Civic Center Drive, Marana, Arizona 85653 Council Chambers December 17, 2019, at or after 7:00 PM Ed Honea, Mayor Jon Post, Vice Mayor David Bowen, Council Member Patti Comerford, Council Member Herb Kai, Council Member John Officer, Council Member Roxanne Ziegler, Council Member SUMMARY MINUTES CALL TO ORDER AND ROLL CALL Mayor Honea called the meeting to order at 7:00 PM and directed the Clerk to call the roll. Vice Mayor Jon Post; Council Members Dave Bowen, Patti Comerford, Herb Kai, Roxanne Ziegler and John Officer were present. There was a quorum of council members present constituting a quorum. PLEDGE OF ALLEGIANCE/INVOCATION/MOMENT OF SILENCE: Led by Mayor Honea. APPROVAL OF AGENDA Council Member Bowen moved and Council Member Kai second the motion to approve the agenda. Motion passes, 7-0. CALL TO THE PUBLIC December 17, 2019 AMENDED Regular Council Meeting Summary Minutes 1 David Lutz provided comments on the Make Marana General Plan 2040 and thanked Mayor Honea and Council for saving the Tortolita Mountain Preserve, and its decision on December 10. David Morales presented the Kai Family Foundation with an award plaque from the Chapter 4 DAV volunteer organization. The plaque reads as follows: Kai Family Foundation in Recognition of Appreciation to Chapter 4 DAV. PROCLAMATIONS P1 Proclamation honoring the dedicated service of Daniel Sample, retiring Marana Motor Officer, for his 31 years of service to the Marana Community (Cherry L. Lawson) Town Clerk Cherry Lawson read the proclamation into the record as follows below: PROCLAMATION Honoring Daniel Sample Marana Motor Officer WHEREAS, Daniel (Dan) Sample graduated from the Pima County Reserve Officer Academy in June 1988, hired as a Reserve Officer in October 1987 until November 1988, and later hired as a full-time Officer; and WHEREAS, during his career, Dan Sample served in various roles within the Marana Police Department including: a Detective in MANTIS, the HITDA Drug Task Force; a Detective in the AZ GITEM, the DPS Gang Task Force; a Motor Officer, Motor Instructor, Field Training Officer, and was instrumental in the development of the Pima County Regional Motor Academy; and WHEREAS, in 2003, Dan served in the Marana Police Department's only mounted horse unit, graduating in October 2003 from the Basic Mounted Police School in Scottsdale, AZ; and WHEREAS, Dan was instrumental in the department's involvement in the Special Olympics Law Enforcement Torch Run helping to plan the Annual Team Roping events that raised thousands of dollars; and WHEREAS, Officer Dan Sample retires as a Marana Motor Officer on December 20, 2019, and will continue spending time enjoying his children: Cameron, Conner, and Kyra as well as his friends. He will continue riding and taking care of his horses and spending time at his property in the White Mountains. NOW, THEREFORE BE IT RESOLVED, the Mayor and Council of the Town of Marana commend and thank "Officer Daniel Sample" for his 31 years of service to the Marana community and encourage citizens to join them in congratulating him on his retirement. Motion passes, 7-0. LIQUOR LICENSES BOARDS, COMMISSIONS AND COMMITTEES COUNCIL ACTION Al PUBLIC HEARING: Ordinance No. 2019.024: Relating to Development; amending Marana Town Code Title 17 (Land Development) by revising Section 17-6-14 (medical marijuana dispensary) to extend the permissible hours of operation for medical marijuana dispensaries from the current hours of 7:00 a.m. to 7:00 p.m. to 7:00 a.m. to 10:00 p.m. (Cynthia Ross) [7:21 PM Minutes:] Mayor Honea open the public hearing. Senior Planner Cynthia Ross provided an overview of this item stating Golden Leaf Wellness located at 5390 has submitted an application to amend the Marana December 17, 2019 AMENDED Regular Council Meeting Summary Minutes 3 Development Code relating to permissible hours of operation. The applicant is requesting the hours of operation for the two dispensaries be extended to 10 p.m. Golden Leaf Wellness cites extending the hours would allow them to compete with neighboring community dispensaries that are opened until 10 p.m. The Planning Commission at the November 20, 2019 voted to recommend adoption of the amendment to the Town Code extending the hours of medical marijuana dispensaries to 10 p.m. She indicated that she does not have a recommendation for this item. She deferred to Council for its motion on the item. [7:22 PM Minutes:] Mayor Honea closed the public hearing as there were no comments offered. [7:22 PM Minutes:] Mayor Honea reopened the public hearing to allow Council Member Comerford an opportunity to ask a question. Council Member Comerford asked whether town staff sought approval by the police department. Ms. Ross replied that the town had consulted with the police department prior to bringing this item forward. [7:22 PM Minutes:] Mayor Honea closed the public hearing. Council Member Ziegler motion and Vice Mayor Post second the motion approving Ordinance No. 2019.024. Motion passes, 6-1 (Comerford - Nay) A2 Resolution No. 2019-124: Relating to Parks and Recreation; approving and authorizing the Mayor to sign an intergovernmental agreement between the Pima County Flood Control District and the Town of Marana for the El Rio Preserve Bank Protection Project (Frank Cassidy) Council Member Bowen moved and Vice Mayor Post second the motion approving Resolution No. 2019-124. Motion passes, 7-0. A3 Resolution No. 2019-126: Relating to the Marana Regional Airport; approving and authorizing the Mayor to execute a Lease Agreement with The Boeing Company for the lease of real property located at the Marana Regional Airport, 11700 West Avra Valley Road (Jane Fairall) Council Member Kai moved and Council Member Ziegler second the motion approving Resolution No. 2019-126. Motion passes, 7-0. ITEMS FOR DISCUSSION/ POSSIBLE ACTION D1 Resolution No. 2019-125: Relating to Intergovernmental Relations; adopting a 2020 Town of Marana Legislative Program and authorizing and directing those December 17, 2019 AMENDED Regular Council Meeting Summary Minutes 4 authorized to lobby on behalf of the Town of Marana to represent and pursue it (Heath Vescovi-Chiordi) Council Member Bowen moved and Council Member Ziegler second the motion approving Resolution No. 2019-125. Motion passes, 7-0. � • �/�iT.liSiii'liri D3 Relating to Legislation and Government Actions; discussion and possible action regarding all pending state, federal, and local legislation/ government actions and on recent and upcoming meetings of the other governmental bodies (Jamsheed Mehta) Mr. Mehta did not have a report at this time. EXECUTIVE SESSIONS E1 Executive Session pursuant to A.R.S. X38-431.03 (A), Council may ask for discussion or consideration, or consultation with designated Town representatives, or consultation for legal advice with the Town Attorney, concerning any matter listed on this agenda for any of the reasons listed in A.R.S. §38-431.03 (A). E2 Executive Session pursuant to A.R.S. § 38-431.03(A)(1) for discussion of Town Council and Town Manager relationship. Council Member Bowen moved and Vice Mayor Post second the motion to enter into an Executive Session Meeting for the purpose stated in Item E2. Motion passes, 7-0. [11:12 PM Minutes:] Mayor Honea resumed the Regular Council Session Meeting. FUTURE AGENDA ITEMS Notwithstanding the mayor's discretion regarding the items to be placed on the agenda, if three or more Council members request that an item be placed on the agenda, it must be placed on the agenda for the second regular Town Council meeting after the date of the request, pursuant to Marana Town Code Section 2-4-2(B). ADJOURNMENT Mayor Honea asked for a motion to adjourn the meeting.
