MARANA ORDINANCE NO. 2018.017
RELATING TO DEVELOPMENT; APPROVING A MODIFICATION OF A REZONING
CONDITION OF MARANA AMENDED ORDINANCE NO. 2002.18 TO ALLOW AN
INCREASE IN THE MAXIMUM SITE DISTURBANCE FROM 30% TO 40% ON
APPROXIMATELY 6.5 ACRES OF LAND GENERALLY LOCATED EAST OF
CAMINO DE MANANA AND SOUTH OF THE DESERT FALCON LANE
ALIGNMENT
WHEREAS the Mayor and Council of the Town of Marana. adopted Marana
Amended Ordinance No. 2002.18 on January 21, 2003' approving a rezoning of
approximately 431 acres of land from Zone F (Hartman Hills Specific Plan) to Zone R-36
(Residential); and
WHEREAS approval of the rezoning was subject to a number of conditions
including Condition No. 3, restricting total site disturbance to a. maximum of 30%,
exclusive of major roads dedication, and requiring that building envelopes reflective of
the 30% disturbance be established through the platting process; and
WHEREAS Town staff received an application by an owner of approximately 6.5
acres of land located within the rezoned area requesting a modification of Condition
No. 3 to increase the allowed site disturbance from 30% to 40%, only as it applies to his
property, in order to allow building envelopes to accommodate larger homes; and
WHEREAS the land subject to this request is located east of Camino de Mariana
and south of the Desert Falcon Lane alignment in the northwest quarter of Section 12,
Township 12 South, and Range 12 East, more particularly described in Exhibit 'A' and
depicted in Exhibit 'B' attached to and incorporated in this ordinance by this reference;
and
WHEREAS the Marana Planning Commission held a public hearing on
August 22, 2018 and voted unanimously to recommend that the Town Council approve
the requested modification; and
WHEREAS the Mayor and Council of the Town of Marana find that the
modification adopted by this ordinance is in the best interest of the Town of. Marana
and the general public.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town
of Marana, Arizona, as follows:
