycle starting in January; however this is only
preliminary information and staff continues to investigate all possibilities for additional
funding sources.

C1 Resolution No. 2018-077: Relating to Development; approving the final block
plat for Silverbell Ridge Estates, Blocks 1 - 3 located at 6975 N. Silverbell Road,
approximately 0.2 miles south of Ina Road on the west side of Silverbell Road (Steven

C2 Relating to Procurement; ratifying the Town Manager's approval of a change

order to the Splash Pad, Crossroads-Silverbell Park (PK025) construction contract with
Kappcon General Contractors in the amount of $7.1,777.00; authorizing the transfer of

L1 Relating to Liquor Licenses; recommendation to the Arizona Department of
Liquor Licenses and Control regarding a special event liquor license application
submitted by Patrick R. Nilz on behalf of Marana Heritage Conservancy for the Town of
Marana Farm. Festival to be held on September 29, 2015. Presented by Hilary Hiser,
Deputy Town Clerk.
Council Member Bowen motioned to approve with a second provided by Vice Mayor
Post. Motion passed unanimously 7-0.
L2 Relating to Liquor Licenses; recommendation to the Arizona Department of
Liquor Licenses and Control regarding a Person Transfer of a Series #6 Bar liquor
license application submitted by Jennifer Lynn Fletcher on behalf of Tumbleweed Bar
located at 13915 N. Sandario Road, Marana, Arizona 55653. Presented by Hilary Hiser,
Deputy Town Clerk.
Council Member Kai motioned to approved with a second provided by Council Member
Bowen. Motion passed unanimously 7-0.
BOARDS, COMMISSIONS AND COMMITTEES
COUNCIL ACTION:
**C4 Resolution No. 2018-078: Relating to Development; approving a preliminary plat for
Lazy .K Bar Ranch, Lots 1 through 178, Common Areas 11A f', 1' .B 11, and C" Located at the zvest
terminus of Pima Farms .load zvest of the Scenic Drive alignment. Presented by Brian.
Varney, Senior Planner. Mr. Varney stated the preliminary plat is in substantial
conformance with the specific plan and development agreement adopted by the
Council. The Planning Commission approved the preliminary plat at its July 25, 2015
meeting with the condition that the public trail alignment increases. The preliminary
plat before the Council reflects that new trail alignment with the support of
stakeholders in the area. Mr. Varney noted that the development has increased open
space and has tighter alignment of houses with increased lot sizes overall. The
developer has also found creative ways to preserve and incorporate the historic
buildings into active areas for residents.
Mayor Honea thanked Mr. Varney for his presentation and indicated there were two
public comment cards regarding this item..
Pima County resident David Lutz addressed the Council expressing his displeasure
with the proposed development indicating it will have a negative impact on his
property and result in an overall increase in his property taxes. He asked the Council
not to approve the development.
Pat Lopez addressed the Council thanking them for taking the time to consider the
Lazy Bar Ranch development. He stated that the work done by Mr. Varney to help

shepherd this development from start to finish shows a commitment on the Town's part
to ensure all stakeholder views were adequately represented. I ie stated that as
presented to the Council, this development reflects the conditions residents have agreed
too.
Council Member Ziegler acknowledged that the road to approval for Lazy K Bar
Ranch has been hard fought over the course of two years. She asked Mr. Varney if the
development would have two distinct ingress/ egress for the development. Mr. Varney
responded that this development does have two accesses points for residential traffic at
each end of the development.
Council Member Ziegler motioned to approve, with a second provided by Vice Mayor
.Post. Mayor Honea asked for a poll vote of the council members,
Council Member Bowen voted yea;
Council Member Comerford voted nay --stating the proposed density for the area is too high;
Council .Member I<ai voted to abstain —citing a conflict of interest;
Council Member Officer voted yea;
Council Member Ziegler voted yea;
Vice Mayor Post voted yea;
Mayor Honea voted yea.
Motion passed with 5 yea votes to 1 nay vote, and 1 abstention.
Al PUBLIC HEARING: Resolution No. 20.8-084: Relating to Development;
adopting a minor amendment to the Transportation Element of the Marana General
Plan by revising the road network exhibit to relocate westward the portion of the Lon
Adams Road alignment located north of Clark Farms Road, to align with the existing
location of Lon Adams Road on the western boundary of ora Mae Harn Park.
Presented Cynthia Ross, Planner II. Ms. Ross informed the Council that the conditions
in the area have changed since the adoption of the 2010 General Plan. The proposed
road alignment no longer meets the expected traffic needs in the area since ora Mae
Harn park has expanded and MUSD has changed their plans to relocate the bus barn.
The proposed modification will allow for better traffic flow given the current conditions
in the area. There were no public comments made during the public hearing portion.
Council Member Bowen motioned to approve, with a second provided by Vice Mayor
Post. Motion passed unanimously 7--0.
A2 Resolution No. 2018-085: Relating to Elections; declaring and adopting the
results of the Town of Marana primary election held on August 28, 2018. Presented by
Hilary Hise:r, Deputy Town Clerk, Ms. Hiser stated Pima County provided the official
Canvass of the Vote and four candidates received highest majority votes cast in the
primary. The winners of the four open council seats are Patti Comerford, Herb Kai, john
Officer, and Jon Post.

Mayor Honea motioned to approve with a second provided by Council Member .Bowen.
.Motion passed unanimously 7-0.
ITEMS FOR DISCUSSION/ POSSIBLE ACTION:
D1 Relating to Legislation and Government Actions; discussion and possible action
regarding all pending state, federal, and local legislation/ government actions and on
recent and upcoming meetings of the other governmental bodies. Report provided during
Manager's Briefing by Deputy Tozvn Manager Erik Montague.
EXECUTIVE SESSIONS: Vice .Mayor Post motioned, with a second provided by
Council Member Comerford to transition to executive session. Motion passed
unanimously 7--0. The Council left the dais at 8:28 p.m.
Pursuant to A.I.S. § 38-43..03, the Town. Council may vote to go into executive session,
which will not be open to the public, to discuss certain matters.
E1 Executive Session pursuant to A.R.S. X38-431.03 (A)(3), Council may ask for
discussion or consultation for legal advice with the Town Attorney concerning any
matter listed on this agenda.
E2 Executive session pursuant to A.R.S. § 38-431.03(A)(3) and (4), discussion or
consultation for legal advice with the Towri s attorneys and to consider the Town's
position and instruct its attorneys regarding (1) contemplated litigation to recover costs
to remedy water quality issues resulting from perfluorinated compounds
contamination and (2) a joint prosecution and confidentiality agreement related to the
contemplated litigation.
The Council returned to the dais at 8:49 p.m. Town Attorney Frank Cassidy requested
Council make a motion to authorize the Town Manager to sign, on behalf of the Town
of Marana, a joint prosecution and confidentiality agreement regarding remediation of
perfluorinated compounds and to pursue actions as discussed during executive session.
Council Member Bowen motioned, with a second by Nice Mayor Post. Motion passed
unanimously 7-0.
FUTURE AGENDA ITEMS:
Notwithstanding the mayor's discretion regarding the items to be placed on the agenda,
if three or more Council members request that an item be placed on the agenda, it must
be placed on the agenda for the second regular Town Council meeting after the date of
the request, pursuant to Marana Town Code Section 2--4-2(P).
Council Member Ziegler asked staff to provide the Council an update regarding traffic
alignments and proposed road improvements for the San Lucas neighborhood..

ADJOURNMENT: Council Member Bowen motioned to adjourn. at 8:52 p.m., ivith a
second provided by Council Member Kai. Motion passed unanimously 7-0.
