OF PAGES: 6 SEQUENC~: 19990330113 02/19/1999 ORDIN 10: 15 M~IL AMOUNT PAID $ 8.50 MARANA ORDINANCE NO. 99.05 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE TOWN OF MARANA, ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, ARIZONA REVISED STATUTES, AND AMENDMENTS THERETO, BY ANNEXING THERETO THAT TERRITORY KNOWN AS SECTION 19, WHICH IS CONTIGUOUS TO THE EXISTING TOWN LIMITS OF THE TOWN OF MARANA, ARIZONA, AND CHANGING THE ZONING FROM "PIMA COUNTY ZONE RH" TO "TOWN OF MARANA ZONE R-144." WHEREAS, apetition in writing, accompanied by a map or plot of said real property, having been filed and presented to the Mayor and Council of the Town of Marana, Arizona, signed by the owners of more than one-half in value of the real and personal property and more than one-half of the persons owning real and personal property that would be subject to taxation by the Town of Marana as shown by the last assessment of said property, said property is contiguous to the Town of Marana, and not now embraced within its limits, asking that the property more particularly hereinafter described be annexed to the Town of Marana, and to extend and increase the corporate limits of the Town of Marana so as to embrace same; and WHEREAS, the Mayor and Council of the Town of Marana, .Arizona, are desirous of complying with said petition and extending and increasing the corporate limits of the Town of Marana to include said territory, wMch is approximately 40 acres; and WHEREAS, the Section 19 annexation is a triangular area located in the northeast quarter of Section 19, Township 12 South, Range 12 East, Gila and Salt River Meridian, Pima County, Arizona; and WHEREAS, the petition sets forth argue and correct description of all the exterior boundaries of the entire area proposed to be annexed to the Town of Marana and had attached thereto at all times an accurate map of the territory desired to be annexed; and WHEREAS, no alterations increasing or reducing the territory sought to be annexed have been made after the petition had been signed by any owner of real and personal property in such territory; and WHEREAS, A.R.S. § 9-471(L) requires the Town to adopt a transitional zoning classification, which permits densities no greater than those permitted by the county before annexation; and WHEREAS, the zoning classification on the property prior to annexation was "Pima County one RH (Rural Homestead) and the mo~t comparable town zoning classfficat~on, which does not 1 0 9 8 O 9 4 Marana, Arizona Ordlmnv~, NO. 99-05 Page 1 of 2 permit greater densities and uses, is "Town of Marana Zone R- 144" (Residential 144 Acre Minimum Lot Size); and WHEREAS, the provisions of A.R.S. § 9-471, and amendments thereto, have been fully observed; and WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on file in the office of the town clerk of the Town of Marana, together with a true and correct copy of the original petition referred to herein, which is on file in the office of the county recorder. NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, that: The territo~ known as the Section 19 annexation is annexed into the Town of Marana and that the present corporate limits are extended and increased to include the described area. A copy of this Ordinance, together with an accurate map of the territory hereby annexed to the Town of Marana, certified by the Mayor of said Town, be forthwith filed and recorded in the office of the County Recorder of Pima County, Arizona. The zoning classification of"Pima County Zone RH" (Rural Homestead) is hereby changed to the most comparable town zoning classification, which is "Town of Marana Zone R-144" (Residential 144 Acre Minimum Lot Size). PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, t/tis 16th day of February, 1999.
