Regular Council meetings are usually held the first and third Tuesday of each month at 6:00 PM at the Marana Municipal Complex, although the date or time may change and additional meetings may be called at other times and/or places. Contact the Town Clerk or watch for posted agendas for other meetings. This agenda may be revised up to 24 hours prior to the meeting. In such a case a new agenda will be posted in place of this agenda. (Mo El-Ali) Discussion: Marana Town Code Section 3-4-7 provides generally that the Town Council approves purchases through the inclusion of the purchase in the Town's adopted budget.  However, per section 3-4-7(B)(3), separate Town Council approval is necessary where the purchase is authorized in the adopted budget but the funds exceed the budgeted amount by more than $50,000.      The budget for fiscal year 2021-2022 was adopted on June 15, 2021. The Marana Road Realignment Project (ST044) was properly included within the Town of Marana’s FY2022 Capital Improvement Plan. The Town Council-approved budget for the project is $333,555 within the Downtown Reinvestment Fund.       The Town of Marana has received a competent bid proposal from Whelcon Contractors in the amount of $398,958.95 to construct an Art Monument within the round-about located at Marana Rd and Sandario Rd. This Art Monument is a component of the Marana Road Realignment Project (ST044). This bid exceeds the available funds thatMarana Regular Council Meeting 10/19/2021 Page 8 of 57 Marana Road Realignment Project (ST044). This bid exceeds the available funds that were authorized by the Town Council by $65,403.95. An additional $14,596.05 is being requested to fund unforeseen project costs for a total project increase in budgeted expense authority of $80,000.    Financial Impact: Fiscal Year:2022 Budgeted Y/N: No Amount:$80,000.00 This is an increase in budgeted expense authority of up to $80,000, from within the Downtown Reinvestment fund (Fund 3025) to the Marana Road Realignment Project (ST044) in the same fund. Staff Recommendation: Staff recommends the described addition of expenditure authority for the Marana Road Realignment Project.  Suggested Motion: I move to approve the increase in budgeted expense authority of up to $80,000 from the Downtown Reinvestment fund (Fund 3025) to the Marana Road Realignment Project (ST044) in the same fund. Location The subdivision will be located within Block 37 of the Gladden Farms Blocks 26-43 block plat (Book 62, Page 64) south of West Mike Etter Boulevard, east of Midfield Road and west of Clark Farms Road. Zoning The zoning for Block 37 is F - Specific Plan (Gladden Farms II) with a land use designation of High Density Residential (HDR).  The HDR land use permits detached single-family detached homes with a minimum lot size of 3,500 square feet. The proposed minimum lot size is 4,792 square feet. The proposed maximum lot size is 10,834 square feet. The proposed average lot size is 6,251 square feet. Transportation The subdivision will have two entries from West Mike Etter Boulevard on North Portus Drive and N Hamlin Drive, both 60-foot rights-of-way.  Another entrance will be from the south via N Olin Avenue (42-foot right-of-way) and N Birchfield Drive (75-footMarana Regular Council Meeting 10/19/2021 Page 10 of 57 the south via N Olin Avenue (42-foot right-of-way) and N Birchfield Drive (75-foot right-of-way) from Gladden Farms Block 42. The typical internal street section is a 42-foot wide public right-of-way. Recreation, Park Requirements and Trails Per the Gladden Farms II Specific Plan, 185 square feet of on-site recreation area per single-family detached residence is required. This subdivision requires a minimum of 39,220 square feet of recreation area. A total of 86,618 square feet of recreation area is provided within Common Areas "B-1," "B-3," and "B-5." Preliminary Plat The preliminary plat for Gladden Farms Block 37 was approved by Town Council on February 16, 2021, by adoption of Resolution No. 2021-017.  Staff Recommendation: Staff has reviewed the request against the requirements of the Gladden Farms II Specific Plan, the Town Code and the Marana General Plan. This final plat is in substantial conformance with all required development regulations and staff recommends approval. In comparison to September 2020, Development Services issued 73 single -family residential permits; • The number of single -family residential permits as of now stands at 17; • Dr. Jing Luo presented on water issues during the Community Conversations Meeting, and the information was well -received by the public attending; additional meetings have been schedule, and more to follow o October 26 at the MMC o November 6 at Coyote Trails o Possibly in Dove Mountain and Sunflower • CAP Trailhead Ribbon-Cutting on October 30. Marana Regular Council Meeting 10/19/2021 Page 25 of 57 Regular Council Meeting Summary Minutes October 5, 2021 P a g e | 4 Principal Planner Steven Cheslak provided an overview of this request to amend Marana Ordinance No. 2004.23, by eliminating a rezoning condition related to lot sizes (Condition 18), reconfiguring lots according to a new conceptual land use plan, and revising other rezoning conditions to conform to intervening Town actions, current Town policies, and current Arizona law. Mr. Cheslak provided an overview of the existing land use plan and the requested new conceptual land use plan. Mr. Oland stated that Mr. C heslak had explained most of the plan; however, wanted to emphasize that the two (2) main thrust behind their redesign is 1) get the minimum lot size to 6,000 sq. ft., as the last time he presented to Council, that plan was not well received, it had a smal ler lot size. They increased the size of the lot to 6,000 and it conforms with everything else surrounding it; however, with the exception of Fianchetto, that has different zoning. 