HomeMy WebLinkAboutResolution 2002-002 release of assurance agreement for continental ranch parcel 9MARANA RESOLUTION NO. 2002-02 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN RICHMOND AMERICAN HOMES, INC., TITLE SECURITY AGENCY OF ARIZONA, AND TOWN OF MARANA FOR LOTS 1-13, 15-31, 80-122, 130-144, 187-189 & 205-237 AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN CONTINENTAL RANCH PARCEL 9. WHEREAS, Continental Ranch Parcel 9 is a 56.307 acre subdivision located north of Wade Road and east of Silverbell Road containing Lots 1 through 237 and Common Areas A1 & A2 as depicted on Exhibit A and incorporated herein by this reference, and recorded at the Pima County Recorder's Office in Book 47 of Maps and Plats, Page 43; and WHEREAS, the Town has previously entered into an Assurance Agreement between Richmond American Homes, Inc., (beneficiary) under Trust No. 623 and Title Security Agency of Arizona, (trustee), recorded at the Pima County Recorder's Office at Docket 10538, Page 1699 assuring the completion of public improvements; and WHEREAS, Richmond American Homes, Inc., has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Continental Ranch Parcel 9. WHEREAS, Richmond American Homes, Inc, has satisfied all Linear Park financial requirements to the full satisfaction of the Town. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Continental Ranch Parcel 9, lots 1-13, 15-31, 80-122, 130-144, 187-189 & 205-237 are hereby released from the Assurance Agreement between Richmond American Homes, Inc., under Trust No. 623, and Title Security Agency of Arizona. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 1.8 miles of paved streets for the following appurtenances, as depicted on Exhibit A: a. Avondale Place b. Cantora Way c. Harcuvar Drive d. Kamelik Place Page 1 of 2 Marana, Arizona Resolution No. 2002-02 e. Red Rock Drive f. Sauceda Drive g. Sayante Way h. Somerton Drive i. Tacna Drive j. Wellton Way Section 3. Common Areas A1 and A2, as depicted on Figure 1, shall be owned and maintained by the Continental Ranch Community Association.
