OF PAGES: 2 SEQUENCEz 20031381029 07/18/2003 ORDIN 15:49 MAIL AMOUNT PAID MARANA ORDINANCE NO. 2003.18 $ 8.00 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AMENDING THE CONDITIONS OF ORDINANCE NO. 2'003.02, A REZONE OF THE PROPERTY LOCATED WITHIN THE TOWN LIMITS AT THE SOUTHWESTCORNER OF FLYING DIAMOND AND CAMINO DE OESTE, ASSESSOR'S PARCEL NO.216-27-1100. WHEREAS, Cheng Holdings Limited Partnership owns approximately 9.56 acres of property, in a portion of Section 12, Township 12 South, Range 12 East, described as Assessor's Parcel No. 216-27-1100; and WHEREAS, the Marana Planning and Zoning Commission held a public heating on December 18, 2002, and voted unanimously to recommend that the Town Council approve the rezone with conditions; and WHEREAS, the Town Council held a public heating on February 4, 2003, to obtain input from the Applicant, Town Staff, and the public on Ordinance No. 2003.02, the rezoning of the Property, and has determined that the rezone was in the best interest of the residents and the Town of Marana and should therefore be approved, with conditions; and WHEREAS, Cheng Holdings Limited Partnership has requested that condition # 4 of the approved rezoning conditions be amended as follows: Item #4 - Current Verbiage - "A maximum of thirly percent of the total site may be disturbed, exclusive of Major Routes dedications. Building envelopes shall be established through the platting or lot split process, reflective of the thirty percent total site disturbance restriction." Item #4 - Proposed Verbiage - "A maximum of thirty percent of the total site for each platted lot may be disturbed, exclusive of Major Route dedications. Building envelopes shall be established through the site development/building permit process for each individual lot created herein, reflective of the thirty percent total site disturbance restriction. "; and WHEREAS, the Town Council finds this change does not affect the requirement, but only postpones the selection of the building envelope to the improvement stage. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town o f Marana, Arizona, that condition g4 of the rezordng conditions approved in Ordinance No. 2003.02, be amended to allow the building envelopes to be established through the site development/building permit process for each lot created. i 4 --Page 1 of 2- PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this 15th day of July, 2003. ~ Mayor ATTEST: own Clerk SUTTON, JR.