2) To make the recreation amenities within the subdivision much more of a functional amenity. Council Member Craig stated that she does like the use of open space as well as the trail system, and that there is access to the Barnett Channel. She asked whether the trails would allow people to cross Clark Farms Blvd. Mr. Oland re sponded stating those would be crosswalks. The other thing that they have done was to provide amenities on both sides of the subdivision. Except for the dog park that is on the north side, the people on the north and south would be able to access the playg rounds and picnic areas without having to cross Clark Farms. Council Member Kai inquired of the retaining walls around the subdivision, as an example the south and east side. Mr. Oland clarified asking whether Council Member Kai was referring to abutment of the existing homes . He explained that those would be graded to the existing homes. That there would not be a grade difference between those homes. Council Member Kai asked about the homes on the south side of Moore Road asking whether there is a wall on that side. Mr. Oland replied stating they plan to match the grading in that area to the existing homes on the south side. Where there are homes on the southeast side, the grading would be close as well. Lawson) Discussion: This application is for a Series #009 Liquor Store liquor license at Marana Chevron, located at 13960 N Sandario Rd, Marana, AZ 85653.   Pursuant to state law, the application was posted at the premises where the business is to be conducted.  The posted notice provided that residents within a one-mile radius from the premises may file written arguments in favor of or opposed to the issuance of the license with the Town Clerk’s Office within 20 days of the posting.  Any written arguments received by the Clerk’s Office for or against the proposed liquor license are attached to this item and will be submitted to the Department of Liquor Licenses and Control (DLLC).   Town staff has reviewed this application to determine whether the applicant is in Marana Regular Council Meeting 10/19/2021 Page 29 of 57 compliance with zoning, building and other legal requirements for the business.  Additionally, the Marana Police Department has conducted a local background check.    The Town Council must enter an order recommending approval or disapproval of the application within 60 days after filing of the application.  Pursuant to state statute, a license will only be issued after a satisfactory showing of the capability, qualifications and reliability of the applicant and “in all proceedings before the town council, the applicant bears the burden of showing that the public convenience requires and that the best interests of the community will be substantially served by the issuance of a license.”   If the Council’s recommendation is for disapproval, the order must include an attachment stating the specific reasons for the recommendation of disapproval and including a summary of the testimony or other evidence supporting the recommendation.   If the Council enters an order recommending approval of the application, or makes no recommendation, then no hearing before the Arizona state liquor board will take place, unless the director of the DLLC, the liquor board or a resident within a one-mile radius from the premises requests a hearing.  If the Council enters an order recommending disapproval of the application, or if the director, board or a resident within a one-mile radius from the premises requests a hearing, then the state board will hold a hearing regarding the application.   At the hearing, the state board will consider all evidence and testimony in favor of or opposed to the granting of the license.  The decision of the board to either grant or deny an application will normally take place within 105 days after the application has been filed, unless the director of the DLLC deems it necessary to extend the time period. Once issued, this liquor license is transferable from person to person and/or location to location within the same county and allows the holder both on- & off-sale retail privileges. This license allows a bar retailer to sell and serve all types of spirituous liquors, primarily by individual portions, to be consumed on the premises and in the original container for consumption on or off the premises. Marana Regular Council Meeting 10/19/2021 Page 51 of 57    Council-Regular Meeting   D1        Meeting Date:10/19/2021   To:Mayor and Council From:Yiannis Kalaitzidis, Finance Director Date:October 19, 2021 Strategic Plan Focus Area: Community,  Recreation Subject:PUBLIC HEARING: Ordinance No. 2021.022: Relating to Transaction Privilege Tax; amending the Town Tax Code by increasing the tax rate on certain activities by one-half cent for the design and construction, and fixtures, furniture and equipment, for a new Multi-generational Community Center and Aquatic Center and for other necessary capital improvement projects; amending Sections 8-460 (Retail sales; measure of tax; burden of proof; exclusions) and 8-610 (Use tax: imposition of tax; presumption) of the Town Tax Code by adopting Local Option V of the Model City Tax Code establishing an alternate tax structure for certain sales/purchases; and designating an effective date (Yiannis Kalaitzidis) Discussion: At the December 8, 2020 Council meeting, staff presented the initial findings of the Parks and Recreation Ten Year Master Plan.  The Plan identified the need for a multigenerational community center and aquatics facility (Project) for a growing community of our size.  