Town Code Title 18 Public Nuisance and Property Preservation
This new code will have a defined purpose and scope unlike
the current sections of the Town Code.
•To promote the health, safety and general welfare of the citizens of the
Town by protecting neighborhoods against public nuisances
•To protect neighborhoods from blight through property preservation

Currently Code Enforcement staff is responsible for
enforcement of many sections of the Town Code. They
also assist with enforcement of some Arizona Revised
Statutes and the International Property Maintenance Code.
Compiling all of these areas into one succinct code will
make it much more user friendly for residents and business
owners and much easier for staff.

What’s New-
•Many new definitions to clarify ambiguity
•Clearly establishing what constitutes a public nuisance
•Maintenance of commercial business parking areas
•Maintaining land free of noxious exhalations/airborne irritations
•Securing property used for illegal dumping
•Maintain commercial property entrances free of debris on adjoining ROW
•Treatment of vacant lots if motor vehicles become an issue
•Prohibit storage of personal property on sidewalks/public streets
•Abatement regarding criminal activity
•Ability to work through violations with a Corrective Action Plan 4
Authority
•A.R.S. §9-499(A):
•“The governing body of a city or town, by ordinance, shall
compel the owner, lessee or occupant of property to remove
from the property and its contiguous sidewalks, streets and alleys
any rubbish, trash, weeds or other accumulation of filth, debris or
dilapidated buildings that constitute a hazard to public health
and safety.”

Next Steps
•Make any needed modifications to the Code
•Identify sections of existing Town Code to be edited
•Bring the new Title 18 back to Council for adoptions with
amendments to existing Town Code Titles 10, 11, 12 & 17
