A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, APPROVING THE PRELIMINARY PLAT FOR PRV-03110, PIMA FARMS
VILLAGE, SUBMITTED BY DIAMOND VENTURES, INC. FOR A SINGLE-FAMILY
SUBDIVISION OF 295 LOTS AND COMMON AREAS "A" THROUGH "O", ON
APPROXIMATELY 156 ACRES LOCATED WITHIN THE PIMA FARMS SPEC~IC PLAN,
LOCATED AT THE NORTHEAST CORNER OF PIMA FARMS ROAD AND NORTH
SCENIC DRIVE, IN A PORTION OF SECTION 29, TOWNSI-I~ 12 SOUTH, RANGE 12
EAST.
WHEREAS, this Preliminary Plat was heard by the Maruna Planning and Zoning
Commission November 19, 2003, and was forwarded with a recommendation of approval on a
vote of 5 - 1, Chairman Parker dissenting, with recommended conditions; and
WHEREAS, Diamond Ventures, Inc. is the owner of approximately 156 acres within the
Pima Fan'ns Specific Plan, generally located in a portion of Section 29, Township 12 South,
Range 12 East, and has applied for approval of a Preliminary Plat for a 295-1ot subdivision on
approximately 156 acres; and
WHEREAS, the Marana Town Council has heard from the representative(s) of the
owners and staff, at the regular Town Council meeting, December 16, 2003 and has determined
that the Preliminary Plat for Pima Farms Village should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona that the Preliminary Plat, submitted by Diamond Ventttr~s, Inc. for a 295-1ot
subdivision plat on approximately 156 acres located west of Silverbell Road, between Twin
Peaks Road and Coachline Boulevard be approved with the following conditions:
The full trails system will be shown on the final plat prior to approval by Town
Council.
Provide a recorded agreement from a third party entity as accepted by the Town to
manage the Conservation Easement prior to approval of final plat by Town
Council.
If entries are to be gated, they must be shown on the final plat, and must be
approve by the Town, and Northwest Fire District.
No approval, permit, or authorization of the Town of Marana authorizes the
applicant and/or landowner to violate any applicable federal or state laws or
regulations, or relieves the applicant and/or landowner fi'om responsibility to
Marana Resolution No. 2003-161
ensure compliance with all applicable federal and state laws and regulations,
including the Endangered Species Act and the Clean Water Act. You are advised
to retain appropriate expert and/or consult with appropriate federal and state
agencies to determine any actions necessary to assure compliance with applicable
laws and regulations.
All purchasers of lots adjacent to the E1 Paso Natural Gas easement shall be
notified of that proximity.
Lots in the Development Sensitive Overlay zone are subject to the Pima Farms
Specific Plan, Development Regulations (D), "Heavy equipment or storage will
not be permitted within the sensitive overlay are. No satellite discs shall be
permitted on roofs. No dirt bikes or ATV vetficles shall be allowed within the
sensitive overlay area." Notice of these additional conditions should be included
within the CC&R's for the project.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