After going through an additional 30-day public comment period, Council adopted and approved the implementation of the Parks and Recreation Ten Year Master Plan.  During the process, the Town received almost 400 interactions on the Plan, of which the vast majority were favorable.   Based on the feedback received, Town Council directed staff to undergo a site selection study for the Project.  Staff presented various options to Council during a Study Session on June 8, 2021. The Council selected the West site, bounded by Marana Main Street to the east and Bill Gaudette Drive to the south, for the location.   At the June 22, 2021 Council Study Session, staff presented information to Council regarding funding sources to support service levels in our growing community, including information regarding potential funding sources for the Project. Council Marana Regular Council Meeting 10/19/2021 Page 52 of 57 directed staff through a unanimous motion to undergo the public process for a possible sales tax increase for the Project. The direction at the time was to maintain the increase as a permanent tax to be used for other public infrastructure that the Town of Marana will need in the future.   Staff initiated a public outreach plan explaining the need and funding options for constructing this Project as well as other similar public infrastructure. Staff developed a plan which included social media outreach, public notices, a new dedicated webpage, and four public meetings at different sites across the Town to provide Marana residents the opportunity for input. The meetings were attended by approximately 35 residents. Social media outreach reached thousands of people and produced approximately 70 comments, predominantly supportive of the tax increase for the proposed Project.   As required by Arizona Revised Statutes, a notice of Intent to Change the Tax Code was posted on the Town’s website 60 days before tonight's meeting to possibly adopt the new tax rate, and a notice was also published in a newspaper of local circulation 15 days before the meeting. After the public hearing this evening, staff is seeking Council's consideration of the proposed ordinance which would do the following: Increase the transaction privilege tax rate by one-half cent on all classifications except the following: Construction Contracting under Town Tax Code Sections 8-415, 8-416, 8-417  Hotel/Motel – Additional Tax under Town Tax Code Section 8-447 Mining under Town Tax Code Section 8-432 Telecommunication Services under Town Tax Code Section 8-470 Utility Services under Town Tax Code Section 8-480 1. Adopt Local Option V of the Model City Tax Code to impose an alternate tax structure on sales/purchases of "big-ticket" items. The proposed ordinance would provide that the full amount of any single item purchase over $5,000 will be taxed at the current, lower tax rate (2%). 2. Require that the proceeds from the tax increase be placed in a newly established fund for the financing, design and construction, and fixtures, furniture and equipment, for the new multigenerational community facilities and aquatics center, and other public infrastructure projects that have a direct benefit to the community. The ordinance specifies that the proceeds cannot be used for new positions, salaries, equipment, repair, operation, or maintenance, or other day-to-day operational needs of the Town. 3. Set an effective date of January 1, 2022 for the tax rate increase.4. Authorize Town staff to perform all actions necessary to give effect to the ordinance.5. Should the ordinance be approved, Staff will provide notice to the Municipal Tax Code Commission and the Arizona Department of Revenue within 10 days of approval (A.R.S. §42-6053(E)). Financial Impact: Fiscal Year:2022 Marana Regular Council Meeting 10/19/2021 Page 53 of 57 Budgeted Y/N: If approved Amount:$3.2 million Based upon internal staff analysis, the Town anticipates that the additional one-half percent sales tax will generate $6.25 Million in the first year of collections, and similar amounts annually depending on economic conditions. Due to the uncertainty associated with the economy, it is our recommendation that the additional one-half cent sales tax rate remain in effect at least until such time as adequate funds have been collected to pay all costs associated with the financing and construction and acquisition of the project(s). This amount will be used towards the construction of the building and also the fixtures, furniture and equipment associated with the community center and aquatics facility. Should the ordinance be approved, Town staff will include estimated revenues in the fiscal year 2022-2023 budget. Staff Recommendation: Staff recommends approval of the proposed ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, AR IZONA, AS FOLLOWS: SECTION 1. The tax rate for all activities taxed in the Town Tax Code , except those activities listed in this Section 1, is hereby increased by one -half cent. The Town shall establish a separate fund for the design and construc- tion, and fixtures, furniture and equipment, for a new multi-generational Community Cen- ter and Aquatic Center and for other necessary capital improvement projects , and the pro- ceeds from the tax increase adopted by this ordi nance shall be placed in this separate fund. For purposes of this ordinance “other necessary capital improvement projects” are defined as those capital building projects or amenities which provide a direct benefit to the quality of life of Town of Marana residents, or provide enhanced service delivery. The proceeds from the tax increase shall not be used for new positions, salaries, equipment, repair, oper- ation, or maintenance, or other day -to-day operational needs of the Town.
