HomeMy WebLinkAboutResolution 2002-023 release of assurance agreements in copper moonMARANA RESOLUTION NO. 2002-23 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN PULTE HOME CORPORATION, LAWYERS TITLE OF ARIZONA, AND TOWN . OF MARANA FOR LOTS 116A, 117A, 11SA, 209 - 315 AND COMMON AREAS M - R, AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN COPPER MOON. WHEREAS, Continental Ranch 36 - 38 & 40 Phase III is a 34.45 acre subdivision located north of Twin Peaks Road and east ofCoachline Blvd containing Lots 116A, 117A, 118A, 209 - 315 and Common Areas M - R as depicted on Exhibit A and incorporated herein by this reference, and recorded at the Pima County Recorder's Office in Book 52 of Maps and Plats, Page 66; and WHEREAS, the Town has previously entered into an Assurance Agreement between Pulte Home Corporation, (beneficiary) under Trust No. 7924-T and Lawyers Title of Arizona, (trustee), recorded at the Pima County Recorder's Office at Docket 11300, Page 535 assuring the completion of public improvements; and WHEREAS, Pulte Home Corporation, has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Continental Ranch 36 - 38 & 40 Phase IlL WHEREAS, Pulte Home Corporation, has satisfied all'Linear Park financial requirements to the full satisfaction of the Town. NOW, THEREFORE, BE IT RESOLVED by the Mayor.and Council of the Town of Marana as follows: Section I. Continental Ranch 36- 38 & 40 Phase 12'I, lots l16A, l17A, 118A, 209-315 and Common Areas M - R are hereby released from the Assurance Agreement between Pulte Home Corporation, under Trust No. 7924-T, and Lawyers Title of Arizona. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 0.9 miles of paved streets for the following appurtenances, as depicted on Exhibit A: · Chesapeake Drive · Colony Park Drive · Mission Valley Drive · Stonebrook Drive Page 1 of 2 Marana, Arizona Resolution No. 2002-23 · Victory Court Section 3. Common Areas M - R, as depicted on Figure 1, shall be owned and maintained by the Continental Ranch Community Association.
