HomeMy WebLinkAboutResolution 2020-100 Approving a Final Plat for Twin Peaks and Lambert Lane, Lots 1-62 and Common Areas "A-C" MARANA RESOLUTION NO. 2020-100 RELATING TO DEVELOPMENT; APPROVING A FINAL PLAT FOR TWIN PEAKS AND LAMBERT LANE, LOTS 1-62 AND COMMON AREAS "A" (PRIVATE STREETS), "B" (NATURAL OPEN SPACE, DRAINAGE, LANDSCAPE, PEDESTRIAN, PUBLIC AND PRIVATE SEWER AND UTILITIES), AND "C" ( ACTIVE OPEN SPACE) LOCATED EAST OF TWIN PEAKS ROAD, WEST OF BLUE BONNET ROAD, AND NORTH OF LAMBERT LANE WHEREAS, on April 4, 2017, the Town Council adopted Ordinance No. 2017.008 approving a rezoning of 34 acres of land from R-144 (single-family residential) to R-6 (single-family residential); and WHEREAS, on March 17, 2020, the Town Council adopted Ordinance No. 2020.005 approving an amendment to Ordinance No. 2017.008 consisting of a revision to the conceptual development plan and an increase in the maximum number of lots from 59 lots to 62 lots; and WHEREAS, on July 21, 2020, the Town Council adopted Resolution No. 2020-072 approving the Preliminary Plat for Twin Peaks and Lambert Lane, Lots 1-62 and Common Areas "A" through "C"; and WHEREAS the WLB Group, Inc., representing Meritage Homes and the property owner, has applied for approval of a final plat for Twin Peaks and Lambert Lane, Lots 1-62 and Common Areas "A" (Private Streets), "B" (Natural Open Space, Drainage, Landscape, Pedestrian, Public and Private Sewer and Utilities), and "C" (Active Open Space) (the "Twin Peaks and Lambert Lane Final Plat") located east of Twin Peaks Road, west of Blue Bonnet Road, and north of Lambert Lane; and WHEREAS the Twin Peaks and Lambert Lane Final Plat abandons a 60-foot ingress, egress, and utility easement (the "Easement"), which was created by the Deed of Abandonment recorded in the Pima County Recorder's office on February 19, 2010, at Docket 13749 Page 492 (Sequence 20100330239); and WHEREAS the Easement reserved the right of ingress and egress over a portion of the property included in the Twin Peaks and Lambert Lane Final Plat if and to the extent any land adjoining the abandoned roadway was left without a public or private legal access connecting the land with an established public roadway; and WHEREAS the access reserved in the Easement is now being replaced by alternate access provided in the Twin Peaks and Lambert Lane Final Plat; and 00072178.DOCX/1 Marana Resolution No.2020-100 - 1 - 9/3/2020 11:25 AM WHEREAS Trico Electric Cooperative, Inc. ("Trico") owns facilities located in the Easement that are now accommodated in another easement shown on the Twin Peaks and Lambert Lane Final Plat, as agreed to by Trico and the property owner; and WHEREAS the Mayor and Town Council, at its September 15, 2020 meeting, determined that the Twin Peaks and Lambert Lane Final Plat, including the abandonment of the Easement, should be approved. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA that the Twin Peaks and Lambert Lane Final Plat is hereby approved.
