MARANA RESOLUTION NO. 2000-04.
A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA,
ARIZONA, ABANDONING THE NORTH 45.00 FOOT MASSINGALE ROAD RIGHT-OF-WAY.
WHEREAS, an application for abandonment of the Town's north 45 foot Massingale Road
right-of-way, recorded in a deed to Pima County in Docket 5408 at Page 389, has been submitted
to the Town by the Shetland Properties Co., L.L.C. and Merapi Properties Co., L.L.C.; and
WHEREAS, the Mayor and Council have the authority pursuant to A.R.S. § 28-7205, to
resolve that the roadway or a portion of the roadway be vacated; and
WHEREAS, it has been determined by the Mayor and Council that the north 45 foot of
Massingale Road right-of-way as recorded in Docket 5408, Page 389 is no longer necessary to the
Town, and notice of the intended abandonment has been posted on the property and published in
the appropriate manner; and
WHEREAS, thc Mayor and Council have determined that the land has no monetary value
due to its location and degree of fi'agmentation.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that the Town of Marana abandon the north 45 foot Massingale Road right-of-way
as deeded to Pima County and recorded in Docket 5408 at Page 389, as more fully depicted in the
map attached hereto as Exhibit 1 and legally described in Exhibit A and incorporated herein by this
reference, which is no longer necessary to the Town, subject to the following conditions:
The following are resolved in accordance with A.R.S. § 28-7210:
a) existing sewer, gas, water or similar pipelines and appurtenances;
b) canals, laterals or ditches, and appurtenances; and
c) electric, telephone and similar lines and appurtenances.
The abandonment will not prevent any property owners l~om legally accessing their property.
At the time of development of a linear park by Pima County, in compliance with the Eastern
Pima County Trail System Master Plan and Pima County River Parks Master Plan, a 50'
portion of the Massingate Road right-of-way along the eastern bank of the Santa Cruz River
shall be dedicated to Pima County by Shetland Properties and Mercapi Properties for said
linear park.
