A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT
BETWEEN RICHMOND AMERICAN HOMES, INC., TITLE SECURITY AGENCY OF
ARIZONA, AND TOWN OF MARANA FOR LOTS 1 THROUGH 145 AND COMMON
AREAS Al, A2, B1 & B2, AND ACCEPTING FOR MAINTENANCE THE PUBLIC
IMPROVEMENTS IN CONTINENTAL RANCH PARCEL 4.
WHEREAS, Continental Ranch Parcel 4 is a 29.24 acre subdivision located south of Wade
Road and east of Silverbell Road containing Lots 1 through 145 and Common Areas Al, A2, B 1 and
B2 as depicted on Exhibit A and incorporated herein by this reference, and recorded at the Pima
County Recorder's Office in Book 48 of Maps and Plats, Page 82; and
WHEREAS, the Town has previously entered into an Assurance Agreement between
Richmond American Homes, Inc., (beneficiary) under Trust No. 624 and Title Security Agency of
Arizona, (trustee), recorded at the Pima County Recorder's Office at Docket 10538, Page 1692
assuring the completion of public improvements; and
WHEREAS, Richmond American Homes, Inc., has completed the public improvements
acceptable to Town standards in accordance with the Assurance Agreement for Continental Ranch
Parcel 4.
WHEREAS, Richmond American Homes, Inc, has satisfied all Linear Park financial
requirements to the full satisfaction of the Town.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the To~m of Marana
as follows:
Section 1. Continental Ranch Parcel 4, lots 1 through 145 and Common Areas Al, A2,
B 1 and B2 are hereby released fi.om the Assurance Agreement between Richmond American
Homes, Inc., under Trust No. 624, and Title Security Agency of Arizona.
Section 2. The Town accepts for maintenance, including maintenance of regulatory
traffic control and street signs, .9609 miles of paved streets for the following appurtenances,
as depicted on Exhibit A:
a. Blythe Place
b. Carefree Way
c. Hassayampa Place
d. Kearny Drive

f. Siskiyou Drive
g. Surprise Dr/ve
h. Tuzigoot Way
i. Wenden Way
j. Wilhoit Way
Section 3. Common Areas Al, A2, B1 and B2, as depicted on Figure 1, shall be owned
and maintained by the Continental Ranch Community Association.
PASSED AND ADOPTED by the Mayor and Council of the Town o fMarana, Arizona, this
day of January, 2002.
