Reuwsaat, Town Manager SUBJECT: Request for letter of support by Management & Training Corporation to submit application to the Arizona Department of Corrections to convert the current Marana Community Correctional Treatment Facility into a 1,000 bed women's minimum security facility. DISCUSSION Warden Lori Lieder from the Marana Community Correctional Treatment Facility has requested a letter of support from the Town for Management & Training Corporation's (MTC) response to the Request for Proposal (RFP) issued by the Arizona Department of Corrections. If successful, the RFP would convert the existing 450 bed facility in Marana into a 1000 bed minimum security women's facility. MTC has also requested a back up proposal to house men instead of women in a minimum security facility. Staff has attached the letter of request and supporting documentation for Council's review and consideration. To implement this change of use and expansion, the request would require additional public input and Council consideration through a Significant Land Use Change. As such, any letter of support would need to state that future staff review and Council review and approval will be necessary. ATTACHMENTS Letter dated December 8, 2006 from Warden Lieder to Mike Reuwsaat with attachments including current and new criteria, administrative exclusions, RFP AD8-012 definition, custody level description, and proposed site plan. RECOMMENDATION That Council direct the Town Manager to draft and send a letter to MTC regarding Council's position on this request, noting that any letter of support be conditional based on necessary and future town staff review and Council review and approval. Civic Center Drive, Bldg A3 Marana, AZ 85653-7006 Dear Mr. Reuwsaat: Per our discussion on December 7,2006, MTC and the Marana Community Correctional Treatment Facility would like to request the Town of Marana to allow MTC to expand the current capacity of the Marana facility from 450 beds to 1,000 beds. The reason for this request stems from an RFP issued by the Arizona Department of Corrections on November 21,2006. The RFP is due on January 18,2007. HB 2868 authorizes the construction and operation of3,000 minimum security beds for 2,000 males and 1,000 females to be housed within the state of Arizona. The RFP requires the females to be housed between Tucson and Phoenix. The beds must be ready for occupancy by April 2008. It is MTC's preference to propose housing a female population at the Marana Facility. This would mean transitioning the existing 450 male offenders to women and constructing buildings to house an additional average of 600 women, plus 50 emergency beds for ADC overflow use. The advantages of the proposal are: 1. MTC will create approximately 100 additional permanent jobs at the facility at an estimated $3.3 million a year. 2. The construction of additional buildings and retrofit of existing facilities will result in a significant number of trade related jobs during the construction phase. 3. The Town of Marana will realize a significant increase in occupancy tax from the increased number of offenders. 4. MTC would be in a position to increase the community work crews for the Town of Marana. 5. MTC would pay more in property taxes to the county. A total of$126,435.66 was paid in 2005. 6. MTC would agree to use the Town of Marana sewer system once it is completed, generating more user revenue for the town. 7. Local vendors provide 20% of vendor services to MCCTF. Currently, approximately $1 million each year goes to local merchants for vehicles, furnishings, office supplies, food, utilities and other items. Local businesses are given top purchasing priority whenever possible. 8. Local contractors provide 90% of subcontracted services to MCCTF. This includes services contracted to the Marana Health Clinic such as physician, mental health, X-Ray, lab and urgent care needs. 9. MTC would provide desperately needed services to approximately 12% of the female population by preparing and facilitating their access to their children and services in the Southern region of Arizona. 10. In 2005, MCCTF work crews provided 62,924 total hours of community service as follows: a. The Town of Marana crews completed 32,320 hours, during which time general landscaping, cleanup, maintenance work, work for Marana Water, and cleaning the park site of the Ironwood National Monument was provided. In 2005, these services cost the Town approximately $16,160 as opposed to hiring workers for at a rate of$8.00 per hour, ($258,560/yr), before benefits, thus generating a substantial savings to the government and taxpayers. b. The crew at the National Guard facility located at the Pinal Air Park provided 18,697 hours. These crews provided maintenance, janitorial and landscaping services. c. The Arizona Correctional Industries crew working at ESB Modular in Marana provided 11,907 hours. These crews learn to build modular buildings, which are then transported to installment sites. This work includes all phases of construction from framing to finish work. It also helps inmates gain skills for transitioning back into society. No Custody Level higher than MINIMUM. No Institutional Risk Score higher than (3). Facility Overrides Prohibited. 2. Offenders shall not have a history of a "serious offense" as defined by ARS Title 13-604 or an assaultive history that would pose a threat to the public should they escape (See attached list). 3. No inmate with Medical and Health Care Needs Scores higher than (M-3). 4. No inmates with Mental Health Care Needs Scores higher than (MH-2), but (MH-3) may be considered on a case by case basis. ARS TITLE 13-604 "Serious Offense" means any of the following offenses if committed in this state or any offense committed outside this state which if committed in this state would constitute one of the following offenses: First Degree Murder Second Degree Murder Manslaughter Aggravated Assault resulting in serious physical injury or involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument. Sexual Assault Any dangerous crime against children Arson of an Occupied Structure Armed Robbery Burglary in the First Degree Kidnapping Sexual conduct with a minor under fifteen years of age RFP AD8-0I2 Definition 2.2.1.5.6 Minimum Security Facility and Population FACILITY - Dormitory living; single bunks; central dining; unescorted movement to meals, education, work and recreation; inmates can work outside the complex doing Community Betterment Projects; single 14 foot fence with razor wire and no climb top. A medium fence adds electronic detection can (optional). POPULATION - Most responsible inmates; no current sex offenses or other felony detainers; serving short sentences; not lifers or inmates sentenced to death; No Security Threat Group members; Foreign Nationals can be in minimum complexes but cannot work off the grounds. CUSTODY LEVEL DESCRIPTION ADC OBJECTIVE CLASSIFICATION CUSTODY AND INTERNAL RISK TECHNICAL MANUAL MINIMUM Custody is LOW RISK to the public of escapes or committing violence while outside of the prison perimeter, including community work crews. Minimum custody inmates must have five (5) years or less to serve of their earliest release date, not have a current sex offense, and not have any felony detainers. INTERNAL RISK SCORE (1) Inmate requires lowest level of control measures. Very Low risk to staff or other inmates to cause disruption or commit violence within the perimeter setting. Inmate may be housed in an open dorm setting with minimal supervision and if minimum custody may be assigned to any work assignment. (2) Inmate requires low level of control measures. Low risk to staff and other inmates to cause disruption or commit violence within the perimeter setting. Inmate may be housed in an open dorm setting with minimal supervision and if minimum custody may be assigned to most work assignments. (3) Inmate requires moderate level of control measures. Moderate risk to staff and other inmates to cause disruption or commit violence within the perimeter setting. It is the understanding of the Town of Marana that if successful, the 1,000 bed women's facility will house an average of minimum security 600 females, with an additional 50 emergency beds for use by the Arizona Department of Corrections for overflow. The Town is in support ofthe application for a women's minimum security facility with the understanding that upon award MTC will undertake additional public outreach, seek further staff review, and request Mayor and Council approval through a Significant Land Use Change. The Town will work with MTC to ensure that the public processes and needed approvals are completed in a timely manner and in accordance with existing Town ordinances and procedures.
