OF PAGES: 4 SEQUENCE: 20040640212 04/02/2004 RES 13:03 PICKUP AMOUNT PAID $ 7.00 MARANA RESOLUTZON NO. 99-85 FOR RELEASE OF ASSURANCES & SUBSTITUTE ASSURANCES AND ACCEP1/NG FOR MAZNTENANCE THE PUBLIC IMPROVEMENTS FOR CONTINENTAL RANCH SUNFLOWER PHASE I & PHASE II MARANA RESOLUTION NO. 99-85 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE SUBSTITUTE ASSURANCE AGREEMENT BETWEEN DEL WEBB HOME CONSTRUCTION, INC., AN ARIZONA CORPORATION, AND FIRST AM]~RICAN TITLE INSURANCE COMPANY, A CALIFORNIA CORPORATION, FOR CONTINENTAL RANCH SUNFLOWER PHASE I (CONTINENTAL RANCH ACTIVE ADULT COMMUNITY) LOTS 1 THROUGH 141 AND COMMON AREAS A THROUGH K; AND AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN DEL WEBB HOME CONSTRUCTION, INC., AN ARIZONA CORPORATION, AND FIRST AMERICAN TITLE INSURANCE COMPANY, A CALIFORNIA CORPORATION, FOR CONTINENTAL RANCH SUNFLOWER PHASE II LOTS 142-275 AND COMMON AREAS L THROUGH W AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS. WHEREAS, Continental Ranch Sunflower Phase I (Continental Ranch Active Adult Community) is a 35.86 acre subdivision located north of Linda Vista Boulevard and west of Coachline Boulevard containing Lots 1 through 141 and Common Areas A through K and is recorded at the Pima County Recorder's Office in Book 49 of Maps and Plats, Page 89; and WHEREAS, Continental Ranch Sunflower Phase II (32.99 acres) is a subdivision located south of Linda Vista Boulevard and west of Coachline Boulevard containing Lots 142 through 275 and Common Areas L through W and is recorded at the Pima County Recorder's Office in Book 51 of Maps and Plats, Page 1; and WHEREAS, the Town has previously entered into a Substitute Assurance Agreement with Del Webb Home Construction, Inc., an Arizona corporation, (beneficiary) under Trust No. 4742 and First American Title Insurance Company, a California corporation, (trustee), recorded at the Pima County Recorder's Office as Docket 10899, Page 266, assuring the completion of public improvements for Continental Ranch Sunflower Phase I; and WHEREAS, the Town has previously entered into an Assurance Agreement with Del Webb Home Construction, Inc., an Arizona corporation, (beneficiary) under Trust No. 4742 and First American Title Insurance Company, a California corporation, (trustee), recorded at the Pima County Recorder's Office as Docket 10785, Page 1235 assuring the completion of public improvements for Continental Ranch Sunflower Phase II; and WHEREAS, Del Webb Home Construction, Inc. has completed the public improvements to the Town standards under the Substitute Assurance Agreement for Continental Ranch Active Adult Community (Sunflower Phase I) and now requests that Lots 1 through 141 and Common Areas A through K be released fi.om said Substitute Assurance Agreement; and Page 1 of 3 Marana, Arizona Resolution No. 99-85 WHEREAS, Del Webb Home Construction, Inc. has completed the public improvements to the Town standards under the Assurance Agreement for Continental Ranch Sunflower Phase II and now requests that Lots 142 through 275 and Common Areas L through W be released from said Assurance Agreement. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona authorizing the release of the Substitute Assurance Agreement between Del Webb Home Construction, Inc., under Trust No. 4742, and First American Title Insurance Company for Lots 1 through 141 and Common Areas A through K; and authorizing the release of the Assurance Agreement between Del Webb Home Construction, Inc., under Trust No. 4742, and First American Title Insurance Company for Lots 142 through 275 and Common Areas L through W and accepting for maintenance the public improvements in Continental Ranch Sunflower Phase I (Continental Ranch Active Adult Community) and Continental Ranch Sunflower Phase II as follows: The Town accepts for maintenance 1.49 miles of the following paved streets within Continental Ranch Sunflower Phase I (Continental Ranch Active Adult Community): Amber Ridge Way Candle Creek Road Cathedral Canyon Drive Desert Mist Lane Gold Brook Drive Myriad Pass Silverhaven Drive Starry Night Lane Sunflower Park Drive The Town accepts for maintenance 39 survey monuments, public Drainage Way # 2 (2.81 acres), and miscellaneous items such as regulatory traffic control signs and street signs within Continental Ranch Sunflower Phase I (Continental Ranch Active Adult Community). The Town accepts for maintenance 0.97 miles of the following paved streets within Continental Ranch Sunflower Phase II: Sunflower Park Way Summer Scene Drive Mission Canyon Place Arch Canyon Place Copper Crest Place Alamosa Place Page 2 of 3 Marana, Arizona Resolution No. 99-85 · Wonderock Place · Sandy Mesa Place · River Edge Place The Town accepts for maintenance 34 survey monuments, public Drainage Way # 2 (5.30 acres), and miscellaneous items such as regulatory traffic control signs and street signs within Continental Ranch Sunflower Phase II. The Developer shall comply with all Linear Park financial contribution requirements to the full satisfaction of the Town.
