HomeMy WebLinkAboutResolution 2019-121 Approving Release of Assurances for Gladden Farms Blk 40 & 41 Lots 1-119MARANA RESOLUTION NO. 2019-121 RELATING TO DEVELOPMENT; APPROVING A RELEASE OF ASSURANCES FOR GLADDEN FARMS BLOCKS 40 & 41 LOTS 1 THROUGH 119 AND ACCEPTING PUBLIC IMPROVEMENTS FOR MAINTENANCE WHEREAS the final plat for 'Gladden Farms Blocks 40 & 41 Lots 1-119, Common Areas "A-l"—"A-11", "B -1"—"B -Y' ("Gladden Farms 40 & 41") was recorded in the Pima County Recorder's office on 22 February 2019 at Sequence 20190530029;and WHEREAS the Town has a third party trust assurance agreement (the "Assurance Agreement") with Meritage Homes of Arizona, Inc. (the "Subdivider") and Title Security Agency of Arizona, LLC, under Trust No. 201820-T, recorded in the Pima County Recorder's office on 22 February 2019 at Sequence 20190530032, assuring the completion of public improvements for Gladden Farms 40 & 41; and WHEREAS the Subdivider has completed the public improvements for Gladden Farms 40 & 41 acceptable to Town standards in accordance with the Assurance Agreement. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. The Assurance Agreement is hereby released. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, approximately 0.83 miles of the following paved streets as shown on the plat of Gladden Farms 40 & 41: • Browns Drive • Chestnut Street • Filbert Street • Geary Avenue • Grassland Avenue • Hayward Drive • O'Farrell Avenue • Sutter Drive Section 3. The Town accepts for maintenance the potable water system serving Gladden Farms 40 & 41, consisting of approximately 4,146 linear feet of potable water 00066895.DOCX /2 Marana Resolution No. 2019-121 - 1 - 12/6/2019 3:17 PM line, water meters, valves, fire hydrants and appurtenances with an estimated value of $376,064. Section 4. The Town accepts for maintenance the sanitary sewer system serving Gladden Farms 40 & 41, consisting of approximately 4,018 linear feet of conveyance system and appurtenances with an estimated value of $396,722.
