A RESOLUTION OF THE MAYOR AND COUNCIL OF TIlE TOWN OF MARANA, ARIZONA,
AUTHORIZING THE RELEASE OF THE SURETY PERFORMANCE BOND BETWEEN D. R.
HORTON, INC., SEABOARD SURETY COMPANY AND TOWN OF MARANA, FOR
CONTINENTAL RANCH PARCEL 3 - RESUBDIVISION OF CONTINENTAL RANCH
PARCEL 3 RECORDED AT BOOK46, PAGE 52, AND ACCEPTING FOR MAINTENANCE
THE PUBLIC IMPROVEMENTS.
WHEREAS, Continental Ranch Parcel 3 - Resubdivision of Continental Ranch Parcel 3
recorded at Book 46, Page 52, is a subdivision located north of Silverbell Road and West of Cortaro
Road containing lots 1-164, Common Areas A1 thru AS, and is recorded at the Pima County
Recorder's Office in Book 50 of Maps and Plats, Page 11; and
WHEREAS, the Town has previously accepted Surety Performance Bond No. 366736 with
D. R. Horton, Inc., (Principal), and Seaboard Surety Company (Surety), recorded at the Pima County
Recorder's Office as Docket 10722, Page 809 assuring the completion of public improvements; and
WHEREAS, D. R. Horton, Inc., has completed the public improvements to the Town
standards under the Surety Performance Bond No. 366736 in the amount of $1,344,215.00 for public
improvements in Continental Ranch Parcel 3- Resubdivision of Continental Ranch Parcel 3 recorded
at Book 46, Page 52, and now requests that Lots 1 through 164 and Common Areas A1 thru A8 be
released from said Surety Performance Bond.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona as follows:
Continental Ranch Parcel 3 - Resubdivision of Continental Ranch Parcel 3 recorded
at Book 46, Page 52, containing lots 1-164 are hereby released from the Surety
Performance Bond No. 366736 subject to the following conditions:

Common Areas A1 through A8, private drainage easements, and private
landscape easements will be owned and maintained by the Continental Ranch
Association.
D.R. Horton's contribution of funds to the Continental Ranch Lineal Park
Project.

The Town accepts for maintenance 1.1 miles of the following paved streets within
Continental Ranch Parcel 3 - Resubdivision of Continental Ranch Parcel 3 recorded
at Book 46, Page 52, and their associated appurtenances. The named streets are as
follows:
· Arcata Drive
· Atolia Drive
· Panamint Drive
· Rosamond Way
· Tulare Way
· Wenden Way
· Wildomar Drive
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this
18th day of April, 2000.
