HomeMy WebLinkAboutResolution 2020-124 Floodplain Management; Granting a variance to Marana Town Code Chapter 17-15 for property 4801 W Flying Diamond MARANA RESOLUTION NO. 2020-124 RELATING TO FLOODPLAIN MANAGEMENT; GRANTING A VARIANCE TO MARANA TOWN CODE CHAPTER 17-15 (FLOODPLAIN AND EROSION HAZARD MANAGEMENT CODE) FOR PROPERTY LOCATED AT 4801 W FLYING DIAMOND WHEREAS the residence located at 4801 W. Flying Diamond was expanded without Town floodplain use permits first being issued; and WHEREAS the owner of the residence has engaged consultants to advise on dry floodproofing the existing residence and addition; and WHEREAS floodproofing is normally reserved for commercial structures pursuant to Marana Town Code section 17-15-10.B.3, therefore a variance would be required from the Floodplain Board to allow floodproofing to be used for a residential structure; and WHEREAS the Town Council,acting as the Floodplain Board,and pursuant to the Marana Town Code Title 17 (Land Development) and Chapter 17 (Floodplain and Erosion Hazard Management Code), is empowered to grant variances, provided all variance actions must be reported in a biennial report to FEMA. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, acting as the Floodplain Board, that the property located at 4801 W. Flying Diamond,Marana,Arizona,is hereby granted a variance from Marana Town Code section 17-15-10.B.3, which would otherwise prohibit floodproofing of a residential structure, subject to the following conditions: 1. Payment of the floodplain variance fee per the Town's comprehensive fee schedule ($1000); 2. Securing a Marana floodplain use permit for the work; 3. Providing an elevation certificate for the work performed; and 4.
